For the “Best Team”: - Donna Attanasio is an Assistant Dean for George Washington University Law School - Fiona J. Bratton has been practicing since 1989. No further info. - Mark W. Baten is a partner for a Labor & Employment law firm in Boston. - Robert S. Gerber unfortunately passed away in 2012. He is survived by his wife and children. Before he passed, he was practicing in San Diego. - Patrick J. McElhinny is a partner for a firm in Pittsburgh that specializes in litigation, commercial disputes, insurance recovery, and post-grant patents. - Lisa Rodensky is an English professor at Wellesley College. She also obtained her PhD.

Scalia's wit is razor sharp, and he manages to be personable and charming at the same time. The audience laughs everytime he examines counsel's oral arguments. Truly one of a kind.

"Jury can't be trusted to do the fact opinion distiction, for both constitional and procedural reasons." Then why in the hell do we have jury trial in the first place? In fact, it isn't for him to determine that either.

This is why most parties work really hard to settle before trial. Most cases do settle before trial-not only is it costly, but it’s binding and it has ramifying effects to future case law. The jury trial, when it works well, represents a pluralistic view-a collection of lay citizens having the ability to decide together is more just. Can we truly say that now? In 2024? Not so much.
