Dissent is integral to democracy, and Professor GN Saibaba’s story is a sad example of how dissent is criminalized, how our criminal justice system works, and how our fundamental rights can be watered down. Professor GN Saibaba was a scholar and English professor at Delhi University. He was a social activist and human rights advocate. He was born with 80% disability due to polio. In 2014, he was arrested under the Unlawful Activities (Prevention) Act (UAPA) on allegations that he possessed extremist-related literature and documents in his room. After spending 10 years in severe jail conditions as an undertrial, in March 2024, a divisional bench of the Mumbai High Court granted him a clean acquittal for the second time. (Previously, in October 2022, a single bench of the Mumbai High Court acquitted him, stating that the prosecution failed to prove GN Saibaba's ties with Maoists. On appeal, the Supreme Court suspended the order and asked the High Court’s divisional bench to reevaluate the case, which later again acquitted him.) In its verdict, the court clearly stated that GN Saibaba was being acquitted not due to any benefit of the doubt or technicality, but as a clean acquittal. It also questioned the very process of the investigation. Can anyone be charged under UAPA simply on the grounds of possessing certain extremist literature? (In this case, the search was conducted behind closed doors without allowing anyone, and an illiterate person was considered as a witness.) This act does not fall under UAPA, and the court granted him a clean acquittal. The High Court also mentioned that the prosecution’s case was invalid due to lack of technical propriety as well as various cases of dodgy evidence.It called the trial court’s verdict a "failure of justice." Many questions arise from this incident: Who will give back Saibaba’s precious 10 years of life, and who is responsible for the severe trauma he and his family endured? The Supreme Court once ruled that if a person undertrial for a long period is later acquitted, they are eligible for compensation. Yet, Saibaba has not received any compensation. Moreover, no amount of compensation can justify the severe trauma he experienced during his 10 years of jail sentence in Nagpur Central Jail. He described his jail life as severe-his room was so small that he couldn’t move his wheelchair. Two other inmates had to help him if he wanted to use the washroom. When he started his jail term, aside from his disability, he was a relatively healthy person. By the time of his release, his heart was functioning at only 55% capacity. He faced liver and pancreas problems, kidney failure, weakening of his brain and nervous system, severe gallbladder pain, and muscle deterioration. He was also diagnosed with COVID-19. Doctors recommended multiple surgeries, but he did not receive proper treatment. Another person arrested in the same case, an Adivasi named Paandu, died of swine flu in jail. The right to life and the right to live with dignity are fundamental rights, even for prisoners. Does this not apply to GN Saibaba? Did he and others like him deserve such cruelty? The Right to Freedom, the Right to Equality, and the Right to Live with Dignity were the foundations of our freedom struggle and are fundamental principles of our Constitution and democracy. Shouldn’t these rights have been upheld for Saibaba, even just to provide him with basic medical services? He wasn’t asking for royal treatment-just the facilities to live as a human being. Does the right of a disabled person not apply here? His bail petitions were rejected multiple times. He wasn’t allowed to visit his mother when she was critically ill or attend her cremation after she passed away. The Supreme Court has often said that bail is the rule, and jail is the exception. Why did this not apply to GN Saibaba? There are many cases where individuals with more severe charges were granted bail quickly. For example, Gurmeet Ram Rahim Singh, alias Dera Baba, who was charged with rape, sexual harassment, and murder, was granted parole multiple times. The main allegation against GN Saibaba was that he was trying to destabilize democracy. A serious question arises: Is our democratic system or Indian state so weak and powerless that it could be threatened by a severely ill man with an 80% disability? He was suspended from his professor post once arrested. Even after his release, despite multiple pleas, he did not get his job back, nor did any other institution offer him work. In Saibaba’s case, it wasn’t just the jail term-the process itself became the punishment. As per the courts, "Unless proven guilty, one is innocent." Does this not apply to Saibaba? Where is his right to speedy justice? Justice delayed is justice denied, but in Saibaba’s case, justice was buried. He finally passed away on October 12th after his body couldn’t tolerate a minor gallbladder surgery. In his own words: "My story is your story, my freedom is your freedom. I don't need sympathy, I need solidarity." GN Saibaba’s death is not just a death; it is a sad commentary on the Indian criminal justice system. GN Saibaba did not die-he was killed by society, by the errors and loopholes in the Indian criminal justice system. The nation is sorry for you, sir. You deserved a better life. We pray that you receive the respect and dignity you expected, at least in your next birth.🙏
