Sayyidi Younus AlGohar explains once and for all in light of the Koran whether the Caliph of the time was correct in taking the Garden of Fadak from Bibi Fatima and using it to serve Muslims.
Summary:
Moula Ali was present when Prophet Mohammad (PBUH) gifted the Garden of Fadak to Bibi Fatima. He was also there when the Caliph of the time took the Garden of Fadak from Bibi Fatima saying that it was not hers, but rather the property of Muslims. Despite being in the right, Moula Ali did not argue with the Caliph because his esoteric honour did not allow him to do so over the sake of his own property, especially when the Caliph said that he would use the Garden of Fadak for the Muslim community.
The Garden of Fadak was obtained by the Muslims as part of war loot. Many of the soldiers fighting for Islam thought that because they were the ones who fought and defeated the enemy, they were the ones with rights to the war loot. It was with this notion in mind that many Companions took items from the war loot for themselves. Those who did so were declared to be hypocrites by Prophet Mohammad (PBUH). People asked the Prophet who had rights to the war loot; Prophet Mohammad (PBUH) waited for God to reveal an answer in the Koran.
O' Prophet Mohammad (PBUH), people ask you questions about the war loot.' Tell them that God and his Messenger have the rights to the war loot.' - Koran 8:1
This means that Prophet Mohammad (PBUH) has exclusive rights because God is not on Earth. Prophet Mohammad (PBUH) gifted the Garden of Fadak, which was war loot, to his daughter. In that era, there was no paperwork so there was no documentary evidence of Bibi Fatima owning the Garden of Fadak; Prophet Mohammad (PBUH) verbally declared that it belonged to her.
Perhaps it wasn't in the knowledge of the Caliph at the time that Prophet Mohammad (PBUH) had complete rights to all war loot. He must have also not known that if Prophet Mohammad (PBUH) gave something to his daughter, he as the Caliph had no authority to take it from her. When he took the Garden of Fadak from Bibi Fatima, he blasphemed the Koran and the Prophet. He committed injustice and went against the Koran.

Jazakum Allahu Khairan. Allahumma Salli Ala Muhammad Wa Ale Muhammad. Those who harm Fatima Zahara AS, the Messenger of Allah SAS and Ahlul Bait will pay the full price. The Prophet Muhammad (SAW) said, "My sahabas (Companions) will be taken to the fire [of hell], whereupon I shall plead: "O Lord! But these are my sahabas!" It will be said to me, "You do not know what they did after you." I will say, "Then perdition should be the lot of all those who altered after me." (Sahih Bukhari, Vol. 7, p. 209). Also narrated by: Annas in Bukhari; Abu Sa'ed Al Khudri in Muslim, Ahmad, Abu Dawud, At Tirmidhi, Ibn Majah and An Nasai'; Sahl bin Sa'ad in Bukhari and Muslim; Abu Hurairah in Muslim; Aisha in Ahmad; Abdullah ibn Mas'ud in Bukhari and Muslim. Indeed, if the Successor is not Divinely appointed, who will undertake the legitimate leadership of the Deen and the Ummah? How strange that they denied the Messenger of Allah SAS the right to appoint his SAS's Successor, but they appointed theirs? Saqifah bani Saidah, a really dark day in early Islam: conspiracy against Ahlul Bait: Ali, Fatima and their children, Hasan and Husain AS. It was clear by several undisputed evidence and based on outstanding merits, Ali Ibn Abu Talib AS was the only intended and desired Successor - Khalifa after his SAS's death - as determined by the Messenger of Allah SAS himself on numerous occasions. Mainstream Islamic Scholars purposely try hide the truth from the general Ummah in order to deny 'Ali bin Talib AS the Most Qualified, Competent and Natural Rightful Successor after the death of the Messenger of Allah SAS. They strenuously try to defend, promote and propagate the status quo. Yet, some of the most meritorious, indisputably prominent and distinguished characteristics and status of Ali AS over and above ALL the other Sahabas can be prominently highlighted as follows: 1. Ali AS was brought up in the household of the Prophet SAS from the tender age of 10 when the Prophet SAS was then 30 years old, 10 years before Revelation and never worshipped idols, unlike the rest of the Sahabas. 