He literally said " if you don't give me your details, I will detain you ". That is explicitly forbidden in the pace code of practice. There is no ambiguity about this incident, it is clearly a corrupt or otherwise improper exercise of a police power or privilege. Basically, if you insist on exercising your right to privacy, I'm just going to take it from you by force. Then I'm going to assume that my Inspector is as bent as me and has zero moral or ethical standards.

COPS HAVE NO POWER JUST AUTHORITY AND CAN ONLY USE IT WHEN THEY ARE DEALING WITH CRIME/CRIMINAL OR HAVE RAS TO BELIEVE CRIME MAY BE AFOOT. FILMING ALONE DOES NOT COUNT AS RAS AS IT IS A LAWFUL ACTIVITY. WHEN SEARCHING UNDER THE TERRORIST ACT THEY MUST SAY WHAT THEY EXPECT TO FIND IE BOMBS OR BOMB MATERIAL, WEAPONS OF DESTRUCTION ETC., ETC. Blondie was feeding him information. She was talking on the radio to someone (possibly him). Then, she is called over the radio and disappears behind the gate. I believe she conspired with the tyrant which explains why she flipped during the arrest.

That is a hugely important lesson to learn: that a single cop can do what he wishes in front of other cops who, even if they are better aware of the situation, feel powerless to intervene. A chilling lesson indeed, and worth your hanging around for. A few seeds of doubt have surely been planted in minds - not only your viewers, but in the young policemen with whom you were enjoying a civil and cordial conversation.

Where does this terminology ‘detained’ come from? Far too many Police watching ‘American Cop Shows’. AB, was placed in handcuffs. Why? Was he actually arrested? If so, why was AB not given the ‘CAUTION’. Regarding his ‘RIGHTS’. Can a person be handcuffed in this situation? I thought handcuffs could only be used if an offender was violent, threatened violence or suspected of ‘ABSCONDING’. In which case, putting a person in chains is not lawful. AB, you need to seek legal advice. This malpractice by the Police must be stopped. Automatically putting a person in chains is unacceptable. This is not the USA. This is what happens when a politician is imposed on the Police as is with an elected Police Crime commissioner’. Get rid. Frank

I sent a complaint as follows:- "A man was filming outside of Luton Police Station. PC 6474 used the Terrorism Act as a means to handcuff and try to get the details of the man lawfully filming in public. He refused to give a document to say he'd searched the man unless the man identified himself. I would ask why is it that police personnel still do not know the law regarding filming in public despite memos circulating from police chiefs saying it's lawful? Why are police personnel still misusing the Terrorism Act?"

@Replying is futile IOPC would be unlikely to even look at his complaint, let alone find in favour. They only really look at incidents of DSI (Death and Serious Injury) or cases of gross misconduct. This sort of complaint would be dealt with in house by the police themselves.

@Replying is futile He could appeal an investigation that did not find in his favour, but I magine they would not find in his favour for a second time (watch my uploads about the response to my complaint based on virtually the same use of sec 43 powers without reasonable suspicion to get an idea of how they justify it). So the only remedy would be to bring a civil action for false imprisonment (trespass to goods and assualt are usually thrown in too, if property is searched, and cuffs are used, or you are grabbed). In this civil case, based on case law, all one has to do is prove he was detained, and that the detainment was unlawful. Proving he was detained is easy. Was he free to leave? Once he proves he was detained the burden of proof pases to the defendant (the police) to prove that the actions were justified and lawful. Unfortunately, I think it would be difficult (although not impossible) to get a court to agree that the detainment was 'unreasonable'. You and I may realise that it was, but it is another matter to convince a court that it was. Especially since it surrounds terrorism powers. The courts would, IMO, be unlikely to wamt to be seen to bring a judgememt which might be seen to hinder the police's powers to combat those dreaded bogeymen called terrorists. Once the head of claim of false imprisonment fails, so the others fail on the back of it. Would make for an interesting case mind, and expensive. You'd be unlikely to get any legal help for free. You could try and do it yourself, but be prepared to have to sit down and learn the way to procede through the civil courts.

One policeman killed him but there were many more who stood around watching and doing nothing. If we're not careful the UK could end up the same way if behaviour like this isn't challenged. It's all very well saying it's just a few bad apples but if the good apples don't do anything then they're just as guilty.

