As a citizen of Yemen, I reside in the country and have traveled extensively from east to west. I strongly detest and fear Al-Qaeda more than any other entity on this planet. I believe the UN classifies them as "soldiers of fortune", so they are technically equivalent. Hell mercenaries can even be state sponsored (even though not publicly), so they are fairly equivalent. No it's not illegal. They are used by almost every major country to handle things in other countries. But there's a trade off. I was approached by a PMC shortly after leaving the military, they were looking for Vets to go to South America. The catch was there was no backup, no protection by the government, and no planned extraction should shit go bad. I considered it for a few days but decided the risk of getting stuck, ending up in a basement somewhere without support, or simply dead and forgotten wasn't worth it.
