The judgement appears to miss, no facts to be prove beyond pleadings eg. Readiness, willingness in earlier time, thus in general appears, the foundation must come in original pleadings first, so that defendant must have first opportunity to impeach, admit them, if the fact of only secondary documents is in knowledge. Further, in commercial court act, no additional evidence can be given without permission of court, order 18, thus, in effect, one appears necessarily to make application citing details of circumstances, then the court will allow to depose.
