K-pop: los crímenes sexuales revelados en chats secretos de ídolos de la música coreana

En Corea del Sur, las estrellas del K-pop tienen fama, fortuna y millones de fans. Pero una investigación descubrió que algunos de ellos llevaban una doble vida, donde filmaban y distribuían videos de mujeres drogadas, violadas y humilladas.
Este reportaje de la BBC cuenta la historia de las mujeres periodistas que asumieron la tarea de investigar el grupo de chat secreto de estas estrellas del K-pop, y por ello fueron después acosadas en internet.
Las tres estrellas investigadas fueron Choi Jong-hoon, guitarrista de la banda FT Island, el solista Jung Joon-young, y la estrella del grupo Big Bang, Seungri.

Segundo, en este tipo de delitos es muy importante considerar el contexto; si la mujer se expuso, si la mujer lo provocó, si la mujer se prestó a eso, si la mujer se defendió; si la mujer hizo lo que estaba en su mano para evitarlo; si para la mujer era o no importante su sexualidad; si hubo consecuencias o no, ya sean físicas o psicológicas. En Occidente tradicionalmente se le ha dado mucha importancia a la violación, por una tradición de moral cristiana en la que el sexo se consideraba un pecado, y nacida en una época en la que no existían los anticonceptivos y una mujer no virgen no tenía futuro; sin embargo, también sucedía que muy pocas cosas se consideran violación en ese marco tradicional. En la actualidad, la castidad de la mujer ha dejado de tener valor y los anticonceptivos han hecho que una violación deje de tener las consecuencias que tenían antes; en ese contexto, la violación ha adquirido otras connotaciones. Si queremos ser objetivos, debemos valorar la gravedad de un hecho por sus consecuencias, y considerando la culpabilidad de cada uno, en el contexto que lo generó. Por otro lado ¿Qué tiene que ver, entender que la gravedad de un acto malo está altamente correlacionado con la gravedad de sus consecuencias, con el traspaso de algún tipo de responsabilidad? Son cosas independientes, e igual una víctima puede tener responsabilidad en haber sido víctima, pero eso es otro asunto, que no tiene que ver con la gravedad de las consecuencias. Y vamos, que la valoración de las consecuencias para determinar una sanción, es algo tan natural y obvio, que es en lo que se basó el primer sistema de justicia de la humanidad, que es la ley del Talión, y sigue siendo uno de los principios fundamentales de justicia, quedando contenida en el principio de proporcionalidad. Después hablas de que incluso en medio de una situación íntima, el hombre debe detenerse; pero de lo que estamos hablando aquí, no es de lo que debe de ser, sino de que la gente no es perfecta y hace cosas malas, pero eso no significa que sean igual de malas unas cosas que otras, y algunas son más entendibles (o a veces hasta tolerables), aunque todas estén mal. Y es que además, no para todos es igual de importante su sexualidad, y decir lo contrario es mentir; yo conozco mujeres que pueden vender su sexualidad por un poco de dinero, y mujeres que valoran mucho su virginidad; y no hay comparación entre el daño que le puede causar a una o a otra, aquello que comprometa su sexualidad, y por lo mismo una se va a cuidar muchísimo más que la otra, para que no le ocurra. La subjetividad tiene importancia aquí, porque es lo único que puede justificar una gravedad práctica del hecho, en el caso de que no haya habido consecuencias físicas u objetivas. Querer darle un valor a las cosas por definición, independiente a la realidad práctica, es totalmente arbitrario y dogmático; es la misma forma en la que se sustentan las condenas para el adulterio o la infidelidad en el Islam. Y que quede claro, que no digo que no deban existir castigos para los malos comportamientos; lo que estoy diciendo, es que estos castigos deben ser proporcionales, y además, que no se debe infantilizar a la víctima, y dejar de considerar la posible corresponsabilidad que tenga en haber sido víctima.

Al contrario tendríamos que analizar el sistema penal del país, y cual es su plan de reinserción social, estamos acostumbrados a penas extremadamente largas pero sin ningún fin mas que condenar, haciendo que la carga fiscal aumente y sin ninguna mejora para la sociedad a largo plazo. Además, especialmente cuando las faltas son menores, y no dejan huellas visibles que puedan demostrar que hubo un ilícito, lo normal es que no se pueda condenar a nadie; otra consecuencia de que la ofensa no deje secuelas visibles, es que la medida del daño se vuelve muy relativa y manipulable; por eso es correcto no sancionar excesivamente estas cosas.

Este caso me revuelve el estómago, sobre todo por cómo se "resolvió" dando condenas patéticas, me atrevo a decir que ninguna víctima ha recibido justicia aún. El mundo entero es un asco en cuanto a hacer justicia, y se minimiza muchísimo los casos de violencia sex*al y más cuando se trata de casos de personas adultas, es fácil juzgar y decir que "los adultos saben lo que hacen", falta muchísima más empatía a las víctimas de todo el mundo que han pasado por abuso y acoso sex*al.

Yo creo que es peor que te metan unos años a prisión que lo que les pasó a ellas; además no sabemos el contexto en el que sucedió, ni si las mujeres tuvieron parte de la culpa. Y lo digo porque conozco mujeres que van a lugares de mala muerte a emborracharse y drogarse con cualquiera, y no sorprendentemente pueden llegar a tener malas experiencias; porque en esos ambientes los juegos llegan demasiado lejos y se pierden los límites.
