The plaintiff hired the defendant to install a water filtration system in his house, and it guarantees odor-free water. However, the plaintiff says three weeks after the installation, there was a strong sulfur smell, so the plaintiff is suing for a refund. The defendant claims the plaintiff’s water heater needs repair, not the water filtration system.

I agree with the verdict, but it would be good business to put an asterisk with the "eliminate" sulfur odor and add that in some cases additional solutions might be necessary. I see the plaintiffs point that the defendant's ad stated that there would be no sulfur odor and that's what he fairly paid for.

We have well water, Mississippi, and it has no smell or weird taste. I moved to Louisiana have city water and it's awful on my skin. It smells sometimes chlorine, rotten eggs, chemicals. We refuse to drink it, we have a filter on fridge for ice and water but it still tastes weird.. I ended up buying an ice maker and buy gallon spring water for ice, drinking, and watering dogs. I wish I could get well water at our house now. My family home in MS when we visit our skin is soft and clear no redness or drying, hair is softer. I hate city water. It also doesn't meet the standard rules half the time for water regulation .

I don't know anything about Florida's water or having sulfur in the water, but I have a couple of questions. 1. If he didn't have sulfur in the water prior to the new system and the only thing he changed was the new system and then he had a smell, then wouldn't that mean that the new system is actually the problem.? After all, its the only thing that changed. It seems as if the new system doesn't remove as much of the sulfur as the old system removed, and there's something about the water sitting in the hot water tank that allows the surfer to accumulate. 2. If he has a sulfur smell in the hot water but not the cold water that would appear to imply that the problem is the hot water tank. However the hot water tank does not add sulfur to the water, so how can it be the source of the sulfur?. It seems as if the hot water tank, when unused for a period of time, simply allows sulfur that's already in the water to accumulate. 3. changing to a zinc/aluminum anode might solve the problem, but that doesn't necessarily mean that the tank is the problem. If this system is known to not remove as much sulfur from the water as older systems, and the hot water tank anode might need to be replaced with a zinc/aluminum anode, why is this not something that is communicated to customers up front.? 4. So what do you do if you have a water softener.?

I get it was the plaintiff's system, but if the defendant's ad states a guarantee that they can provide odorless water and for whatever reason they do not, shouldn't they say "Sorry we can not live up to our guarantee with your system" and give the money back? I think the judge was missing that the plaintiff was not saying it was the def.'s fault but that he could not provide what he guaranteed in writing.
@benjie128

Yes, the guy had a statement guaranteeing odor free, and it works. There is a mitigating factor based on his specific geography that means his hot water heater is re‐adding the sulfur smell back in. Evidenced by the cold water is fine.
@sisteryaya24

I don't agree with the verdict in this case. He paid this guy $2000 to install this new tank and get rid of the smell. That was the agreement. The defendant was unable to get rid of the smell so it would be only right to return most of his money. The defendant could have done the same research that the judge did to solve the problem. That was his job to solve the smell problem. The plaintiff should have at least gotten most of his money back, special problem or not.

The plaintiff suing for the full amount of the new system (not just a discount) may not have been appropriate. I however think the defendant should have had extra info in his brochure - sounds like he touted non stinky water and the plaintiff relied on that info. Going forward, he should change his brochure to say not guaranteed. I think the plaintiff should have gotten a little money back based on him relying on the brochure's information.