Copy of letter sent below. Dear Mr Forsyth, WITHOUT PREJUDICE DICTATED A KZbin video was brought to my attention today, entitled stand-off outside Luton police station, part 2. Let me begin by asking if police stations and other publicly funded buildings in England, are exempt from photography. Or, are there any laws on the statute books which specifically denies a citizen the right to point a camera in the direction of such a buildings? I am deeply disturbed by the behaviour of the police officers who interacted with the videographer in this video. Especially officer 6474. It is clear that the videographer had broken no laws ( the officers agreed to that point) and that none of the officers had “reasonable grounds” under the prevention of terrorism act, to genuinely suspect him of being involved in terrorist activities. The act of photography, alone, no matter which direction you point your camera in, cannot be sufficient grounds for a serious charge such as terrorism. If that were so, then every tourist who stands outside the MI5 building in London taking pictures of that building, simply because they’ve seen it in a James Bond film, would be behind bars. It seems likely that the treatment this citizen received, was as a result of behaviour that is often referred to in America as, contempt of cop. Not answering questions of a police officer, is not a crime. Provided that you are behaving completely lawfully. Your officers reacted to a citizen that declined to give up his personal details for no reason, as if that automatically made him guilty of a crime for which they had the powers of arrest and search. It was as if the very foundation of our legal system had been reversed. Namely that the citizen is guilty until they prove their innocence.. THE USE OF CAMERAS IN PUBLIC. There are 627,000 CCTV cameras in London alone and between 14 to16 million of them in the country as a hole, According to government statistics, by 2022 there will be 54 million smart phones in circulation all of which have video cameras and the police and TFL use ANPR cameras recording cars and people by the millions every day. And last year the police announced that they are rolling out facial recognition camera vans into our streets to video random passing faces of the public. It seems to me that the government regards photography as a perfectly legal activity. As legal as walking a dog or going shopping. The law makes no distinction between any of these activities. There is an estimated 10 million dash cameras fitted to trucks and cars ( including police cars ) constantly recording all over the country. And finally, citizen journalism is a firmly established fact of present day life (as mentioned in a letter from Andrew Potter, Chair of the ACPO, now named, NPCC, in 2010) and footage from citizens smart phones, of crimes is often sought by the police as evidence. The police often appeal for citizens footage to help solve crimes. You can’t have it both ways. It seems to me that the government regards photography as a perfectly legal activity. As legal as walking a dog or going shopping. That being the case, what is it about this ONE camera in the hand of this citizen outside a police station (that we pay for) that entitled these offers to interrupt his peace and freedom to conduct what amounts to a police interview on the roadside with no opportunity for him to seek advice or council. Then they accuse him of being a terrorist, and put him through the indignity of a body search on the pavement. And if it’s because he pointed his camera briefly at a police station, can you tell me if police stations are exempt from photography and what other buildings in the country have special no photography status. Better still, may I have a list please? Further, may I also have a list, detailing any other rights that I have as a citizen, which police officers are entitled to trample on based on their emotions and feelings rather than law. FULL DISCLOSURE. I have spent 30 years working in the media and will not be fobbed off with an email that does not seriously address the points that I have raised and either defends the officers actions with legal reasoning and justification or accepts that errors were made. And please address the inactions of his colleagues who did nothing to prevent this clear breach of civil rights taking place. There was no crime afoot here and the officers involved clearly stated that this citizen had not broken any laws on several occasions. Lastly, I think it is clear to all who view this video that there is a serious lack of training, ability and knowledge in all the police officers connected to this event. Especially officer, shoulder number 6474. This reflects on poor leadership. To put it bluntly and to use an old phrase, the fish stinks from the head. So please explain to me what you will be doing in the future to ensure that police officers are better trained on the rights of citizens, particularly in the area of photography from a public place. Regardless of their personal opinions as to this lawful activity. Many millions of men and women gave up their lives in two world wars so that we could live in a society where jackbooted police officers don’t walk up to citizens and demand “Papers please”. The behaviour of this officer and his colleagues denigrates all of those people who sacrificed so much for our freedom and is reminiscent of the behaviour found by the bully boy thugs who worked the streets of Berlin in the 1930s. Hi, thanks for your comment, and yes, you’re right in that anyone who thinks the police will investigate themselves on any matter without a predisposed policy of doing everything possible to support the officer/s and reject any complaints, is a fool. But then I ask myself, what I should do? Nothing? Perhaps, but if I were a chief constable and every day, I received more and more complaints from citizens about the behaviour of my officers, it would start to grate on my nerves. And in an age where social media seems to carry so much weight, perhaps pressure there, can have an effect. I certainly don’t pretend to have all the answers. But,many of the historical problems in our society took root and grew in size, because people did nothing. If enough British citizens complain about the poor behaviour of police officers then over time, and in the far distant future we may bring about reform and change. These things can take a generation to turn around. But as a great Greek philosopher once said. “A society grows great when old men plant trees, the shade of which they know they will never sit in”

The cops weren’t really making casual conversation, a lot of what they were saying was probing questions about AB’s background. The male cop was acting the nice guy to get AB to open up. Basically cops are never your friend when they stop you.

Whenever I see cops standing back and allowing a tyrant to abuse a citizen these words by Martin Niemöller always spring to mind. First they came for the socialists, and I did not speak out-because I was not a socialist. Then they came for the trade unionists, and I did not speak out- because I was not a trade unionist. Then they came for the Jews, and I did not speak out-because I was not a Jew. Then they came for me-and there was no one left to speak for me. “I will detain you if you refuse to give me your details” - well right there, that’s where it went from 0-100. This is perhaps one of the worst abuse of powers as part of a photography audit I’ve seen in the UK. So many laws broken by the police and complete lack of proportionality in every sense. I really am sorry this has happened, but equally now that it has PLEASE keep us constantly updated on your complaint and follow this up in the courts with a civil suit at the minimum - unless tyrants like that police officer get a summons in the post, and realise saying “see you in court” wasn’t an empty threat, they will simply do this again to someone else.

