The only problem that could arise for Baldwin is that he, as Producer, hired the inexperienced 24 yr old armorer. However, I fail to see how that's manslaughter. Baldwin, as Actor, was handed a prop and was assured it was safe; it's NOT his fault that it contained live ammo.

It is his fault that while that shot was being blocked, he whipped out the gun, cocked it, pointed it the cinematographer, and pulled the trigger. That wasn't close to what he was supposed to doing. And there was absolutely no reason for him to point that gun at Hutchins - he just did it for fun. He was playing around on the set with a gun and effed-up. It's called reckless. He's going to go down for one of those manslaughter charges. His behavior is pretty gross - he offered Hutchins' husband the position of Executive Producer on that film after Hutchins was killed. The widower took it. Hmmm.

@@betsyj59 Your account of the "facts" regarding just how the gun discharged is in question. But assuming this scenario did play out, sworn statements conclude that the "prop" gun handed to Baldwin was "cleared" and announced (and been deemed) as "cold." Which meant it was totally harmless, not even filled with blanks. No doubt this will be an interesting case to follow if for nothing else than to see just how drastically Defense & Prosecution testimony differs. I'm inclined to think more of a case could be argued that Baldwin, as Producer, hired the inexperienced 24 yr old Armorer, Gutierrez-Reed.

Only crime I see why he lied about pulling the trigger and if he knew there was a live round in the gun. The real question is why was live ammo in the gun in the first place. And the only person or person's are the armory personal in charge of all the weapons on the movie set.

Baldwin didn't know that there was a live round in the gun. Yes the real question is how did that live round get onto the set altogether much less in a gun. Gutierrez-Read already went to prison for not properly preparing the gun. But BAldwin is half at fault that he did not properly handle the gun. He allowed it to be aimed at a person. He is going to go down.

It was, likely, a horrible accident. Baldwin should not have accepted someone else's word on the gun's safety. If he didn't and checked the gun himself or asked the person handing him the gun to show him that it was safe, no accident. If he would not have pointed the gun or put his finger on the trigger, no accident.

@@777PattieSo Baldwin wrote script, produced movie and started. Finished filming in Montana and is being sued as he did not pay the crew. Hannah was never paid either. And he settled out of court with Mathew Hutchins and it is over a year and he has not made a payment-deadbeat-so now facing additional civil charges.

You obviously do not know how the chain of handling works in the entertainment industry. Actors ARE suppose to rely on the technicians. It is not the actors responsibility to do so. First of all how many actors would know what to look for in a loaded gun. In other words, if the rounds in the chambers are live or blanks or the right caliber or for the right desired effect. There are many types of blank cartridges and dozens of live ones and some blanks look just like live ones. True if he had not pointed the gun at a person WHICH IS WHAT HE WAS SUPPOSE TO DO IN THE FIRST PLACE, no accident.

He is so used to doing movies that there is no way he did that intentional. It was an accident. What happened was the girl that handed him the gun should’ve made sure that there was no bullets in there. That’s whoever’s handed him. The gun is who’s that fault not him firing it. He’s trusting that the person that handed him the gun is doing what they’re supposed to do. It’s a movie you’re acting.

He pointed the gun at Halyna (safety rule number one broken) manipulated the action while pointing said arm (rule number two broken) pulled, touched or held the trigger either in process or after manipulation (rule three broken) so three safety rules broken while holding a firearm as if it were a toy.

Yup. If there had been intention to kill, then he would be charged with first degree murder. The defense is proving that Baldwin accidentally killed the director which is a precise match to the charge against him. LOL

@@MovingAlong742the State has two charges of manslaughter against him each with a different theory of the offense. One of Baldwins defenses is that, essentially, he was an innocent victim of someone else’s negligence and not himself a direct cause of the chain of events. For example if a drunk driver loses control, strikes your car, and then your car runs over and kills a pedestrian it’s clearly not your fault and you wouldn’t expect to be charged. That’s the exact issue here, someone else’s criminal negligence is the entire cause of the death. If another actor had been holding that gun the same end result is likely to have happened. Did he knowingly pull the trigger or not, and did it misfire, are as irrelevant as if you swerved left or right after your car was struck. In the heat of the moment you’re functioning of instincts based on your driving experience and not consciously controlling the car. It’s important to note that *another actor was found with a live round* and he was due to film a shootout scene. It’s recognize given the facts here that Baldwin isn’t criminally responsible here and shouldn’t have been charged. Had he known a live round was loaded, or had the armorer done her job, none of this would have been happened.

Any person who points a gun on another person is NOT a character of a NORMAL person! He should be ACCOUNTABLE for the LOST LIFE, not to rely on other people's opinion as the legal bases for his FREEDOM! Recklessness is a felony, tantamount to a GUILTY verdict! Otherwise, RECKLESSNESS should not be included as an element when committing a crime -check if there are people who serve a jailtime for RECKLESSNESS and you will be surprised there are TOO MANY of them who did the same but still ROT in jail to this day! Lucky guy!

As an actor he should be aware that you don't point a gun and pull the trigger on a fiction movie set. It's not worth it (as we see in this case). As the producer it was his responsibility that all precautions were followed by everyone under him. I see a jury finding him guilty of manslaughter, especially if the prosecutor produces a photo of the victim before and after.

I totally agree with you. I've been posting like posts for years now. I'm in the technical theatre field and was an armorer at one theatre for 18 years. The first thing I told the actors that had to use a gun on stage is 'don't actually point it in the direction of another person.' I have a perfect safety record at that theatre. The reason I wasn't one after that theatre was I moved on to another and they already had an armorer.

A producer hires an inexperienced armorer to save money...think about it, seriously! Why wouldn't you double check? How did live rounds get on the set?

That's an interesting question about the live rounds got on the set in the first place. It was widely reported after the killing happened that crew members were loading guns from the set and using them to play target practice during their lunch breaks. That set was not run professionally at all.

I saw that too. He moved his chair to be in direct line of sight. On the flip side, I don’t blame him. The cop is now denying his own assessment of Baldwin and other individual’s behavior as seeming to be a terrible accident. Why does cop continually try to deny his own statement.

Any person who points a gun to anyone then fires the said gun whether there are LIVE BULLETS or not, should be immediately put in jail, not to be regarded as mere ACCIDENTAL.
