I KNOW THIS IS OLD, BUT I WENT TO COURT TODAY (10/25/24) ON A WINDOW TINT TICKET AND BEAT IT THANKS TO BRUBAKER VS COMMONWEALTH OF PA. The officer was soooo sure of himself. He was surprised when I mentioned the Brubaker case to the Judge as the officer had no knowledge. The Judge went to look up the case while the officer went out to his vehicle and returned with this rather large book, and thought he was doing something by showing me that PennDot tint % checklist. He did not realize that checklist had NO weight due to the way he wrote the ticket and the code used (4524) (e) (1). Long story short there are two facets regarding window tint and the way the officer reaches his conclusion is pertinent. The judge stated if the officer had used a light meter and there was something else...but if he had used the meter I would have been guilty, but since the officer could see inside the vehicle (he didn't admit it-I actually drove the car to the hearing with the tint and the Judge came outside to check the vehicle). Sorry for the novel and thanks to your channel I won!!!!!!! RESPECT!

I also just looked into this as I plan to get 35% tint on my new car. Brubaker works if they charge you with violating the statute that Brubaker got charged with violating (75 Pa CS 4524 I believe). However, if they charge you with violating another statute, 75 Pa. C.S. 4107(b)(2), it’s a crime to operate a vehicle not “equipped as required under department regulations.” So that PennDOT sheet that is quite frankly absurd is still the law, they just have to pick the right statute to charge you with violating. It’s obviously a lot easier to beat the statute Brubaker got charged with violating. They could always amend the complaint against you or refile charges to get you if they realize they made a mistake. Those percentages are in the Pa Code, which contains regulations made by agencies like PennDOT, made enforceable by statutes from the legislature. Similar to how Congress gives agencies like the FCC, SEC, IRS, etc. the ability to promulgate rules you can get in trouble for violating. 75 Pa CS 4107 makes those percentages in the Pa Code enforceable law. I get not wanting to allow truly dark tint for safety, but 35% is totally reasonable. 70% is absolutely unbelievable to me.

Had a cop on Toll 66 (Amos K. Bypass) pull me over, and threaten to pull me over every time he was on duty and seen my car on that road if I didn't remove my 35% tint. That was after I was compliant with his requests to see in the car. I think the largest issue the majority of us have with the law, is that we all either know a law enforcement office, either state or local, that has a completely blacked out personal car that if we were caught in would be illegal to police.

@JaredPaideia just pay and go. I was never into drugs or anything like that but the cops use it for also a way to pull you over late at night or something like that or if they think you're suspicious or something, that way they get to take a look in your vehicle as well. As long as you're not up to no good or riding dirty or anything, it's just a simple ticket and go, sometimes they wouldn't even give you a ticket. Other times it would be a ticket that if you take the tint off of they it away if you showed them within10 days but I would just pay the ticket cuz I always wanted it cuz it made the car look good but I got expensive and as a young guy that really sucked. Good luck to you bro sounds like you're debating whether to get it or not LOL get it, just don't go 5%, go like 20 or 35% so they can at least see your silhouette in there and you're less likely to get pulled over. It's also a bitch to try to see at night with really dark tint it's definitely a problem. Don't go too dark

If law enforcement pulls you over, the best thing to do is put down all your windows, turn on all your interior lights, and put your hands on the top of the steering wheel so the cop knows you aren't a threat.

No because there are 2 statutes you can be charged with violating. The one in Brubaker is more vague and easier to get away with defending. The one they’d normally charge you with is just violating a PennDOT regulation, with that regulation being the percentages he mentions in the beginning of the video.

I was pulled over on my birthday and given a ticket for it, two days later my mother was pulled over..on her birthday, and given a ticket for the tint. When she was pulled over, I was behind her in her car with the same tint as was on my car- no issues with her tint though. At that time they obviously pulled my car over just to be dicks. I've had issues one other time with tint, it's always been the state police. Never any issues with local cops & tint. I only do 20%, which isn't that dark and any time I've ever been pulled over I drop all windows. I could *maybe* understand if it was 5% or 2.5% or something. Really sucks..

I’ve had 5% on my truck and 20% tint in my Range Rover for over 10 years now. Been pulled over 2x for minor speeding and still never got any ticket for my tint. IMO I’m cool running the risk. One thing I’m not sure about, I know this state issues fix it tickets where you can dodge the fine if you get it removed and signed off at a state inspection facility. But… if the fine is $110, if I just say fuck it and pay the fine and keep my tint because I’ve gone a decade so far without any enforcement action against me for these vehicle code infractions, I’ll just pay this fine and see how long I can go till I get another etc. I feel like that is a pretty reasonable solution lol. My tint cost me $600 per vehicle, if I have to pay $110 every 5-10 years as a no points violation then hell that’s not bad lol. Rather pay that fee than remove the tint and pay another $600 to re tint it

Hi there! Great info you put out! This does not constitute legal advice. Some jurisdictions make different provisions, but generally secondary offenses are as you explained. In Philadelphia, secondary offenses include things hanging from a mirror, minor cosmetic damage, unfastened but still visible license plates, etc. Your assessment of Com. v. Brubaker was correct, but the most important part of that opinion is that "the terms of 67 Pa. Code § 175.67(d)(4) cannot be utilized to sustain the conviction for § 4524(e)(1)." All that means is that the PA code doesn't give enough teeth to make it really enforceable beyond "seeing into the vehicle". My opinion is to not go darker than when you can see into a vehicle on a sunny day with no adverse weather conditions. "See into" is not specific, especially for enforcement, but with that I would assume that provided you can make out the shape of the center console with the window up, you should be good to go in court*. This doesn't mean the officer can't write you a ticket, it just means the officer will have to go to court and testify that he couldn't see into the vehicle. If you want to take it to court if/when you receive a citation or "fix it" ticket, you have the case law to substantiate that with Com. v. Brubaker.
