In cases where both Oral and Documentary evidences exist- As in mentioned in Section 91:Evidence of terms of contracts, grants and other dispositions of property reduced to form of document, Documentary evidence must be given as Documentary evidence is better than Oral evidence, where both such evidences exist and hence - Documentary evidence will be the BEST EVIDENCE.

Sir best evidence ka matlab in short yahi hai na ki aisa evidence jo beyond reasonable doubt koie chiz prove kare right? ya fir ye sirf documents ko apply hota hai please tell as soon as possible.

Best evidence ka ye matlab nahi hai ki beyond reasonable doubt prove kare, but: If it is a Document - bring the Primary Doc. If it is Oral- call the person who has heard about it itself. Section 91 of the Act lays down the provision that when evidence related to contracts or grants or other depositions of the property is reduced as a document, then no evidence is required to be given for proof of those matters "EXCEPT the document itself." Now think: Agar ap exam se pehle bohot bimar hai or fir bhi apna BEST dete hai, to shayad ap pass ho jae lekin 1st na aa pae. To "Best" ka matlab- Jo abhi evidence hai wo Best ho"- result chahe Kaisa bhi ae. Ye ho sakta hai ki ap 1st bhai aa jae exam me. Aur isi tarih shayad apka Best evidence bhi conclusive proof banke "beyond reasonable doubt" prove krde. Lekin Evidence mein- Give the "Best in evidence" you have.

Sir fir criminal cases me kaise apply hoga best evidence rule? for example rape victim kahe ki uska rape huva hai aur X ne kiya hai, aur also dr ki report kehe rahi hai ki X ke dna samples rape victim ke private parts me mile hai? lekin X claim kar raha hai ki wo waha tha hi nahi aur X ne hotel ki cctv dikha kar prove kar diya ki wo waha tha hi nahi toh isss case me kaise apply hoga best evidence rule, sorry to disturb you again but muze ye bahut confusing lag raha hai.

This is a hypothetical case. There is nothing like this is best or that is best. Both can be best in their own places. Is case mein court or bhi sabood dekega, force ka use, wo admi kaha tha us waqt etc. Sirf 2 evidences ek dusre ke opposite hona, ye nahi kehta ki case solve nahi hoga. Bohot se aur evidences bhi hunge. Lekin agar, doubt create hua court ke dimag mein in criminal matter, then accused will win the case. Bcz criminal law me ye presume karte hai ki “beyond any shadow of doubt” hume sabit karna hoga case against accused. Agar evidence na mila ya puri tarah sabit nahi hua then accused wins.

Ye Sach hai ki "Best evidence" Sec 91 ke liye hi use karte hai, ki jo chiz mentioned hai usme wo sirf "doc" se hi prove hoga bcz it is the best evidence. Lekin ye ek general rule bhi hai. crlreview (dot)in/primary-evidence/

Brother you are correct. If you refer to other good books then sections60, 64 also are talked about as sections related to the Best evidence rule. If you read the first line of these 2 sections, you would understand that it deals with best evidence rule. Thank you for the comment, I appreciate your good comment.
