Excellent Advice! Get a VA accredited lawyer on your side! My error, back in 2013 was using free services such as VFW, DAV, and AL, Seattle... I took my 2013 original claim to BVA in DC. 2016. How could anyone in their right mind dispute VA X-Ray's, signed consent form for a shoulder replacement! 5051 claim (temporary)? DC Board of Appeals Judge Ames did! I now have an accredited VA lawyer, Veteran to represent my CUE Appeal. I had to show her my prosthetic (ball & stem) which I kept after it was removed! I've been waiting close to 10yrs for my disability claim to be processed correctly according to CFR 4.71 (5051). Go with an accredited lawyer, Veteran! The sooner the better for your disability claim process. No veteran should have to dispute a shoulder replacement 5051; VHA X-Rays/MSN ball/stem prosthetic implants. Close to 10yrs since surgery and 5 years prior of agonizing shoulder pain disrupting work load and quality of life!

Thank you for the good intel. I appreciate your videos. I know that any GI cancers are presumptive under the pact act. However, are IBS, GERD and other Gi disorders presumptive under the Pact Act as well? Would you please advise? Thank you.

IBS, GERD, and other GI disorders are not presumptive under the PACT Act, but they can be service connected through some earlier gulf war presumptions. But there are different requirements for those.

Does my claim have to be denied for you to help? My VSO does not return calls or emails. I'm still waiting decision. Claim filed a year ago next week

It doesn't have to be but, if you are in the middle of waiting for a decision, there probably isn't much that any new rep can do. Sometimes if you call the VA and put up with waiting to talk to a human you can find out a bit more about what the VA is waiting for on your claim.

I never want a deadline to pass on an appeal. So if a person is close to a deadline, the best course is to file the other claims even if they will likely be denied. Otherwise, for me, it really depends on the situation. Sometimes it makes sense to wait, usually to consolidate related claims and make future decisions easier - hopefully- but sometimes it doesn't.

IFFF for some reason the VA denies or tries to low ball me on my two increases i know i can do an HLR or supplemental claim however, then that will be putting me even further back because i can't just add on all my other stuff right? That would be considered two separate issue or claims?

A veteran can file a new claim at any time. You do have to use the correct form, 21-526. A higher-level review will not consider any new claims, but a new claim filed at the same time as a supplemental claim could be developed together. Your situation might be one where it makes sense to file everything now to establish the earliest effective date, then deal with any bad decisions through a supplemental claim or higher-level review.
