First, as long as the subsisting court order has not been vacated by the same court or set aside on appeal, Shuaibu remains the Deputy Governor of Edo State. His position was never vacant. In the eyes of the law, he was never impeached in the first place for the following reason: whatever is done in law and is not properly done is deemed not to have been done at all. You can't put something on nothing and expect it to stay. Second, it is elementary law that the filing of an appeal does not operate as a Stay of Execution. Until the Court of Appeal grants a stay before or at the next adjourned date-September 24 ( ?), 2024-,there is no other Deputy Governor in Edo State except Shuaibu. Period.