2. Dawatul Ashira - 609 when Ali AS was the first male at 23 years old who openly declared acceptance of Islam directly to Prophet SAS, while the other paternal blood relatives declined. Refer to 26:214. The Prophet SAS then referred to him as "Akhi", "Wasi" and "Khalifa". 3. Lailat Mabit - 622 when Ali AS readily and happily risked his life for the Prophet SAS by agreeing to sleep in his SAS's bed for the Hijrah, at the assasination plot to kill the Prophet SAS by the tribesmen. Refer to 2:207. 4. On the Hijrah from Makkah to Madinah, the Prophet SAS left Ali AS in charge of executing the Amana by returning the valuable possessions of some Makkans kept with the Prophet SAS back to the people as a Sacred Trust. 5. The Prophet SAS then gave Ali AS another Sacred Trust to take the three Fatimas - Fatima Zahara AS, his own mother Fatima and Fatima, daughter of Hamza safely to join the Prophet SAS in Madinah and single-handedly valiantly fought off attackers on the journey. 6. A few months upon arrival in Madinah, the Prophet SAS ordered the Muhajireen to each choose an Ansar as his brother to cement brotherhood, but he did not request Ali AS to do so. Neither did the Prophet SAS himself do likewise. Instead, he SAS held Ali AS's hand and declared him as his SAS brother to affirm their special and unique relationship in this world and the Hereafter. Refer to 59:9. 7. Marriage to Fatima AS - 624 when Ali AS was choosen to marry the daughter of the Prophet SAS, while Abu Bakr and Umar RA were refused. Ali AS was the paternal cousin of the Prophet SAS, son-in-law and closest confidante and their house was the only door left open to Masjid Nabawi when all others were ordered closed. 8. Battle of Badr - 624 when Ali AS put down more of the enemies than any other from among the 313 ill equipped Muslims against some 1,000 strong and better equipped enemies of Makkah. 9. Battle of Khaibar - 629 when Ali AS brought an astounding victory to the Prophet SAS. After Abu Bakr and Umar RA failed to do so before him on two separate attempts, the Prophet SAS made an amazing statement: "Tomorrow Allah will send a man who loves Allah and His Prophet and Allah and His Prophet love him too. He will deliver Khaibar to me." 10. Battle of Hunain - 630 when the army of 12,000 fled the arrows in the valley by the Hawazin and Thaqif of 24,000 strong against the Prophet SAS, while only 8 distinguished Companions remained with the Prophet SAS, not including neither Abu Bakr, Umar nor Uthman RA. Ali AS brought final victory to him SAS at Hunain. 11. Ghazwat Tabuk - 630 when the Prophet SAS left Ali AS in charge of Madinah and likened him to himself SAS as Aron was to Moses AS as Nabi and Successor. Refer to 13:7. 12. Ghadeer Khumm - 632 on the 18th of Zul Hijjah after the Farewell Hajj, when the Prophet SAS explicitly and publicly declared Ali AS his SAS's Successor and those present openly congratulated him, including Abu Bakr and Umar RA. 13. Mubahala - 632 when the Prophet SAS entered into Divine Curse with the Christians of Najran to prove the Truth. The Prophet SAS took along with himself only Ali, Fatima, Hasan and Husain AS as his family to confront the Christians. Refer 3:61. 14. Kisa - 632 when the Prophet SAS took only Ali, Fatima, Hasan and Husain AS under his cloak at the Revelation of Ayat Tathir, 33:33, as the only members of Ahlul Bait. He excluded others even though it happened in the house of Umm Salama RA who expressly requested to be included. 15. This highlights the superiority of Ali AS over all the other Sahabas, when the Prophet SAS declared: "I am the City of Knowledge and Ali is the Gate." 16. Consider why the Prophet SAS, at his death bed, when he SAS ordered everyone, including Abu Bakr and Umar RA who refused to join Usama bin Zaid's Army against the Romans but particularly insisted that only Ali Ibn Abu Talib AS alone should remain with him SAS in Madinah.

