Sure Hamdi v Rumsfeld was only limited to “citizen-detainees”, but Rasul v Bush held that foreign nationals held in Guantanamo Bay could petition federal courts for writs of habeas corpus. Boumediene v Bush ruled that prisoners had a right to a writ of habeas corpus under the Suspension Clause. The petitioner in question was Lakhdar Boumediene an Algerian-born naturalized citizen of Bosnia (not a US citizen). The court used the insular cases such as DeLima v Bidwell and Downes v Bidwell to point out that Guantanamo was under de facto control of the USA. Before you cite Department of Homeland Security v Thursissigiam, the court ruled that Illegal Immigration Reform and Responsibility Act of 1996 was not unconstitutional. This case, I should note has nothing to do with Guantanamo. However the only reason it wasn’t unconstitutional according to Alito was that Thuraissigam’s asylum claim was beyond the scope of habeas corpus in the Constitution, which does allow appeal for unlawful detention. So the claim that you are not given due process if you are illegal is simply voided by the Supreme Court of the United States.
