There is no better way to ensure the dissemination of this information and incentivize counterfeiters, than to have the information threatened to be removed from the internet. People did the same with the yellow cake uranium video from cody's lab. That was removed by I think ATF/FBI. I think several thousand people downloaded that before it was taken off the net.

If the video remained monetized, they would've still had decent ground for their case. PDO laws are very strict and somewhat engineered to be enforceable whenever you want. You just can't use the label or the name.

If they aren't made in a specific area you aren't allowed to call yourself But the biggest flaw in their argument is, he isn't even selling a product, he is simply teaching people to make a cheese that is similar to what theirs is.

@@SilvaDreams The consorzio (and all other consorzi in Italy) protects the disciplinare (which is a regulated recipe and production method) AND the name of the specific product. I don't know if in the US there's something similar, but it isn't a simple name thing, it's the whole procedure that is protected by the specific law. So even quoting the name and "teaching" a procedure that isn't corresponding to the disciplinare in a video that is monetized without being part of the consorzio can be a violation of the PDO. The main aim of the consorzio is to prevent it.

For the letter, they must have contracted a "youtube" specialist law company who takes care of all this things. As they receive "an enormous amount" of complains, they gave the company the permit to deliver cease and desist letters to people on their behalf. And that usually backfires....

If big business had there way we would not be allowed to cook anything at home due to trademarks and have to eat out or order takeaways to eat, they did at one time try to get a law passed that food prepared at a restaurant had a trademark and could not be copied at home but they were laughed out of court, but they will try again and again changing the wording until they can pass a law like this...sad but if people fight back they can not sue us all. not enforceable at all

Hi! i am happy all this story ended well! as a italian i was really sorry for the cease and desist letter tho! and indeed i commented that video too! I really would like to specify that the consortium it's NOT a big company but a group of very small, mostly familiar owned, companies that produces grana padano that organized together to help each other out and protect themselves! i believe all this story was a HUGE misunderstanding and it should have been addressed without letters and stuff! At lest all this story gave another subscriber! i wish you al the best and stay safe!

I try to judge people by how they respond to the effects of their mistake vs judging them by their mistakes. The "consortium" has a right to protect their IP but went a bit overboard. The apology was the right thing to do...even if it was because they got a lot of angry mail.

It's more complicated than that; unfortunately, if you don't protest the use of the term, this opens up the question of why you didn't protest the legally erroneous use of the term by a prominent figure. See the problem now? Imagine if, let's say, Obama went ahead and posted a KZbin video where he would be allegedly making Nuremberg Bratwurst... They would be *forced* to act, because not acting would imply they would be OK with Obama very publicly violating the technical specification of the legal term, thereby putting its legal validity in jeopardy.

This isn't a simple IP though, this isn't as simple as that. It's a legally protected product, the whole recipe and production method is protected by italian, european and to some extent international regulations.

Gavin, You really took the high ground. It speaks volumes about your character. You were very measured and calm. I would have raged and said things I would regret later. I would not have taken down the video. Your post about Grana Padano was literally an advertisement for this cheese. I had never heard of this cheese (and many other cheeses) before. I am not a cheesemaker, and I do source some of the actual cheese PDO you present as a "style". For those of us who don't make cheese, you educate us about cheeses from around the world. I know what I like in a cheese, and you convey the cheese flavor and texture that helps me decide what I'd like to try from the cheese section at my grocery. I'm going to look for Grana Padano next time I go shopping.

however the improper use of the Grana Padano Designation (legally registered name) in your videos had been noticed by the control agency we have, just to clear something up, Gavin in no way has NEVER improperly used the name of any trademarked cheese in his videos, he refers to these as "Style" cheeses and does not market nor sell his hand made cheeses as trademarked cheeses. I really think they should have been pleased to see a "home cheesemaking" club make something like their cheese as there is no greater accolade than imitation. I mean, it was a “cheese consortium” that came after you. That alone sounds like something out of badly made 007 knock-off series from the 60’s. I just picture a guy dressed up in a yellow suit with screen printed holes all over it mimicking Swiss cheese sitting on a high-backed swivel chair watching intensely to your videos on a 80 inch drop down monitor and at some point, he summons henchmen to enter the room.
