Good video Randy! The system definitely is broken and you're 100% right the fault falls on the wholesaler. Nobody should be able to tell us what we can and cannot drink. In my state of Iowa I'd be willing to bet dollars to donuts that a lot of our state allocated bottles end up in the possession of those that work for the state run wholesalers. It's BS.

The wholesaler/distributors have all the power in the system. They are not required to carry a brand, nor are they required to supply a brand to a store or bar. The wholesaler is not motivated to deliver small quantities of craft and makes more $ off sales of big brands. This is great info.

He literally says at the beginning that, in his opinion, bootleggers with lots of money influenced the system. This is why money/government is the likely cause. I’m sure that the big distillers, producers, and distributors would net let government ease restrictions. So, they are the problem here.

Alabama almost never sees anything from small companies. I'm fortunate enough to live near Tennessee. But for many others in the state they will never see some of the stuff I am able to get. This is unfortunate because these smaller guys is what I like to get.

Every liquor store in my area (southwest Louisiana) tells the same story. You have to buy case deals to be able to purchase allocations. Or even what they consider allocations. Penelope white label has been allocated to a smaller liquor store.

Great video Randy! The deep pockets are trying not to have the law passed in NYS. NYS Legislature just passed a Bill. Lets see it the NYS Governor signs it to make it a law. Read below: The New York State Distillers Guild and the New York Cider Association are pleased to report that the New York State Legislature passed a bill that will allow their members to safely ship products to adult consumers (A3132-Lupardo/S2852-Skoufis). If enacted, the bill will authorize intrastate shipping as well as interstate shipping to states where direct-to-consumer (DtC) shipping is legal and that have equivalent license classes. The bill now awaits signature by the governor to be enacted into law.

I’ve had many a conversation with my local brick and mortar (Kingwood Texas) about how the licensing is set up. It’s really a crooked system on who gets what and how they have to go about getting allocated items in the shop. It’s ridiculous.

I hate the 3-tier system and have commented on your past videos about this system. I live in Kentucky, I've started just going to distilleries and buying bottles. It's still not ideal. For example, I go to Buffalo Trace about once every 3 months to buy a bottle because they will only sell you one every 90 days. It's ridiculous. I've been a whiskey fan for 30 years, and in the last 5-6 years it's been virtually impossible to get what I want. I found a Weller Antique 107 store pick last Friday for $64. It's the first limited release I've been able to buy at the store all year. I now see retailers gouging the public. It wasn't bad here until about a year ago. I regularly see bottles at retailers now with prices many times what MSRP is. There's a retailer in the town over that has even developed a point system. They have limited releases on their shelves for up to %1000 markup. Every time you buy at the store, you get points. When you've saved enough points, you can trade them in so you can buy a bottle at a normal price.😂 I think it's silly. But it obviously works for this retailer. If you spend thousands of dollars at this store, you can buy a limited release for only a slight markup. This store is not the cheapest store on any product. You're paying more for every bottle you buy. Something needs to change.

The distilleries buy back their gift shop alcohol from distributors. They do not avoid the three tier system.

It does crush small or new distillers. Kentucky is getting into medical marijuana now too. The system developed for that is completely rigged to ensure big business crushes the little guy.

At Buffalo Trace you can buy Weller Special Reserve, Blanton's,and EHT EACH so as long as you like variety you have 3 bottles to keep you busy for those 3 months of and bring a friend they can get a bottle too.

They tried in TX. To have enough funding to be effective they need the larger craft distilleries to participate, but at least one of the larger craft distillers was threatened by their wholesaler and pulled out.

Ordered a bottle of The Prideful Goat 8 yr. rye from Bourbon Outfitters a few months back but it was damaged during shipping and the cost refunded since it was no longer available. Guess I’ll try again. Really like to see the smaller producers succeed in today’s crazy market.

There is generally a way in each state to sell direct to consumer, but it is so restricted that it isn't a viable path to market for a full scale business plan.

That bottle was originally released at $140. My wholesaler bumped their margin and pushed the price way up. We fired them, but the stores who have it at a high price are usually charging a normal margin.

I said "Generally speaking producers are prohibited from selling direct to consumer, and when it is allowed it is onerously restricted". I don't know the laws in Washington, but I doubt they are allowed to ship unlimited quantities direct to consumers without passing it through the wholesale tier.

@@BourbonRealTalk To be fair, if you want unlimited quantities you're probably not a consumer 🙂 We were in Seattle not long ago and we visited Copperworks. I was surprised to find out they could ship me the whiskey we tasted. By buying two bottles they paid for the shipping, and since we were out of state it was exempt from sales tax. It's a nice little distillery if you're ever in the area, and their product tastes really good. The two bottles had the exact same grain bill, except one used Vienna malt instead of plain malt. All the other variables were identical. The Vienna malt makes a substantial difference. My wife prefers the one with the plain while I prefer the Vienna.

@@bob-rogers I see. There likely is a 3rd party shipping retailer that is acting as the 3 tier system. They white label a website for the producer so consumers think they are buying direct from the producer, but the three tier system is still involved. When I say unlimited this is what I mean. Let's say you visit a distillery in TX that has 6 different SKUs. You have a great time and you want to buy one of each. Until recently they were only allowed to sell you 2 every 30 days, and shipping was not allowed. All purchases had to be in person. The state was fighting for shipping, but the Wholesaler lobby was too powerful. The wholesalers ended up offering a compromise. The wholesalers would tell the legislators it was OK for them to increase the limit to 4 every 30 days, as long as the producers would drop the shipping request for at least the next few years. The little producers knew the shipping request would likely be stopped by the wholesaler's lobby, so they took the deal. Now they can sell 4 of their 6 SKUs, but not all 6.