As Salam o aly kum. Allah knows best and You are a scholar I can't argue with you. However my point of view is that when hazrat ali didn't say any thing on his verdict and surrenderd the garden .and later on when hazrat ali became Khalifa he could have undo the verdict but he didn't do . So when hazrat ali and bibi fatima didn't argue for this garden why should we speak about it . May Allah give us wisdom to understand and practice true Islam, and reunite all Muslim's to fight the enemies of Islam, May Allah give Islam the glory as we had till the end of sultanate usmania .amin sum amin ya rabbul alamin.

The claim of Sayyida Fatima (as) was supported by the Qur'an.Abu Bakr rejected her claim by advancing an alleged Hadeeth that contradicted10 Qur'anic verses. Surah Nisa 004.011: Allah (thus) directs you as regards your Children's (Inheritance): to the male, a portion equal to that of two females: if only daughters, two or more, their share is two-thirds of the inheritance; if only one, her share is a half. , Al-Qur'an Surah 4, Ayah 11 Allah deemed every person to be entitled to inheritance, hence Sayyida Fatima (as) was the Waris of her father; the Hadeeth advanced by Abu Bakr contradicted the Qur'an. Any Hadeeth that contradicts the Qur'an cannot be acted on. From what is left by parents and those nearest related there is a share for men and a share for women, whether the property be small or large,-a determinate share. , Al-Qur'an Surah 4, Ayah 7 When a woman is the Waris of her father then Sayyida Fatima (as) was the Waris of her father, To (benefit) every one, We have appointed shares and heirs to property left by parents and relatives. To those, also, to whom your right hand was pledged, give their due portion. For truly Allah is witness to all things. , Al-Qur'an Surah 4, Ayah 33 When every person inherits from their parents then Sayyida Fatima (as) likewise inherited from her father (s). Bloodrelations among each other have closer personal ties, in the Decree of Allah. Than (the Brotherhood of) Believers and Muhajirs , Al-Qur'an Surah 33, Ayah 6 When the Qur'an bestows the closest ties to blood relations, then they clearly are the closest when it comes to inheritance. Sayyida Fatima (as) was closet in ties to Rasulullah (s), hence why Sayyida Fatima (as) produced Qur'anic evidence of her right to inherit her father's property. And Solomon was David's heir. , Al-Qur'an Surah 27, Ayah 16, When Prophet Sulayman (as) was the Waris of Prophet Dawood (as) then by the same token Sayyida Fatima (as) was the heir of Prophet Muhammad (s). To David We gave Solomon (for a