Totally different processes. However, if already arrived on a non-immigrant visa, with originally no intent to remain in USA, then married to a US citizen. The Citizen spouse can petition for you to stay without ever leaving USA, This is called concurrent filing. Details at www.visacoach.com/concurrent-filing-101-video/

Any lie, or misrepresentation submitted to US immigration might hurt you. That is way I council my clients to always be truthful.

Saying "it was someone else's fault". Does not change the fact that you are responsible and committed fraud when you applied and made sworn statements to US immigration. I spoke to your spouse, the combination of you fraudulently stating you were married, when you weren't, had two children with your supposed spouse, when you did not, makes it very unlikely that you will ever be forgiven by US immigration and issued a visa. Of course, a spouse or fiance visa is actually applied for by the American partner so sometimes the officer will grant despite your misdoings as a courtesy to the American. Sorry, but your case ALSO has red flags, such as having a 30 year age difference, she is 68 and you are 38, and you are from Nigeria the home of 419 scammers. While you can apply, and I can certainly help your American spouse put her best foot forward in the application, I am not optimistic. I recommended she move overseas to be with you, as it is unlikely you two will be together in USA. And word of advice to anyone else "NEVER LIE to US IMMIGRATION"

You can apply for tourist visa anytime you like. The question is whether or not you will be granted the visa? Thats for the officer to tell you, one way or the other.

Hi.I did apply for a tourist visa but at the time of the application I did not have a marriage certificate and therefor couldn’t even say I was going to visit my husband.I was denied.But now that we have obtained the marriage certificate and my husband (US citizen) has filed for a the I-130 application is there a possibility for us to be denied?Thank you.

Possibility to be denied if you attempt another visitor visa, sure, and most likely to be denied. Possibility to be denied for spouse visa, well, that is possible too, but depends on the quality of your application and underlying bona fides of your relationship.

Traveling on a visitor visa one can sitesee, shop, get medical treatment and even MARRY. So he comes, marries, returns to home country and waits for the Spouse visa to be approved. Each entry to USA is at the discretion of an inspecting officer. Should he suspect that your spouse might be planning to misuse the visitor visa, might refuse entry.

I wanted to ask because I keep getting the same awnser that it is not against the law to apply for a b2 visa while waiting on a k1. However my lawyers said my fiancee would be under extra scrutiny. She has no plans on staying in the us until the completion of her k1 visa. Would an affidavit of support and guarantee help the approval of the b2 visa I would really like to get it right if I am going to try it at all

@@Visacoach I'm kind of in the same boat. But my spouse is in the US for training and is not a US citizen or a permanent resident (nonimmigrant/FSM citizen). So no petition filed for me. I'd like to try for a tourist visa to visit him this summer but not sure they'd approve since we'll he's my husband and he's already there? Advice? Also I've been to the US before on a J1 visa.

US Congress sets annual quotas for the number of immigrants allowed to immigrate to the USA from each country. Depending on country of original the spouse of a LPR might need 2 to 8 years to arrive to the USA. Any way to make it faster = No. Can anyone you hire make it go faster? = No. I offer to help clients pursue their case by ensuring the quality of the application shines through, this goes for smooth processing and final approval. Marry whereever you like best. However, if you use your visitor visa with the intention to travel to USA, and remain in USA, that is a violation of immigration rules.

I have no preference. And theoretically neither does US immigration, you become eligible to apply for a fiance visa once an in-person meeting occurs. Where you meet, how you and she got there is not really an issue.

I have a question that I thought may be a good topic for a video. With the shut down going on and on, Ive read that more and more Americans who are engaged to filipinas are looking to meet and marry their filipina in other countries instead. I am supposed to come to philippines in March 2022 for the month and marry my fiance but we are both afraid that things will not be open by then so we started talking about a back up plan. I think its legal for us to both fly to Thailand for the month of march and marry there instead but I could be mistaken. Have you heard of anyone else who has tried to do this?
