Never have I ever: bought stationary because everyone has it, bought duplicate stationery because I forgot I already had it, created a bullet journal😲, bought every type of planner trying to find peace, hoarded supplies because they are "soo pretty", have a stash of "ugly" pens for people to borrow instead of my "pretty pens", regretted purchases. I could go on, but I will get back to work. Thanks for a great episode.

Fun fact: (in the United States and many places in the world) common law copyright attaches when the work is in fixed form, no government paperwork required. If someone has filed the government paperwork to register the copyright and you get sued, you're in a massive world of hurt if you've made any money (as a registered copyright can get triple damages).

I found this episode really informative. I love Pinterest for inspiration, but I hate when I see designs or patterns (e.g. cross stitch, crochet etc) reproduced page by page to get around copyright, and this is no different. Someone has put their time, effort, creativity and sometimes blood, sweat and tears into something, and they should get the credit for that. I also know exactly what journaling company you were referring to, and I won't buy from them now. On a happier note, I often find myself laughing out loud with your friendly banter (the shower stories in the previous episode had me doubled up) so I can't wait for the never have I ever episode! My drink will also be non-alcoholic, and I suspect I will be VERY well hydrated if I join in! Never have I ever spent HOURS organising my craft "stash"! (This can apply to all sorts - pens, inks, washi, paper, stamps, wool, fabric etc.)

I hate copycat accounts on social media, and clones of bigger accounts are AWFUL, but you can't escape them. The number of follow requests I get on TikTok from copycat accounts of the bigger creators I follow are ridiculous. That being said, I'm guilty of using Pinterest inspiration. I recently made a collage of cover pages I recreated with their inspiration pictures and posted that to my Instagram. I don't have the original creators' names, but I tried to make it clear they were not my idea! 😅 Never Have I Ever would be so fun! I'll have to think on that...

Thanks guys - great podcast! I’m listening to a few while I’m cleaning my house after moving out 😅 The affiliate thing is an interesting subject. I intentionally buy the journals I review so I don’t feel any responsibility to the company and can be comfortable giving my honest opinion, but this of course means I am unlikely to make any money! Affiliate arrangements really don’t seem to have much payoff but maybe I’m doing it wrong 😂 I’d love to hear a discussion about whether ‘lives’ are worth doing, and the whole thing of showing vs not showing your face. I’m older, so I sometimes wonder if people flick on through because I’m not in their age bracket or don’t have the right ‘look’. I suppose the question would be, how important is your personal identity to the planner community when you’re a content creator?

People definitely like to have a face to go with the account - but you don’t need to have a face to it if it’s not the type of account you want to have. I think you can follow a creator and get to know then without having to see them. But also, if you are just here for the notebooks - then you might not be worried about the person behind the account. -Mark

I had a brief moment where I was paranoid about the fact that I've used ideas from other people in my journals and not credited them, but then I realised that 1 it's not the sort of theft you were talking about and 2 I'm the only one using my journal and I do tell my family where I got my ideas from if they notice a pretty page I'm working on Mark, you should use your fabulous crab pen holder as an identity mark!

Re affiliate stuff OMG yes this so much. It did the whole round in the Mum blogging sphere a few years back where so many of us were approached and it was like, we won't pay you but we'll give you heaps of exposure in return for us giving you x and you doing y. Um no, exposure doesn't pay the bills. And then there was the whole legal disclosing if posts were sponsored and how you had to word it to cover your bum and certain companies not wanting sponsorship disclosure. It was messy. I always try and credit sticker and planner stores, never thought about crediting layout inspiration. Will make sure I do it from now :)

I think it’s a mix of taking advantage of those who dont know and also some of the brands being held to such a high standard they need to cover all the bases. Any time I share art, journal page etc. anywhere on social media I go the extra mile to find the original artist. When others don't, I comment with the name and/or a link to the original artist ("I love that too! It's made by XYZ Art - this is their website." or something like that). People have occasionally complimented me about it. That's nice, but it shouldn't be that special!

WRT watermarks, they will only deter the 'honest thieves'. You can have a car with an alarm and steering lock to deter theft but the determined thief will always find a way. All you can really do is take precautions and be prepared. It's a sad fact of online life.

