20:30 i think the intention behind this is just not to punish the will to be free and yes they still catch u and theres overall not much prison breaks at all. so.. its a very nice thing given to ya. u can count it "strange" or something buts its in a deeper sense i think. theres a important sentence in the germans fundamental right that means: "die würde des menschen ist unantastbar" (Human dignity is inviolable) i think it has something to do with that

It is seen as the most basic human instinct to not be physically restrained, as the precondition of all human behavior even. Therefore, the idea is that you mustn’t be punished for your existential drive to walk free, or rather not for the underlying motivation. Of course, if on escaping you commit OTHER crimes, you will get sentenced for those… and you forfeit potential benefits once you are behind bars again, like early release on probation due to good behavior. Some German laws are very much about judging good or evil intent, and the reasoning isn’t in every case particularly consistent… but that’s a VERY complicated discourse in German legal philosophy/theory.

20:30 I think his explanation is poorly worded. It is not that you actually have a _right_ to escape. But you cannot be sued/fined for _trying_ to free yourself. Even freeing yourself from custody or jail... Because you can't switch off the basic instinct to get free. So .... if you are actually in jail and escape by whatever means, you will have to face consequences (loss of privileges and such) and you will get sentenced and fined for any damage you caused while you escaped. (If you even harmed anyone or worse, things will really get bad). But basically ... there is no law which forbids you from trying to escape.

Er liest die Kommentare eh nicht oder nur sehr selten. Der lebt in seiner eigenen Welt und geht selten darauf ein. Ich hab schon soviel kommentiert aber jedesmal die gleichen Aussagen oder Meinungen.
