The Rule of Beneficial Construction and Ejusdem Generis are principles of statutory interpretation used in legal systems to determine the meaning of a statute.
The Rule of Beneficial Construction involves interpreting a statute in a way that advances its underlying purpose or policy. In other words, if a statute has more than one reasonable interpretation, the court should adopt the interpretation that is most beneficial to the public or to the group that the statute was intended to protect. This principle is based on the idea that the legislature would not have intended to create a statute that is inconsistent with its overall purpose.
For example, if a statute is designed to protect consumers from fraud, a court may interpret the statute broadly to ensure that consumers are adequately protected, even if that interpretation is not the most literal one.
Ejusdem Generis is a Latin term that means "of the same kind." This principle involves interpreting a general term in a statute by reference to the specific terms that precede it. If a list of specific items is followed by a more general term, the general term is interpreted to include only items of the same kind as those listed.
For example, if a statute prohibits the carrying of "knives, swords, daggers, and other dangerous weapons," the general term "other dangerous weapons" would be interpreted to include only items that are of the same kind as knives, swords, and daggers.
These principles are used by courts to help interpret ambiguous or unclear language in a statute. The goal is to determine the intended meaning of the legislature, while also ensuring that the statute serves its intended purpose and is not applied in a way that would be contrary to that purpose.