I feel like creators do a lot of work to get their videos out. If any part of it is reused by another creator or company, the bare minimum permission should be requested. I literally saw a creator of home organizing copy almost word for word another creators video. I told that creator right away. I am not a creator but I definitely try to watch out for the creators I follow. This is your business and how you support your households. Brands can be greedy (so to speak), but, if you guys put the work in (which is excellent work, i might add), you have every right to be properly compensated.

I took an elective course in uni about copyright, so this was very interesting :) My main takeaways from that were - if you created something, you have the right to decide what happens to it/who uses it - lf someone is making money off of your work - you have to get some of that money (of course it's a more complex issue depending on the circumstances) (All of that applies to German law, so I am curious if things are different in other countries) I think the biggest problem with the internet is that it is such a big space that is really hard to control.

Yes. Different copyright laws in Australia. In Australia copyright is automatic and free. If you create it, it’s yours. You cannot copyright ideas. But you can register trademark which is then protected. A creator has the right to attribution. You must seek permission and acknowledge.

Everytime my immediate family tries to do something/get ahead in life/celebrate a success, this whole can of worms opens. So much so that we've become a lot more secretive, keeping plans to ourselves, not seeking support, etc. from anyone. So would love to know more about how you have dealt with it. Maybe a video on alternate career choices/difficult career decisions etc?

So, this is a question more in the art space, but where is the line for recreating something in your own style? Where is the line between being inspired by someone else's art and downright theft? For instance, recreating the American gothic picture punk rockers? The picture is a direct "copy" but a completely different.

If set-up video is being stolen people should look to the "Acne removal" community, where the big Asian channels have switched to logo stickers (usually small rounds) that fit over the thumb nail of the person whose hands are in the shot. Or it helps if you have scars that can be seen and proven as your own.... * looks at the burn scar between her index and thumb, where she accidentally touched a broiler coil, and the freckle on her index finger knuckle on the opposite hand * 😶🌫

Shein and Temu are full of stolen designs. Sadly, so is etsy--and that's before you start looking at smaller creators because there is so much unauthorized use of characters and designs that are protected by copyright and trademark. Lawyers for the Mouse should be having a field day, given the potential penalties (under U.S. law) for knowingly ripping off protected stuff. As for reposting, well, sadly most social media has a built-in incentive to republish and to steal--and changing it just makes it a "derivative work" which is still theoretically protected by common law copyright--which is definitely infringement...but the whole platform is set up to encourage people to do this and make it easy. I suspect large brands hire young people to manage their social and they (the kids) don't think about the repercussions of just grabbing someone else's work because they don't think about it when they do it for their own accounts all the time. Paying in "exposure" is crap. (And yeah, a creator lawyer wouldn't be a bad idea...did you know that posting on facebook gives them the rights to use your content for free and license it to others without paying you?)

New "business people" applying for a business license should have to pass tests, highlighting reasons for license revoking, regarding violating intellectual property rights. Giving credit to the originator of the artwork, creativity, etc. should be standard. Document these incidences from repeat offenders and submit it to the equivalent of Maryland Department of Labor Licensing Regulations in the state that it occurred. This can't be a new thing given how long social media has existed. A bunch of you should band together to demand fines, license revoking, etc. I hope in the conventions you both attend give some guidance, help, and advice on what to do and how to proceed against violators. If not, put it as a comment on what you would like to see in the future. I really appreciate the comments below as it will help me avoid doing business with companies (thugs) that violate intellectual property laws.

It's the nature of online. Once you put it out thre without copyright protection you are essentially giving your stuff away. Nothing you can do about it. How do you think places like Temu are even in business. You can't trust anyone. Having blind faith in total strangers is naive.

Genuine 'never': Never have I ever accidentally cut the paper too close to the thread (or the thread itself). Never have I ever squealed like a fan girl (since conquering puberty) when meeting someone I admire. Never have I ever signed a brand agreement that I later truly regretted. Never have I ever treated a product like the printer in Office Space.... Okay, that one I need to drink on. I curb stomped the crap out of that fax machine.

I tell people to watermark, but it sucks. You shouldn't have to watermark the shit out of your own piece... but you do.
