Checkpoints are unlawful as they are violations of human rights. Universal Declaration of Human Rights Article 9 "No one shall be subjected to arbitrary arrest, detention or exile." Article 12 "No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks." Article 13 1/ "Everyone has the right to freedom of movement and residence within the borders of each state." 2/ "Everyone has the right to leave any country, including his own, and to return to his country." That was a blatant unlawful detention, barking out unlawful orders, physically retriction his freedom of movement with spike strips, for no reason. What NO ONE realizes is that once the people stop they are free to go! The people are merely required to stop like at a stop sign. There is NO OBLIGATION to sit there otherwise you are voluntarily detaining ("seizure" under the 4th Amendment) yourself. This is what makes these "check points" constitutional. Quite sly of them isn't it?

So the dog was just another intimidation tactic And the useless , "are you a citizen" question is just a lame excuse to go fishing. Time to shut down these check points by overloading them with refuse-nics. 200 at a time, several times a week. Cod lock the whole highway until citizens get tired of it and demand and end to the checkpoints.

If that Agent was really a prick he could've had you snatched out and searched your car because technically his dog did alert. That's why you step out so there is no confusion about the alert. My man, never move to secondary. They cannot direct you to secondary (detain you) without probable cause, and you refusing to answer questions does not qualify as probable cause. Just repeatedly ask if you're free to go, if you're being detained, what reasonable articulable suspicion they have that you are committing a crime, may have committed a crime, or are about to commit a crime. The moment you move to secondary is when they'll start bullying you by setting up spike strips and running dogs.
@gslife12 жыл бұрын
Thanks for the great info. You are 100 percent right about not going to secondary 👌🏼
@harveywallbanger17382 жыл бұрын
Sorry, but our Supreme Court held that agents can refer people to secondary without probable cause. I think this decision is wrong. Here's where: U.S. vs Martinez-Fuerte: "(secondary) Referrals are made for the sole purpose of conducting a routine and limited inquiry into residence status that cannot feasibly be made of every motorist where the traffic is heavy." ... "'[A]ny further detention...must be based on consent or probable cause" I've been ordered to secondary a couple of times. I just read my book while the agents talk at my rolled-up windows... Then they tell me to go.

Because we don't like intrusive government. This country was set up so that the government would not be intrusive, because the English government that preceded was extremely intrusive. But since the founding of the country in 1776 we have seen an erosion of the freedoms that were established at that time. We have to resist the attempts by government to steal our rights. Power concedes nothing without a demand, so we must demand our rights. Or lose them.

@@gslife1 It most likely wasn't, it's one the lies they use to try and fabricate PC. To make it perfect, next time start with: "I am invoking my Fifth Amendment Privilege and will not be answering questions without my lawyer present. I am invoking my Fourth Amendment privilege and do not consent to any searches of my person or property." That magic phrase and they're fucked. THEN answer everything with "I don't answer questions." They can still run the dog around the exterior, like we see here the NKVD Agent did it 3 times desperate for a hit. REMEMBER: State police, Sheriffs and local cops will have their dogs "alert" falsely, they'll claim they alerted just to get PC for a search. They are despicable, lying sacks of shit each and every Law Enforcement Officer in America, without exception. Always best when dealing with Law Enforcement thugs to cover all y'all's bases. When you make that declarative statement your silence and unwillingness to answer questions cannot be used against you in any way. Sadly, some boot licking courts have allowed refusal to answer questions be used as PC for arrest and search.
