I watched a domestic violence documentary yesterday where the man recorded the abuses from his wife, who turned around and called the cops that the husband pointed a gun at her to kill her. The man was almost being led away by the cops and suddenly, he brought out the recording, which revealed that the woman was lying. And immediately the table turned around and the woman was led away in handcuffs. So, I believe it is legal to record a private conversation for your protection.

Recording is permitted in the western world and most countries and are used in the courts all the time. The lady is only talking about Nigerian laws where I think She is qualified. The Privacy law she quoted is very limited in most countries but I guess Nigeria is still using its archaic laws.

You can record, but you need to let the person know he or she is being recorded for that recording to be legal. Exception is if you're being threatened or your life is on the line. Here in the UK, if you have CCTV installed on your premises, there must be a sign warning people that there's CCTV in the building.

Lawful recording would mean that you informed the person that you will be recording the conversation and you will get the person’s consent in the recording before proceeding. But I don’t know if in Nigeria the law requires that the other party must be aware he or she is being recorded.

You're right bro. That lady lawyer got the major point wrong. Recording your conversation without your consent is not illegal as long as the recorder is part of the conversation, but publishing it to the public without consent is illegal. More so, recording without consent doesn't render the recording (evidence) inadmissible. You can establish a case based on it and you can tender the recording against the speaker in a case. Please find this out from lawyers that practise in Nigeria. The rule of thumb is that "where an evidence is derived from is irrelevant to the admissibility. What matters is its relevance."

There are some building inside the prison that has all facilities, you will think that person is in his/her home, this room has POP and well designed. I am a lawyer as well, with all due respect, this lady is applying legal principles wrongly, especially on the ex turpi causa non oritur. You don't just apply legal principles indiscriminately. There are exceptions and you can check the provisions of section 14 of the Evidence Act 2011 on illegally obtained evidence.

The law isn’t always an ass, especially its most likely won’t be in this case. The example the lawyer gave is different from the case at hand. Killing someone is illegal. Borrowing money and refusing to pay is different. There’s always an exception to the provisions of the law. The law provides for the recording without consent in cases relating to national or public interest and other justifiable reasons, in which case this case is within the scope of that exception. Also, the court may exercise its discretion in public interest and it does become law at that point. The guy said he was shown video of BR not being in prison,isn’t that a public risk. Isn’t allegation of public officials corruption a public safety issue. The law isn’t always rigid as we may want to assume. The court do make laws through precedents a.k.a ‘case laws’ In other words, what the lady lawyer said may be a valid argument for the plaintiff and the exception for the defendant, but the court is at liberty to decide the matter in the interest of the public to promote public confidence in the government institutions, otherwise there would be the breakdown of law and order.
