Shouldn't disgorgement take all profits from the deal, not just the extra costs? Like... Assume that he didn't get those terms, someone else's offer on the property would have won so all profits from renting/selling/etc the property should be clawed back. Just focusing on how much more he would have paid for loans seems like a major undershot on the value.
