Back in 1987 or 1988 I had a Pennsylvania State Trooper tell me that if he followed any car for 5 minutes the driver would commit a traffic violation that he could pull the car over for and legitimately write a traffic citation. He didn’t do that because it was ridiculous, but the traffic laws at the time were strict enough that it was impossible for anyone to follow them perfectly. Reasonable cops do not pull over every single car that they see, even though none of us is a good enough driver to follow every traffic law perfectly. It sounds like the ATF has been a bully cop doing everything in its power to cite everyone they can for the last 4 years instead of a good cop focusing on keeping people safe.

@@isaacikaika It seems taboo in the online firearms community to admit that some people absolutely should be barred from owning firearms. In my opinion, if you have committed violent offenses against innocent people using a weapon of any kind, you should never have any rights of any kind ever again. The problem is that's a slippery slope and would absolutely be abused by the government to go after people who don't deserve it, just like this willful violation nonsense. It's also my opinion that the spirit of "shall not be infringed" has room for interpretation to include "unless you're a proven skid mark on the underpants of civilization". I've heard for most of my adult life that ATF relies upon the "Interstate Commerce Clause" of the Constitution as a basis for its authority, or at least an underpinning of some sort. My question is: how long does the goobermint maintain that authority over an item of lawful merchandise that has traveled from one state to another as part of its route from manufacturer to end user? Is it forever? Because I, as an individual citizen and consumer of manufactured goods, am not a state, not do I buy anything of commercial value from my state. The stores I buy goods and services from are privately-owned or corporately owned, but they are not states. My neighbor is not a state. Some other private individual living in a community 20 miles away is not a state. If I sell my neighbor a wheelbarrow that I've owned for 25 years that was made in Taiwan, does the goobermint have the authority to regulate that sale because the wheelbarrow once moved in interstate commerce?

I think that was the point behind all of this they wanna know who has what and they want to keep all the records for themselves and then make it so that anybody that wants to buy a gun or ammunition has to drive 200 miles to do it. Any reasonable person that thinks the ATF should exist at this point Is perhaps not reasonable. Alcohol is legal tobacco is legal firearms are legal. Why do we need this agency.

Wait, so during discovery, a clarification of an unpublished administrative rule was found, or an internal memo or an unnoticed wording in a judgment from an administrative hearing?

We had one here in Kansas, where they used the 2 letter code for the county instead of the written out name - something the STATE of KANSAS uses for the designator when you do things like turn in sales tax etc - but the AFT didn't like it, so yank they did.

You know, we (I) will stick around to hear about it! Leave me and my 2A alone!

Is there any change regarding the “in business “ that was being interpreted to mean if a person sold one firearm they were in. Business?

Exceptional information with this knowledge, we are armed with information and therefore, please more people encourage friends, neighbors, and yourself to take a gun safety course. I just did short story a lady lost her husband. He didn’t have time to train her, and I said the both of you should get trained by a professional so that you can be a law abiding citizen. Just my thoughts thanks you two for being awesome.

I live in Colorado. They are attacking guns and gun related products several times a year. One gun store in Larimer county has six people working there. Now there are two people and they may be out of business. I tried to contact the state NRA people, but there appears to be little activity there. Now someone has filed a lawsuit in Colorado against All? semiautomatic guns. Like the 1911, in use since WW I. Probably a comfortable majority of people in Colorado have guns and yet they voted last year to put and additional 6.5 % tax on all guns and ammunition. Help!

Between my birthday and the legal spelling of my last name it has been proven those two tasks are a nightmare for governmental documents. I have had only two FFL’s that possessed the knowledge of how to file my information correctly. They’ve both turned in their license because of the forced paperwork that has grown over the years. On top of just the paper work they’re forced to endure the queries they receive are outright legal liabilities for them to respond to. So they ceased doing business with them. You know it’s going wrong when the ones collecting the revenue are opting out. Not in just this scenario many other sources of revenue are being rejected for numerous reasons. The forced labor to take care of tax liabilities has driven business out of our country. Common sense desperately needs to prevail. Liberty works when left alone. Keep necessitating items and it all goes south. We can’t even take care of the infrastructure laid beneath our small towns because of devaluation of the dollar.

ATFE and dribbling noses needs to be abolished, Right. I agree; In the meantime, any willful or just plain sloppy gathering of information should not be tolerated at all. No 'zero tolerance' but any person (dealer) who cannot detect a gross defect on a form should be 'handled'. Not just FFL types but others. I don't want the person handling my house sales (either side) entering or passing on the wrong information.

So much easier to get released at the border than keeping your FFL.

They need to reinstate and reimburse the FFLs that they shut down.

The behavior of government employees is not supposed to change with the change in the president. But since it does, the all the ATF employees should be considered political appointees and subject to replacement with each new administration.

Sad that so many dealers lost their FFLs and there's nothing they can do it about now.

Were the licenses of the 400+ FFL's per year that were driven out of biz, restored upon the "clarification"?
