We have rights for a reason, and people talk themselves into jail way too much, just shut up and chances are you won't end up in cuffs, cops are not your friends, their job is literally to put people into jail, their jail salesmen. And in Washington their hands are tied because the people of the state are idiots.

I live in Tacoma and all we have is a bunch of "tuff" cops that will say shit like that but wont do shit, I've gotten pulled over multiple times because of odd reasons "loud muffler, plate cover", most of the times I tell them I have a dashcam recording everything and I have a CPL license, they run my info and always let me go with no tickets, they are some power-tripping individuals that when they cant do shit, they act tuff, that cop 5'6 acting like he standing tall. . .

Literally was calling multiple times once, while trying to de-escalate a drunk dude assaulting random people in Tacoma. Took almost an hour to get a cop there. Multiple assaults, even had it happening in the background while on the phone. They immediately arrested the guy, but then tried to frame it like those of us trying to de-escalate and stop him from assaulting others were trying to provoke him. Also, the guy was let out a few days later and barely had any sentence. We never got a summons to the court case either. The whole freakin system here is broken.

@@zukgod Absolutely. If the cops did decide to continue with their seizure, the seizure of the second phone would have been perfectly legal because he showed them evidence of a crime on video. Then again, showing that video probably aided in them all walking away without arrest and with their devices. It's a fine line.

Washington used to be such an amazing place to live, but it has been absolutely destroyed, and it really sucks. I moved to Idaho to get away from it, but I'd move home tomorrow if the people pulled their heads out of their asses. It's really funny that the cops will drive by people selling drugs or using drugs, but screw with people out having a goodtime. I totally understand them wanting to find the idiot that lit the fire, but there was no reason to act the way they did. Glad you kept your cool, and your camera.

I am so glad this turned out the way it did. I seriously don’t know how to even put in words how this makes me feel. I think cops do this on purpose cause if someone thinks they are gonna loose a multiple thousand dollar camera or phone they are real quick to show them what’s on it or give them what they want. Cause to me there is no reason for cops to immediately take a phone and say it’s going to evidence or there is “probably” something on it that they want. It’s a freaking game they play to get what they want and it’s a BS power struggle because citizens have no power. Like in this situation they would have had to deal with being arrested and loosing their stuff for who knows how long, and then deal with any lies the Police said against them and hope they can get out of it and win. Like it’s such BS what they put on people that the whole policing system is a joke. But it won’t change untill cops like this are held responsible. It just isn’t gonna change ever:

Just an FYI - WA state constitution has much more stringent protections against searches and seizures. It extends well past the 4A protections. Article 1 Section 7 of the State Constitution.

I had a cop take my phone once and he deleted videos, but he was stupid. Enough to not know that you gotta Go in to trash to delete the actual videos 😂😂😂 I got home that day. Download The video. And it wasn't even an hour later, I got a call from his captain saying what he did was wrong and he got promoted to desk duty.

supreme court says seizing devices to search through for evidence is illegal without a warrant, but in Washington police can temporarily seize a device if someone is placed under arrest, just are not allowed to search through said device without a warrant, so when the cops took the phone from Nathan that belonged to matt they were "technically" within their right to do that as they had no guarantee that the phone wasn't Nathans. taking the phone matt held however, was not within their rights, as matt was not under arrest, and neither was the person the phone belonged to (if it wasn't matts phone). same with jimbos camera, they cant take the camera or the sd card without jimbos consent or without arresting him, and threatening to arrest him if he does not comply with there request is obviously against jimbo's rights.

If you do not take the arrest in this situation, then that makes one weak. Stand on your rights, as you are media, press, a cameraman, and this is settled case law based on the Constitution.

There are a lot of stories with Pierce County Sherriffs if you want them. There is the the old Janavich case. He was the Sherriff who worked with gangsters in the 70s. He ended up in federal prison and was relesed after decades. There is the case where officer Bananbola was shot and killed by his own officers after he knew too much. Brian Eggleston was shot multiple times as they tried to pin the shooting on him, but he lived. Ed Troyer was the main PC Sherriff who falsely tried to say a Black man threatened to kill him after Troyer harassede the Black man who was simply delivering papers. So much tradition with Pierce county Sherriffs and corruption and crime. This is yet another incident where cops are doing what they do.

The issue is they wernt even going after the people that actually did this, and they started doing things against these people’s rights and that’s when people stop cooperating. Like when will cops learn this is the last thing you do if you want people to work with you? And I’m glad Jimbo made you guys look like a fool because you are fools. And I want to say this for the people that did nothing wrong but get treated like this, this is exactly why people hate cops, treat people with respect instead of treating everyone like a criminal. We get there are people out there that want to get you but most people just want to go home and if your respectful to them and respect their rights people are likely to help. I’d bet if these cops handled this situation better instead of trying to just take stuff they prolly would have gotten the info they needed. And I think what’s worse is they knew this was just a bunch of kids doing stuff they shouldn’t, but when it comes to actual crime they don’t even do half this much work. It’s really sad

Never consent to a seizure. That's why he was holding his hand out, for you to put it in his hand so he could argue, he didn't take it from you, you put it in his hand, you consented. Never consent. Seizures like that are technically lawful - when the police believe you have evidence of a crime AND you are going to delete it. An argument could be made (in court) that you are youtubers and you intend on publishing it, not deleting it. Either way, invoke your fourth and fifth amendment rights, don't talk to cops, get your lawyer there - especially when he read you your Miranda warning.

Why are PNW police so soft? They wouldn’t be able to pull a single shift on the East Coast. Don’t let them get away with this…the more people let their rights get trampled, the more they do this stuff.
