Decades ago, IN TEXAS, officers appeared for calls from neighbors, where my now-ex-wife had been assaulting me, I answered the door where my shirt was drastically torn for the aggression of the woman. Their ONLY concern... was the WOMAN OK??? I had crawled up into a ball while the woman wailed on me, but NO concern of ANY assault from the woman, while she assaulted me insisting that I should fight to show that I am a MAN. The ONLY showed concern whether the WOMAN was OK. Does this make sense to ANYONE????

Exactly... not to mention even if they didn't get violent, they show up and don't accept "no nothing happened, I don't want to talk to you" they keep questioning you trying to get a "yes a crime occurred" which leads to unnecessary and false charges... they don't accept "no" then also asking a girlfriend whether her boyfriend (who she's apparently fighting with about something) everyone's mad at the answer "nothing happened" so I can see why some women eventually lie and say okay "something criminal happened" then afterwards the gal recants her statement and tries to fix it, but the police and courts won't take "nothing criminal happened" as an answer... they will literally go forward with charges without your support and while you're telling them "no crime occurred" all in a bad attempt at "keeping domestic violence victims safe" all while police commit domestic violence themselves at an alarming rate... they also often times end up arresting the boyfriend and start dating the victim.

Only Hernandez should’ve been prosecuted, and that’s exactly what ended up finally happening, thank goodness. What a shame that it took a new sheriff to clean up the department and take that action though. Shame on the sheriff that was serving when this happened and only put Hernandez on one day suspension without pay. The former sheriff should be prosecuted, but not put in prison for what he did. What he did was wrong, but it’s not to the extent that he should be serving prison time for it. I will say though that the former sheriff’s history should be looked over with a fine tooth comb though, and if he did something more severe than this, then perhaps prison time would be in order.

What should have happened? The first responding officer would actively listen, while showing understanding and empathy. Tell her that she is sorry to hear about bad reputation and expresss the willingness to do anything to make her feeling to be overturned. Give her a card with a telephone number to call anytime if she needs help, and finally assure her that the police is on her side. Everything would have been very different.

I’m trying to figure out how any of the exigent circumstances can exist from a phone call made by uninvolved “witnesses” to the occurrence. How can you have suspicion that the abuser is in the home when the “victim” didn’t call for help, the “victim” says she’s safe in the home with the person she called to be there, and the “victim” saying she doesn’t want to press charges or have any medical attention? The responding cop will likely have just been given an address and brief thing like "shots fired" or "Potential domestic". It is the dispatcher who has the more completed information but with all calls, they must be taken seriously or harm could be done and lives lost.

However, the scariest thing about the videos you post is that almost every situation you audit, even YEARS after the fact, are not resolved. Whether it be charges or lawsuits. Charges still pending, lawsuits being put off. There needs to be major reform for our judicial system.

Allegedly attacked by two different men. For all we know she has a skin condition and she is the aggressor. My advice would be to avoid claiming something as "fact" when all you have are allegations. Absolutely hypocritical. I totally agree with your post. Let me also throw this in... if the police side of government doesn't have the duty why does any other part of government? Most laws are so arbitrary and made on a whim. Some law makers motherly instinct kicks in to give us laws on how and where we are allowed to walk. Yet people jumping out of airplanes or climbing the side of a rock face with no safety gear is perfectly OK.

It sounds like a lot of things changed when the new sheriff chief came in. Maybe that put her in a better position to pursue legal action. Could be any number of things. The legal system is complex and bloated and needlessly complicated, with all sorts of seemingly arbitrary rules.

The first officer did a great job. The victim is under no obligation to answer her questions, however, she wouldn't have been doing her job if she didn't ask them. Domestic abuse victims often defend and lie to cover for their abusers. The officer would've been negligent if she didn't investigate the situation.

When it’s not anymore they are done. That’s why he got caught, harboring a non fugitive is not a crime… and no, investigating doesn’t give you the right to break in, torture or intimidate victims and witnesses. She would have been a great cop if she walked back to her car after that chat, bringing a swat team of morons in not so much. She knows exactly that would happen, and said yes, and if she was a great cop she would have arrested her colleague on the spot for assault, or not entering the home. She did neither, bare minimum is being great apparently.

@Aluzky yeah and the victim told them nothing happened, she didnt want to talk to them, and to go away. the lady cop did not comply with the victims wishes, called for more officers, there was like 5 in total inside of her place.... and they forced their way in by throwing her to the ground by the throat. Every single cop there is complicit in violating the victim. period. stop worshipping police officers. if this lady officer had listened to the victim, right down what she said, and then leave to get a warrant if you think she is lying. thats called due process. but she didnt listen to the victim, which tells me they already thought they knew everything and had no intentions on listening to anything she had to say. They had intended this from the very start. Warrantless search by thieves. they probably were hoping there was paraphernalia in view so they could raid the house and take any money or drugs laying around. (they do this regularly) but probably already know that seeing as how you are most definitely a police officer.

So a grand jury no billed the assault charges and he plead guilty to official oppression and got six months of deferred adjudication. A bit of community service and no conviction. Meanwhile she got 200k in taxpayer money after settling with the county. Justice is served!

I was arrested in 2001 for "domestic violence" in florida and was told by the arresting officer that it wasn't up to my girlfriend but mandated by the state that they "had to take someone to jail", is this true? She sure deserves to win the case, but you guys seem to not really know and be able to imagine what an abusive relationship is, especially one where one of them is physically hurting the other. You think it's like a 10-20 minutes encounter with the police or less, but it's much worse. Living in constant fear that the other will hurt you. Not having the guts to tell anyone of it because you fear your partner will hurt you even more. This cops were totally unprofessional, but good cops would still enter that appartement, without slamming her on the floor, while reassuring her that they are not there to harm her.

The language of domestic violence statues have allowed women to weaponized Domestic Violence accusations. I caught my wife lying, voluntarily left my home to avoid a confrontation, spent 2 weeks meeting with my wife at a marriage counseling office. She abruptly ended the session after I discovered 2 massive lies. She went to the authorities and even after 2 weeks of no contact she was still granted a restraining order.

It is reasonable to suspect the cop is a domestic abuser himself. Imagine being the victim of domestic abuse by your cop husband/boyfriend. Add to that the evidently bad state of the local PD. Consider that the cop left when his police chief was replaced by someone else. Quite the clear picture.

As prior LE, there were no exigent circumstances that I see. As far as the cop grabbing her by the neck goes, this is unwarranted use of force! The series Live PD is no longer shown because it was full of rights violations and not constitutional! These two officers need to be fired and sued immediately IMO!
