Not many people have the means to sue. And social media counts on that to propagate their lies…

Wow. I've been bringing up that California case law about how even a private business can be considered public if it's entire business model is to allow people to use it's space freely and openly, and thus they must allow all forms of protective speech to go on there. And these social media companies are definitely public spaces that allow anyone to freely join those spaces, and thus should have freedom of speech protection. I think I've heard maybe one other person bring this up. Because all of these companies are based in California, the must adhere to both California's constitution and their supreme courts ruling.
@JJpmfc2 жыл бұрын
But they aren’t allowed to use it freely and openly. They have to abide by certain terms to use it, terms that can be changed at any time. Their terms specifically state you are not allowed to post anything you want to say.
@augustgreig94202 жыл бұрын
@@JJpmfc Believe it or not, but those "Terms and Conditions" like the ones on Facebook which are extremely long and written in lawyer speak that most people can not understand. They are by no means as difficult to get around as an actual contracts. But even contracts can legally be broken for a number of reasons, from age, to unfair or illegal demands, especially obfuscated in the small print and written in such a way that it's virtually impossible for a normal person to make sense of it.
@Astraeus..2 жыл бұрын
@@augustgreig9420 Except the part that he's trying to "get around" was a suspension or termination, which Twitter has locked up pretty tight based on the exact wording in the ToS. It states quite clearly they can suspend or terminate an account at any time and for any or no reason, which is about as bulletproof a statement as can be made. Any time, and for any or no reason at all. Meaning they can do whatever the actual fu@$ they want when it comes to suspension/termination of an account.
@augustgreig94202 жыл бұрын
@@Astraeus.. Not true because they have to obey section 230 or they lose all legal protection. They aren't allowed to curate content be sure it violates the law..a ToS can't contain anything illegal, it won't hold up, and in some states just one illegal condition will get the entire thing throw out. They have no right to do this. The only issue is there hasn't been enough people sueing them, and it would probably be great if it went to the appeals court where the law could really be codefide into law, and precedent set. It's just no one has really fought them on that point. The government can't just come after them without a combining victim.

Joe actually followed Tate on IG etc, love that he's bringing light to this issue. Massive issue. People being gagged for speaking their mind, which is totally insane. If this isn't a dictatorship, dunno what is. Ppl should be out in the millions breaking shit untill there's resolve imho

Difference was that tate was advertising his pyramid scheme and this guy simply stated an actual fact.

Having Tate on the podcast would be huge. It would likely end up being one of the most viewed episodes to date. That said, I don’t see Spotify allowing it to transpire without a fight. The powers that be are doing everything they can to delete him from the internet entirely. He’s gotten the Alex Jones treatment with his bank and web hosting dropping him in addition to all the social media platforms.

The problem with his argument is you don't have to agree to anything to go in a mall and protest. Twitter has you sign your rights away before entering.
@themonsterunderyourbed94082 жыл бұрын
Not true. A-Then Twitter shouldn't refer to themselves as a public space or advertise themselves as a social media platform B-Just by interacting with society you agree not to break any laws.
@HarryBalzak2 жыл бұрын
You can go to the mall and protest, but unless it is a public owned mall(I doubt they exist), they can trespass you. Also, groups of more than five protesting on public land have to have a permit. Lack of a permit is legally considered a riot. Seriously. Nowadays they have even created "free speech" zones, where they relegate any protests to small out of the way areas. The government hates free speech. If you ignore what they say and pay attention to what they do it is blatantly obvious.

Social media platforms are PRIVATE businesses. No one is stopping you from saying anything you want. Go stand on a street corner and "yammer away". But you can't yell fire in a crowded theater AND A PRIVATE company can set their own terns of service. Are you for big government interfering more in private business or not? You can't say yes when it suits you and no when it doesn't.

The First Amendment of the US Constitution does NOT give people the right to "protest". It gives people the right to PETITION THE GOVERNMENT. Signing a Petition is completely different than violently Protesting, rioting, blocking traffic, pulling fire alarms, breaking windows, burning police cars, and harming people. So if I owned a mall, I would have every right to Prevent people from protesting on my property. That part's covered in the Second Amendment.

@Chipwhitley2742 жыл бұрын
This man does not understand that private property doesn't work like public property. You have the right to free speech... you don't have the right to use their service to communicate your speech. There is no Constitutional protection here... there is no Constitutional violation. And forcing private property to allow protestors is not free speech protection... it is property rights violations. You can protest from public property all you want... you don't get to enter property against a property owners will. You do not get to violate other people's rights in your pursuit of expressing yours.
