Now to be fair for the first ID refusal. I think the cop was more trying to verify if the car belonged to him. I understand the law, but wouldn't you want to absolutely make sure someone owns the car being blocked before using your authority to have someone to move their car? That's just what I would do to be safe, but then again he did not articulate that.

Not really how tow companies work. They need to make sure it's clear that a vehicle can't park somewhere before they tow a car. They don't tow just because you tell them too. That's how lawsuits are won. But they'll tow your car, for an obscene fee.

They want everyone's ID because EVERY police agency submits EVERY incident report to DHS federal fusion centers where they're analyzed by AI systems. This let's DHS build a huge database of individuals and who they know, travel and associate with. They know more about who people you know know than you do.

Sorry to respond to an old comment; however, I'd argue that it still falls under 1st Amendment (though obviously 4th is more apt). If it protects your freedom to speak (from government punishment), it inherently also protects your freedom not to speak (silence is also a form of speech/expression/communication). If you can't be compelled not to speak through the threat of punishment (the common application of freedom of speech), then you also can't be compelled to speak through that same threat of punishment/legal consequence.

State police only have a jurisdictional restriction in the state. Also, when some departments are understaffed, they will bring in outside LEOs and enter into a contract with that other department of a period to enforce laws (traffic, criminal, both) depending on the contract. LEOs, when they obtain their certification, are (generally speaking-depends on state regulations) certified for law enforcement in the state in which they obtain certification. The EPA Hitta video isn't a good example of ID refusal. The officer asked but did not press the issue when the request (and it was a request) was refused.

folks that carry open or concealed within the state law, always have to sit there and go through a process to try and defend what isn't illegal! What the officer should do is take up the time of the person who called in the complaint and school them on the law that it's not illegal to do that in the United States, or more specifically the state that they are in! My guy just stop. You’re giving shit ass legal advice. Our country is made up of 50 states. Each of those 50 states has their own criminal, traffic, health, etc code of laws. Texas is like what you just said. Not legally required to give ID/Identify information unless you’ve been placed under arrest. But Florida is not like Texas. Florida is a terry stop state where all they need is reasonable suspicion of a criminal activity. Aka detainment. Not a specific crime like soooo many people think. The cop doesn’t need an actual crime in mind. It’s about the totality of the circumstances. Even something that by itself is a legal act can be grounds to detain someone as long as the totality of the circumstance points to criminal activity. Tl;dr : Stop and ID laws vary by state. RAS is based on the totality of the circumstances and not a specific crime.

2nd vid, if police from another jurisdiction stop you for a broken tail light, it’s not legit and they won’t write you a ticket because it’s out of their jurisdiction. File a complaint for the stop as they should not be stopping anyone out of their locale because they can’t enforce the law in other towns or cities and probation officers can’t make car stops because they don’t enforce the vehicle code. They’re all together and fishing.

I agree with all of these ID refusals. The first one, however, objectively I think from the cop's point of view he was attempting to verify that the person making the valid complaint was indeed living at the property in question. If the person would have supplied his ID the encounter would probably go a little smoother. It does go both ways.

The issue isn't to make the situation go smoother. It's a matter of protecting the rights we have and holding those who trample those rights accountable. It's up to each individual person to safeguard those rights. Their called "personal liberties" for a reason. If one person choses to give up those rights, that's on that individual. LEOs need to understand that not everyone is willing to do that, but the service we're required to pay for has to be homogenous. Just because an individual decided to stand up for their rights, does not mean that the LEO can just refuse service. The victim, the one standing up for his rights, was denied service simply because he exercised his 4th Amendment right to refuse to ID. Based on the limited information provided in the video, the LEO seemed like he was correct that it was a civil issue (looks like private parking) but refused to speak with the other resident simply because he refused to ID. Technically legal but poor judgement.

Under constitutional law the officer/revenue collector must have probable cause supported by oath or affirmation meaning concrete proof that you've committed a crime or he has caught you in the process of committing a crime. Otherwise the officer / revenue collector becomes his person surrenders his qualified immunity and is liable for criminal and civil charges through the Federal bureau of investigations. This is known as deprivation of rights under the color of state law.