Sorry to disillusion you, but I strongly suspect “James” was in on it. I’m not absolutely positive about it, but he was receiving communications all the time it was going on, it is difficult to believe they would not have kept him in the loop as to what was going on. I strongly believe he had been instructed to keep you talking until hitler got back ( he looked like he had a hitler moustache in some of your shots). I think the lady in the hijab was the only one that was not really part of it. The other two repeatedly kept looking over at the gates for that miserable streak of shit to return and grind you under his jackboot. He really had the look of somebody that was bullied relentlessly at school and joined up for his ego and to get his own back on anybody he comes across. That blondie has probably gone through all the males like a dose of salts, shamelessly using her looks to lull people into a sense of false security, pathetic, the way she giggles and smarms “are you filming us”. This really upset me, it bought back all the negative interactions I’ve had with police over the years ( not had that many at all, but more have been negative than positive), it reinforced that feeling of disconnect and mistrust, you should allow people to mirror this video as the perfect example of why you should never take how police act on face value, always suspect an ulterior motive. This is coming from someone that would love to be able to respect the police, after all, they are meant to be there for you in your time of need, unfortunately this gets corrupted into a cancerous malignancy resulting in the scenario we have just seen played out.

Agreed he has a earphone connected which is their way of recieving internal comms without anyone else hearing. The way he's acting it looks like he's being instructed through the ear piece to keep him talking. Disgusting behaviour....he didn’t even have a quiet word with the two officers who had been interacting with you for the last 30 mins. Surely they would have been in the best position to determine if they felt you were a threat in anyway. I am also disgusted that they did nothing at all to de-escalate the situation. They stood by and allowed you to be treated unfairly. Where is their passion for social justice and balancing of power. I will be complaining for you AB. I love how calm you are and so articulate. Their actions go against the policies that the MET have in place about public filming and photography. You CAN film a police station you CAN film in the lobby. just watched both videos and in part 1 you told James about being stopped before under section 43, soon after blondie disappers into the station and suddenly you are detained under section 43, obviously she told grumpy cop this and he thought christmas had come early... this is why people don't trust the police anymore... best advice is say nothing as all they were doing is fishing for a reason to detain you... keep up the great work

Police should learn how to correctly use the legislation before unlawfully implementing it. Filming in public is precluded as a premise to use as grounds for suspicion by the ACPO of England, Wales and Northern Ireland; therefore, the Officer who carried out the search acted outside of legal boundaries; hence, he is guilty of unlawful detainment and assault.

Rob won't handle auditors as he considers that they wind up the police. He only handles cases where the police go from 0 to 100 on people going about their lawful and legal business. Ian Gould is the better bet.

AB you must get an EXTRA CAMERA , like Pen 🖋️ camera on your front pocket or something like that as backup in case this happens again which probably will unfortunately, although it will be less each time as you are setting a great example for new officers or old officers that DONT KNOW THE LAW! Just want to say that this channel is great and i subbed after watching this. I hope you get justice for the way you were treated, I know some can mock auditers and label them as "claim jumpers", this I feel is a gross misrepresentation, likely officers who got caught out who use that statement. The most shocking thing to me was as you stated, the young officers completely changed, they became human, they dropped the guard and listened and understood, even if was from another perspective, just for Sergeant Cunty bollocks to come swooping in with his Sec43 TA. What example does that set to the young officers? The choice is theirs yet i imagine a lot of doubt will creep in about the role they have taken. Fingers crossed the numpty gets the sack and that poison can be removed.

I have watched a lot of these audits from AB and others but I have to say that this one is the most disturbing. The question to be asked is why aren’t the police trained and clearly instructed that photography in a public place is lawful.

Massive love to you from Yorkshire, AB. This vid should be on the training syllabus for all police forces. Just as you said, the new young cops handled it amateurishly (they obviously didn't know the law) but with mostly good humour until big bro arrived and committed wrongful arrest and assault. You should have a big win in civil court AB, but please also send the vid to the Police and Crime Commissioner for Bedfordshire, Kathryn Holloway and ask for her comment and support. If we got one PCC to take this issue on and roll it out in their area, that would be a major victory for the people vs corrupt police.

@@ajm5007 There's a difference between telling somebody about something which you are doing and having a valid reason for doing so. It would be easier, and he knows it, to inform the desk so that none of this would happen, but that obviously wouldn't be as interesting to watch. We, the viewers, are privy to what is going on exactly...we already know what his motives are, you can't expect others to. Nb. That's not to say that I think the outcome of this was good...or correct procedure, quite the opposite in fact.

When law suits come from these sorts of interactions all the officers involved should be held financially accountable. It will make them think twice about doing it and make other cops more likely to step up and stop it. Imagine if everyone in a vehicle had to pay a speeding fine, passengers would start pulling up their mates.

You have absolutely proved your point AB. I was really starting to like James but he’ll take his pay check over his moral and legal obligation every time. The others should and could have stopped the cycle of tyranny in its tracks as they had been given all the relevant information they required. But the didn’t.
