Four other prosecutors resigned or were forced off this case, including one this morning. This case should never have been brought, total ineptitude.

There is literally an email trail from Andrea Rabb a Republican law maker that she wanted to prosecute Baldwin to help her career. She was a prosecutor in this case but had to withdraw in disgrace.

This happens all the time. I had it happen in my trial. Under disclosure law, prosecution can determine what's relevant evidence. If they don't disclose, they can't bring it up at trial. In my case, they hid evidence that vindicated me outright! I had a great lawyer.

The state of New Mexico will never recover from the mess they made of this whole case against Baldwin. The incompetence of the DA and their legal team will be the subject of many books and classroom lectures for years to come. BUT -- will they have learned anything from it? Probably not. And that's the real tragedy.

This was always a misguided and ill conceived case done purely to raise the prosecutors profiles. The armorer was found guilty of negligence. End of story

But he was the producer though. Top dog of the production as well as the an actor running around set. Those two position made him think he can do whatever he wants and cut corners. The prosecutors corruption doesnt equal innocence of the alleged. 😂

Ultimately, she made the decision to withhold evidence. That decision was illegal and shows she fundamentally doesn't understand the job of a prosecutor.

@@Gennettor-nc8kx the box contained a mix of both live and d'my rounds from the armory used on set so yes it is relevant because the defense needed to make a case to determine how a live round got there in the first place but she withheld it deliberately and the defense only found out once the trial was underway undermining their ability to prepare their defense. YOU get it right.

As a Forensic Psychologist I cannot weigh in on a case I am not professionally a part of. That said the prosecutor should not be voicing such an unprofessional set of remarks. It is one thing to hold people accountable in the death of a human being if they actually were aware of any responsibility they had and failed to be responsible ie legal negligence. But it is irresponsible for a prosecutor to try to hold people accountable who had no legal knowledge nor authority nor responsibility for the inadvertent harm of another.

"The importance of the evidence was misconstrued" - the evidence she hid under a different file number. The key word being "evidence", so she knew it was evidentiary.

@@OscarDad That doesn’t constitute a dismissal. The evidence would have to be so convincing that it could cause the defendant to be found innocent. Not just a handful of rounds that had nothing to do with this case, and didn’t match any ammo in the case.

​@@dannyhvac37that wasn't her call to make though. The defense had the right to pursue that evidence. It's a violation of alec's 6th amendment right to a fair trial. She admitted to a Brady violation under oath on the stand. The judge had no choice but to throw it out at that point.

The detective parked it, then failed to put enough effort to tie up the loose end.. either on purpose (?) , with instruction to hide it (?), or incompetence.. Either way a catastrophic f up

The DA office in New Mexico had a lot of Republicans that had it in for Baldwin. One of the earlier prosecutors was Andrea Rabb who was a Republican law maker whose emails revealed that she thought a conviction would help her political career. Kari Morrissey admitted to witnesses that she wanted to humble Baldwin and teach him a lesson. The DA office has a lot to answer for.

He was partially at fault. Didnt follow movie set firearm protocol. Then he lied and said he didn't pull the trigger. Colt style revolvers CANNOT fire unless 1. Hammer cocked. 2. Trigger pulled. Two separate steps.

I would never want to work with him if he is producing a film. There were multiple misfires on set. Some even captured on video, and yet he was still pointing guns at people. I agree this should have been thrown out, but I will never work on that guys production. Get ready for him to make a whole doc about how he "didn't pull the trigger".

@@ShelliG as to the indictment, if the prosecution cannot prove beyond all reasonable when the live ammunition was introduced and who introduced it then they cannot prove the offence against Baldwin and perhaps the Armourer. For all we know someone knocked over the ammunition box after it had been sorted for use and put it back incorrectly, missing ammunition found on the floor by the Sherriff. That would do it I think. There may have been slack practice on set but that degree of third party intervention would likely have led to the death. Someone on set is keeping their mouth shut out of self-interest, or perhaps the police simply didn’t ask questions about it, a major flaw in the investigation if they didn’t but found ammo.

Lawsuits Against States Despite the apparent limitations of the Eleventh Amendment, individuals may, under certain circumstances, bring constitutional and statutory cases against states. In some of these cases, the state's sovereign immunity has either been waived by the state or abrogated by Congress.

If it was so critical to verify the link between rounds dropped off and the rust evidentiary material and she could not get hold of the person by phone, being so critical to the case, and peoples futures, you would think that the investigator would drive out to the person’s physical address to ensure a discussion took place. To say that I never spoke to the person is a failure in duty.

That case should never have been brought to court. It was a tragic accident and the handling of the ammunition was so shoddy that it would have been impossible to tell who was at fault

The question of the validity of the ammunition is not her choice to make. Any evidence presented must be made available to the court and the defense attorneys. It's not the prosecution's call to say it's not relevant and then withhold evidence. Kari Morrissey learned this the hard way today.

The ammunition was to be examined by both sides to see if it related to the incident. You dont need a law degree to know that. She knew exactly what she was doing.

It's a joke that the judge did that another wealthy guy free. This evidence was constructed. Hope he gets a big civil suit. He, as producer, was responsible for the crew and the circumstances.

Kari and that detective jacked this case up. They were going to hold this sociopathic narcissist accountable for his killing of Halyna Hutchins (he was going to be found guilty, of at least the lesser offense). Now what Justice will there be for her and her family? My heart feels sick at this.

Fortunately the body camera of the sheriff dept officer caught the interview of the guy turning in the ammunition & stating it was evidence in the “Rust” trial. The officer testified he was told by the prosecutors/investigating detectives to file the evidence under a different case no.

This prosecutors office MUST be investigated for all past cases that may have similar misconduct. That baldwin's expensive attorney's were able to have this dismissed does not clear his soul of wrongdoing but perhaps will help poor people that have been weongly accused n the past.
