She knew her “roommate” had asthma and that synthetic smells would trigger it, she decided spur of the moment to buy a candle still knowing about his condition. How would this not be her fault? She thought he made it up and she messed around and found out lol.

The judge should have asked for his inhaler. An person who has asthma usually carries one.

Judge Ross sounds insane saying the guy doesn't have to carry an inhaler when he knows he has asthma…asthma is DEADLY! My friend mom passed away in walmart from asthma cuz of some spray and they couldn't sue b/c her mom handnt carried an inhaler for years knowing asthma is deadly… As callous as it sounds it's his medical condition and he should have an inhaler. My friends mom hadn't had one in 10 years, so I know legally that not an excuse.

I definitely don't agree with this one. Everyone is responsible for their own ailments. Just like someone who has allergies to food can't assume or expect outside entities to cater to them. He should have had an inhaler, he shouldn't have been there or at least made her aware that he was there collecting things. I think she's right, he probably faked that asthma attack...come on 4 or 5yrs without one and you just all of sudden about to fall out 😒😅

Asthma works and effects people who have it differently. Candles can and will trigger a reaction in some people of have Asthma and will not be an issue with others

I have asthma. I have to cross the mall walkway to avoid bath and body works because of the strong perfume smell. I can cough frequently when I'm in an enclosed space with too much perfume like a car. But you are supposed to carry an inhaler just like you carry an epi pen if you highly allergic. A pumpkin pie smelling candle or baked good candle should not send him in a coughing fit or asthma attack. He thought he smelled food. It didn't set off his asthma when he was being nosy and lingered unril he saw the candle. It seems like the idea of a scented candle set him off into a faux asthma attack then a real one. Also, if he didn't have an inhaler on his person when he is that sensitive to smell he should have immediately grabbed one from the room or somewhere in the house. I would have made her pay half only because he breached as well by coming on a day she was supposed to have the house.

This is bs. It wasn’t his night and he didn’t have an asthma attack at the house he was at the GYM.

1st case: Jeopardizing safety like that is just unacceptable! "Faked asthma attack" my 6! She should be arrested for attempted murder!

Sorry, judge bad judgment. She should not have to pay for his stupidity. The world is filled with all kinds of Sent. stores people's home... And why didn't he have an inhaler? That's on him. He never said he was Allergic.to pumpkin pie scented candles... Wow, wow, wow. He should have made a list of the things that he was allergic to if he was really smart.

I have asthma, but people light scented candles around me all the time, so this is some bull crap

I infer from your statement that everybody has the exact type and degree of asthma that you have.

I do agree to have an inhaler on hand however she was aware of it and lit the candle anyway. She caused the problem by buying and lighting it the candle.

I don't see anything wrong with her burning the candle if she was not expecting him to be there. He seems a little whiney to me. If you were there to pick up some clothes, grab a few things quickly and be out!!

Judge I love you but I don't think this is fair. The man was not supposed to be there, he went there without her knowledge to pick something quickly but stayed there talking to his mother for 45 minutes. He did smell something unsusual so he should have quickly taken the stuff he wanted and walked out to talk to his mother. Why then should she pay? It does not sound fair. When I enter my house or my parents house when I am not expected, I shout my presense as soon as I walk in. This man is so lame. He had an asthma attack more than 5 years before and since then had nothing?
