Khelif isn't suing. They are filing a criminal complaint. It's for French prosecutors to decide of they want to prosecute Musk and Rowling in criminal court. And honestly I think the reason Khelif is doing this is political and part of gender activism. They go after the biggest people to make a point to the rest of the public that if you misgender me I can request you be charged or arrested for a crime. It's really being done as a public message. It's super obvious what Khelif is doing. I think it will backfire because Khelif is a public figure/celebrity and that likely is a defense in this case. Also the public backlash to "misgendering" being punishable as a crime will be swift. The public has already stated that they aren't OK with gender self ID laws or even misgendering laws. Any win Khelif gets will result in conservative politicians winning across the western world. I think Khelifs other goal is that if they win in criminal court then they could bring a subsequent suit against Rowling and Musk in civil court to get some monetary damages. BUT!!! 90% of medical malpractice cases settle out of court, with only 10% going to trial. If they settle with her which means she was compensated enough to let the case drop which is still a win. The IBA was forced to investigate and test them twice because female boxers,coaches and trainers were complaining about them and other biological men trying to enter the adult women's circuit. Algerian here, so I believe my answer will be culturally knowledgable. It is perfectly legal to carry and touch somebody of the opposite gender in Algeria (with their consent ) and, to the best of my knowledge, there are no laws there to forbid signs of affection between men and women. Now, Algeria is still a rather conservative place and I would say that the majority of fathers would not like to see their daughters in such close physical proximity with a man and especially in public. The issue is rather that of family honor and displayed modesty than that of religion and gender. Now, personally I hug my male friends in public in Algiers but I wouldn't do it in front of my father, for example. However, in the moment if I am very emotional as I imagine Imane was when she won, I would probably not think things through and be spontaneous. Imane has made it clear that she is muslim but that doesn't imply that she needs to abide by each rule of Islam, she is human after all. It's like seeing a married jewish woman and implying she's either not jewish or not a woman if she doesn't wear a wig or a head covering. Religion is set in stone but religiosity doesn't always overlap perfectly and depends on personal preferences.

It’s not the first time in sports history that athletes have been successful based on their medical anomaly’s eg acromegaly. Authorities turned a blind eye maybe because it was rare, and chose only to focus on banned substances. Now the gender issue is topical and similar issues will become more common with time. The rules have to accommodate for this now, eg check karyotype, have testosterone level based categories plus weight- not just for fairness but safety.