son),- How excellent in Our service! Ever did he turn (to Us)! Behold, there were brought before him, at eventide coursers of the highest breeding, and swift of foot; , , Al-Qur'an Surah Sad Ayah 30 & 31, In Sunni commentaries of this verse, where we learnt that the breed referred to one thousand horses, which Hadhrat Sulayman (as) inherited from his father. Praying: "O my Lord! … give me an heir as from Thyself,- (One that) will (truly) represent me, and represent the posterity of Jacob; and make him, O my Lord! one with whom Thou art well-pleased!" , Al-Qur'an Surah 19, Ayah 4 - 6 If Prophets do not leave inheritance, Prophet Zakariya (as) would not have prayed for an offspring to inherit him. Sayyida Fatima (as) was likewise the Waris of her father. And (remember) Zakariya, when he cried to his Lord: "O my Lord! leave me not without offspring, though thou art the best of inheritors." , Al-Qur'an Surah Anbiya, Ayah 89, This verse reminds us of the supplication of Prophet Zakariya (as), if Prophet's cannot inherit then Allah (swt) would have surely told him that Prophets leave no inheritance. There did Zakariya pray to his Lord, saying: "O my Lord! Grant unto me from Thee a progeny that is pure: for Thou art He that heareth prayer! , Al-Qur'an Surah 3, Ayah 38, Hadhrat Zakariya (as)'s fear that his property would be usurped by his relatives, led him to pray for a pious offspring. If Prophets do not inherit then Allah (swt) would have rebuked Zakariya (as) for making such a supplication. And (further) their Prophet said to them: "A Sign of his authority is that there shall come to you the Ark of the covenant, with (an assurance) therein of security from your Lord, and the relics left by the family of Moses and the family of Aaron, carried by angels. In this is a symbol for you if ye indeed have faith." , Al-Qur'an Surah 2, Ayah 248, These relics remained in the family of Yaqoob (as) why were they not given away as Sadaqah? The above verses of Quran which were recited by Sayida Fatimah SA in her own defense. This is not something that a molvi has made up. We have already agreed that she was the inheritor of the prophets knowledge so she knows who is and isnt allowed inheritance.

اعوذ باللہ من الشیطن الرجیم ۔۔۔ومن شرما خلق ۔۔۔۔بسم اللہ الرحمن الرحیم ۔۔۔السلام و علیکم ۔۔۔۔ا سورت انفال میں اللہ تعالٰی نے ارشاد فرمایا ھے ۔۔کہ مال غنیمت پر اللہ اور اس کے رسول کا حق ھے۔۔جب تک آپ صلی اللہ علیہ و آلہ و سلم جب تک حیات رھے مال غنیمت آپ صلی اللہ علیہ و آلہ و سلم کے استعمال میں رھا ۔۔۔ اور اپ صعلم نے اماں فاطمہ رضی اللہ عنہا کو تحفے میں دے دیا ۔۔۔۔ تحفے دیئے بھی جاتےھین۔۔۔ اور مصلحت کے تحت واپس بھی کئے جاتے ھیں ۔۔۔ جیسا کہ آپ صلعم کی وفات کے بعد باغ فدک کا معاملہ ھوا۔۔۔ جب حضرت ابو بکر صدیق رضی اللہ عنہ نے کہا کہ حضرت محمد صلی اللہ علیہ و آلہ و سلم نے فرمایا تھا کہ انبیاء کرام علیہم السلام کی وراثت میں کسی کا کوئی حق نہیں ھوتا ۔۔۔ اماں فاطمہ رضی اللہ عنہا اور حضرت علی رضی اللہ عنہ واپس چلے گئے ۔۔۔ (1)ھم مسلمانوں کو نا جانے کب سمجھ آئے گی ۔۔۔۔۔؟؟؟؟ کہ اماں جان حضرت فاطمہ رضی اللہ عنہا اور حضرت علی رضی اللہ عنہ نے جب حضرت ابو بکر صدیق رضی اللہ عنہ سے یہ حد یث مبارک سنی تو اماں جان فاطمہ رضی اللہ عنہا اورحضرت علی رضی اللہ عنہ (کیوں )واپس چلے گئے ۔۔۔۔ (قابل غور بات )؟؟؟؟؟؟؟؟؟؟؟؟؟؟؟؟ وہ یہ کہ وہ اھل بیت ھیں ۔۔۔۔۔۔۔ اور ایک باغ فدک کے لئیے کیسے اپنے والد حضرت محمد صلی اللہ علیہ و آلہ و سلم اور ان کی بات کی نفی کرتے ۔۔۔۔۔ (2 )اب بات ھے سورت انفال کی (کہ مال غنیمت اللہ اور اس کے رسول کا ھے )۔۔۔۔۔ انبیاء کرام علیہم السلام کا مال غنیمت پر ان کی زندگی میں حق ھوتا ھے۔۔۔۔۔۔اور اللہ کے پاس جانے کے بعد؟ ؟؟؟؟؟؟؟؟؟؟، (3 )اللہ کا حق ھے)(وہ کیسے )؟؟؟؟؟؟؟؟ اے مسلمانو ۔وہ ایسے کہ۔۔۔۔۔ اللہ تعالٰی نے حضرت محمد مصطفی صلی اللہ علیہ و آلہ و سلم کو اپنے دین اسلام کے رستے کے لیے بھیجا اور اس کی تبلیغ پر مامور کیا ۔۔ ایسے یہ اللہ کا دین ھوا۔۔۔۔۔ ارے نادانوں بات کو سمجھو ۔۔۔۔ اللہ تعالٰی نے مال غنیمت کا کیا کرنا ھے۔۔۔ وہ بھی تو انبیاء کرام علیہم السلام کی امتیوں کے لیے ھوتا تھا ۔۔۔۔ انتہائی ضروری بات؟ ؟؟؟؟ نبی کریم صعلم کی اولاد کے علاوہ اگر ؟؟؟؟ امتیوں میں اگر ایسا مسئلہ ھوتا تو وہ جائیداد کے لیے اپنے والدین کو اگر جھوٹا کرنا پڑے تو وہ جھوٹا کرنے میں ذرا بھی دیر نہیں لگائیں گے ۔۔۔۔بات کو خود دماغ لگا کر سمجھو ۔۔۔۔۔۔ انتہائی انتہائی انتہائی ضروری بات۔۔۔۔ (12 ) آپ سب مسلمانوں کا یہ یقین ھے اور ھر مسلک کے لوگوں کا ۔۔۔۔کہ حضرت محمد مصطفی صلی اللہ علیہ و آلہ و سلم کے معجزات کے متعلق آنے والے وقت میں ھونے والے واقعات اور روشنائی کروائ ۔۔۔ حضرت امام حسن و حسین رضی اللہ عنہ کی شہادت کے متعلق ۔۔۔۔ میرا ایک سوال ھے ? ؟؟؟؟؟؟؟؟؟؟تمام مسلک کے لوگوں سے ۔۔۔۔وہ یہ۔۔۔۔۔۔۔۔۔کہ۔۔۔۔۔ اللہ تعالٰی نے ہمارے پیارے نبی حضرت محمد صلی اللہ علیہ و آلہ و سلم کو ہر بات بتائی ۔۔۔ چاھے وہ غیب کی خبریں یا آنے والے وقت میں ہونے والی باتیں ۔۔۔۔)(یا زمانہ کفر و اسلام کی باتیں )اللہ تعالٰی نے اپنے نبی کریم کو ہر بات سے آگاہ کیا۔۔۔۔۔۔ تو پھر ایسا کیا کہ( نعوذ باللہ من ذالک )۔۔۔۔؟؟؟؟؟؟؟؟؟؟؟؟؟؟ اللہ تعالٰی نے حضرت ابوبکر صدیق رضی اللہ عنہ اور حضرت عمر فاروق رضی اللہ عنہ بتانا بھول گیا تھا کہ یہ تیری اولاد کے دشمن ہیں۔۔۔۔۔ استغفراللہ ربی من کل ۔۔۔۔ اور انہیں اپنے 4 یاروں میں رکھا ۔۔۔۔ اور اس سے بڑھ کر اپنے دائیں ہاتھ اور بائیں طرف سلایا ۔۔۔۔۔۔ اب بھی اپنی آنکھیں اور دماغ کی کھڑکیاں کھولو۔۔۔۔ کب تک علماء حضرات کے رحم و کرم پر رھو گے۔۔۔۔اتنا آگے نہ جاو کہ واپسی کا راستہ نہیں معلوم کر پاو۔۔۔۔۔ سلیم شاہ صدائ صابری چشتی
