That’s actually incorrect about a few things. You don’t need to trademark your business name when you first start out. An LLC is for registration of your business and has nothing to do with a trademark. No state will allow 2 companies in the same class to have the same name so when you register your LLC with your state - if no other company has that name then you will be the only company in the state with that name. No trademark needed. Also if you choose a name that someone else in another state has and they used it first but you trademark it now - they can argue “first use” and keep using their name. Also the majority of candle fragrance manufacturers allow you to freely use their name of the fragrance. Candle science, wholesale supplies plus, wooden wick and many others allow it. Though I do think it’s a good idea to name your scents differently from the manufacturer.

As far as an EIN and starting a website, should you wait until you’re past the testing phase and have sold a certain number of candles? I got my LLC , EIN, and Dunn& Bradstreet and I hadn’t made my first candle. When I knew that making candles would be my business I took care of that right away.

you need an EIN before selling. you have to pay taxes on any money you make.

Oh that’s a very good point. If Zyro doesn’t connect with Pirate Ship then they’re a no go for me because Pirate Ship is the cheapest and best way to ship heavier items such as candles.

Thank you for sharing all the information. I didn’t know about the trademark. I was told by my county not to do a “doing business as” because someone can take my name, but better to do LLC, which I did. I need to look into trademarking. Also, I was going to go with Shopify with my Domain, but I decided on Etsy for now. But it seem Shopify still have my domain listed even as I cancelled. How can I make sure they do t have it?

LLC is best because it will protect you from lawsuits. They’re easy to do, usually takes about 15 minutes online with your Secretary of State. Trademarks are complicated and not necessary unless you’re 100% set on your name and logo. You can’t make changes to an existing trademark. If you changed your mind you would need to file a new trademark. They’re not cheap and the process is complicated. Also if you mess up and your application I rejected you don’t get your money back.
