The only state that has a law requiring police officers to identify themselves is Massachusetts. Cops still don't ID and they're never prosecuted for violating Mass state law.

Ricky Granderson, there is no law or any case law where it says that officers must give citizens their name and badge number, and the reason why they don't have a law it's because is not considered a crime. However, you do have three states that have statutory laws where officers must give his or her name and badge number. 1. California Penal Code 830.10, Any uniformed peace officer shall wear a badge, nameplate, or other devices which bears clearly on its face the identification number or name of the officer. 2. Massachusetts Statutes section 98D. Each city or town shall issue to every full-time police officer employed by an identification card bearing the officer's photograph and identifying information. Such identification card shall be carried on the officer's person and shall be exhibited upon lawful request for purposes of identification. 3. New York City the Right to Know Act. which requires officers of the NYPD to provide citizens with their name rank command and shield numbers during pacific interaction such as Terri Stops even if the citizen does not request this information and they are also required to give a business card.

@@robertortiz8540 The difference being is that Massachusetts Code - Chapter 41 - Section 98D is a state general law. "Identification cards. "Section 98D. Each city or town shall issue to every full time police officer employed by it an identification card bearing his photograph and the municipal seal. Such card shall be carried on the officer’s person, and shall be exhibited upon lawful request for purposes of identification." Notice that the word "shall" in law or code means "must". When enacted, general law governs the relationship between a citizen and applicable governing bodies. A citizen's responsibility for paying taxes, following rules of the road while driving, and the use of business licenses are each examples of relationships between citizens and government covered by general law.

Fun fact: if you insert the number of police (city, county, and state police), their militarized equipment, and their budgets in our nation into the list of the worlds most powerful militaries... The US Police would tank third (3rd!!) behind the US military and the Chinese military. That's higher than Russia, India, N. Korea, Germany, UK, France, Spain, Italy, and S. Korea.

She wouldn't ID because the request wasn't a lawful order, so he thought he could run her license plate and ID her. Increasingly, law enforcement will take a picture of a person and identify that person through an image recognition database such as ClearView or Rekognition. With biometrics, your face is your ID so refusing to provide an ID is becoming somewhat meaningless.

Not only was she protected under the 1st Amendment for filming on public property, she was also protected under precedent set by Glik v Cuniffe by filming police officers in public on duty.

What a great idea! Have an auditor for every cop on the street. Right along with them. On every stop.on every encounter with the public. Explain to the auditor exactly every move they are going to make if possible before they make said move. Auditor has final call on whether to issue bs tickets for tint, pulling service issue weapon or not whether to use tazer on someone in the water .in short, be their conscience, since most don't have 1.

It’s not that he didn’t understand public property, his dumbfounded look was trying to figure out how to make up laws to harass and intimidate. He’s never taken a debate class. His questioning is ridiculous and he may be either on or off his meds since he keeps repeating the same question and she clearly answered. He just doesn’t like the answers. In his mind: How dare she walk around free and do what the constitution allows her to do.

You can't teach people not to be lying pieces of garbage who are obsessed with maintaining power and control over every situation they put themselves into. This is not a matter of their knowledge of the law, it's not a matter of training. It's a matter of a rotten cult-like culture within law enforcement that feels entitled to violate the law and the rights of citizens and a legal system that allows them to get away with it the vast majority of the time it's been perpetrated. These people legitimately think that they can just make up or outlandishly interpret the law (or just manipulate citizens with lies about the law) on the spot in whatever way serves their immediate goals or interests, that will continue as long as they're able to get away with it in any form.

About an hour and a half ago I had my first encounter with the police where knowing my rights was essential. However, I am a retired paralegal. Still, watching your videos was very helpful in how to speak to the officers. They asked to talk and I inquired to the nature of the contact. It wasn't regard to what I had written in a study room at CSU. They used every trick that was in your videos and my knowledge of the law, case law included, I declined to answer their questions and refused to give ID. Yes thr confused looks were evident. I got them to agree that no crime had occurred and no ill intent was present and both officers finally left. I felt good about the encounter and taking the win.

I don’t think it’s a matter of the officer not knowing the law, necessarily, but more the confusion of not being able to control and demand to get his way. This was gold. And as for the cam back from one of the officers…. I always love when the auditor notifies them not to go deleting the video because it will be FOIA requested. If it's his private cell phone and not issued by the police then you are not getting anything off of it without a warrant just as the cops couldn't get the video from the auditor without a warrant. Even if government issued so many FOIA request are denied as "exemptions" which are carefully crafted to purposely keep you from getting info.

Once a cops ego is bruised it’s almost impossible to get them to identify. That’s why the auditor’s first question should always be “what is your name and badge number?”

The Officer articulated a reasonable cause of fear for officer safety when he said "you may film a UC car." He then asked her to leave and she refused. Hey former cop running this site have you ever worked UC? Read United States vs. Kokinda. Just because a property is government owned doesn't automatically mean anyone can wonder around on it. The amazing thing is the officer knew he was in the wrong all along. When his bullying tactics didn't work he walked away. Every one of those men knew they were in the wrong. If they actually thought she was breaking the law they would have had her on the ground and that camera out of her hands in a second.

Really nicely done. Remained calm, was polite, but absolutely asserted her rights and utterly refused to back down, but without deliberately escalating- a number of auditors seems to want a fight, rather than an opportunity to educate.

I’m pretty sure he means things should be taken even further than Terry v Ohio. Abolish qualified immunity and make it illegal to detain someone without specific articulable facts that a crime has been committed. Instead of it being RAS, reasonable suspicion, it should have to be specific articulable facts instead of just suspicion.

The fact that auditors will say something like “Gathering content for a story” and post everything that goes on in their story isn’t exactly a lie. The waste of taxpayers money falls on officers who make issues out of legal activities.

I haven't seen any auditor on any 1AA channel that has broken any law willingly. Only the cops. Every auditor, even the rude ones, are the last heroes left in America. Feelings of resentment to them doesn't reduce the position of the cause. If it's legal, then don't be upset because you didn't like the content. Either it's all okay according to the 1st amendment or none of it is. "While we may not like what another would say, we'll defend to the death their right to say it."
