The mute feature on body cameras needs to be removed. There's absolutely no reason to mute them. If there's something captured by the audio that shouldn't be released to the public then it can be redacted, just like the video. The only reason for muting audio or turning off the camera in the middle of an incident is to prevent the documentation of exculpatory evidence.

If a police officer turns off the camera or mutes the sound while responding to a potential criminal action, then whatever charges were laid should be immediately dropped and the cop should be charged with tampering with evidence. The same should happen if the police officer simply "forgets" to turn it on during an interaction with the public. If a FOI request comes in for the bodycam footage, the police can still edit whatever video they give out, but the original must remain in an unedited state until the charges go before a judge and at least 6 months after that. If someone actually files a case against the cops, then the process should start again with the footage being held until that case is resolved, plus 6 months.

Got him for possession of a suspended license, though he wasn't driving. Said he would have arrested him for "attempting to incite a riot" if nothing else came back when he ran his name. In his report he always referred to my friend as "the A", obviously meaning "a**hole". I was in court when the judge read the report. The judge said nothing about that. I learned long ago about what kind of people we're dealing with.

No, it makes sense, people just misinterpret it. "Fighting words" are things like "I'm gonna kick your ass" or "I'll kill you", things that would cause any ordinary person to be in reasonable fear that a fight was imminent. It's basically the same as "real threats". It's a pretty narrow statute, but much like disorderly conduct, it gets applied and twisted to fit whatever the cops need it to be.

The "fighting words" is clearly meant to allow officers to issue an arrest while the fuse is lit but there's stil an opportunity to stop it before it causes an explosion - However in this case, it wasn't a lit fuse but instead just a burning candle that had no risk of exploding. So the female officer decided that ruining his life was an appropriate response to what she thought she heard, and never entertaining the idea that she might've misheard given he displayed no desire to act.

I don't know how it works in other states, but in mine when they're spoken to you it's essentially a limited check given to you to cash in immediately by means of a few good swings. Subsequently I believe that threats and threatening words need to have a review of real threats vs. conditional threats. There is a difference. But this situation is completely different. A law enforcement body is driven exactly the same as any military corps. They are public, have ranks, and the "manager" is not, is in fact a superior. A superior is allways responsible for the actions of his subordinates to the utmost extent, up to losing his rank or job in case he can't control his subordinates.
