Well as some one said in Mother Encore server: Nintendo doesn’t fully own the MOTHER series or its characters, there’s a reason that every Smash game has Shigesato Itoi credited in the copyrighted details. Without legal blessings from Itoi, Nintendo can’t take down whatever they want regarding MOTHER fan-projects, since it’s only a 2nd party series to them. And seemingly, Itoi and Hobonichi (Itoi’s company and the partial owners of the MOTHER series IP) don’t seem to mind fan-games and other fan-content that Nintendo normally would take down so..... Encore seemingly is fine.
