Sir Three of my brothers have purchased an agricultural land measuring 650 sqyds by way of three separate sale deeds on three different dates from four joint holders of the Bhumidhari land. The property was not partitioned between the earlier title holders amongst themselves but they sold it by declaring partition on a sketch plan attached with each sale deed but these sketches are different on the three deeds. Two of the four title holders sold 392 sq yds on the front side abutting the main road and the sketch shows that there is a six feet wide lane on the side for ingress and egress of the other two. Then one another title holder sold his part of 125 sq yds and the sketch shows lane on the side. The fourth title holder sold 134 sq yds and the sketch shows that it is located on the front abutting the road. The total land sold works out to 651 sq yds exclusive of the lane. This means there is no land left for the lane. Now, it’s absolutely clear that the three sale deeds are defective and must be corrected by way of correction deed but the sellers are dead. How should the plot of land be partitioned as it is being used for residential purposes by two of the purchaser brothers at present??
