Why didn’t she go to court about the child support? The court already took the divorce settlement out of his paycheck. The same could have been done with the child support Edit: so she says going to court about this would have been too stressful. While I do understand this, it’s not her money she had to decide about, it’s her child‘s money. Where I live parents are not allowed to give up on child support.

It depends on where they live, but in the story the woman said they were in a 50/50 state over marital assets. In every state in the US, it doesn't matter that she hadn't done it before the story. She can do it any time up to the son's 18th birthday. Then the son has has until he turns 20 or 21 (forget which) to file a claim against his father. He should do it anyway, even though his father is in debt. That way it's on court records & any time for the rest of the father's life if he comes into money the court will automatically take the unpaid child support from him 1st. For instance if he wins the lottery or some random forgotten relative that doesn't know he's a deadbeat dad leaves him an inheritance of cash or property, then along with that business debt there's the child support debt too. I considered doing this against my dad when I turned 18, but by then frankly he was such an addict I knew he'd never spend a single $ on lottery tickets when it could go towards more pot or alcohol (& sometimes other stuff thrown in if he was hanging out with his brothers or "friends", but mostly he just loved depriving his brain of oxygen slowly with constant pot highs). In the story the father admitted to gambling, which is probably at least part of why his business flopped. Just in case he's ever got a bit of cash to gamble in a casino or buy lotto tickets & gets lucky, then he should be forced to pay his debts. Even if the son is smart & gets some scholarships & the mom does have some savings to help with college too, it doesn't absolve the father from his responsibility. The mom shouldn't have been letting it slide. Any child support gotten in those 10 years could've gone into a college/1st home down-payment savings fund in the son's name.

The father could have tried hiding from the courts. This happens all the time where somebody will constantly move to prevent the courts from finding them. It works. My bio dad did this all the time before he finally hid away on an Indigenous reservation making it impossible for the courts to do anything then.

It makes me wonder if there was a child support plan in place but the father shirked on his duties by claiming that he wasn't working or by working under the table. It sounds like there was some kind of plan put in place from listening between the lines, but maybe I am wrong? Of course, he could have moved around a lot to ensure that he couldn't be found by the courts? The latter is what my bio dad did. He moved around so much that the courts couldn't find him and then he couldn't be touched at all after a certain point since he moved to an indigenous reservation where the courts couldn't reach him at all. My mother gave up when she learned from the lawyer that it would be more trouble than it was worth, especially since me and my sister could have been taken away by Indigenous family services and either placed with an abuser or put into foster care until we turned 18.

If Tyler doesn't have custody of Jesse in any capacity it isn't basically kidnapping it IS kidnapping and he would be arrested. If Tyler had joint custody then it would be considered custodial interference and as such Tyler wouldn't be arrested for it, but the courts would have to settle any custodial disputes. In the state of Kansas there is no specific age for a child to be able to choose which parent to live with in a custody battle, but as a teenager the judge could choose to consider the child's wishes about their residence and reasons for their decision. The older the child the more weight their wishes are typically given in custodial agreements. Kicking off a new custody battle after not paying legally mandated child support for ten years is a sure fire way to lose the battle before it even begins, and you would be hard pressed to find an attorney willing to take on such a doomed case.

First of all you need to show you are financially stable to gain full custody of child he is not. His business has gone bankrupt and he is basically unemployed. The fact that he's never paid child support also would ANY court to grant him custody. Is she a nurse or a doctor? It says both. Most nurses do not make 200k a year. Nurses don't go to medical school that's for doctors. They go to nursing school. My mom was a nurse. Another family member is a medical doctor. Too many holes in this story again.
