BREAKING: Judge Mary Marlowe Sommer dismissed the 'Rust' movie shooting case with prejudice against Alec Baldwin. When Baldwin heard her ruling, he started to sob and later hugged his family. Baldwin was accused of negligence in the death of cinematographer Halyna Hutchins, who was killed on the set of "Rust" in 2021.

You know what makes me mad? How many times did this prosecutor and others around the country commit Brady violations against other defendants that were never caught due to the defendants inability to pay for skilled counsel?

This was the only time we needed the prosecution to get a case overthrown like this. It has nothing to do with past track record. This was an incredibly unselfish act.

No the prosecution hiding evidence kept him out of prison. This evidence most likely would not have changed AB case as he was not accused of bringing the ammo in. So he got off strictly because the prosecution messed up so badly. Not that I was rooting for him to lose, I think on his part it was a truly awful accident.

All we have is their word that that didn't happen, but they literally just proved themselves to be untrustworthy with their word, so that "promise" has 0 value.

Screwing up is to make a mistake. She made deliberate choices and I would suggest that her comfort in making those choices are due to getting away with it in the past. Yes, the judge really made the right call. I like her; she's a smart, no nonsense person who doesn't put up with crap.

The judge is a hero in this sad case … you would be surprised how many judges do NOT make an examination of prior procedure before judgement is made. I know I’m correct because she made damn sure citing each case for her determination of judgment and then added with prejudice….. ie she knew the prosecution was completely unethical in this case.

It wasn't even exculpatory as you said. How live rounds got on the set had nothing to do with negligence, pointing a gun at someone and pulling the trigger. WOW! The media AND judge are gaslighting this calling it IMPORTANT evidence to the defense. NO it isn't.

The person/s in charge of the props should be charged....it is their own responsibility to make sure that any prop weapons have blanks and not live rounds.

I haven't followed the trial, but did a quick google on the prosecutor and she has made a series of missteps and downright nastiness in her recent years so that she has been dead centre on the radar. Someone in her position should know how to act with the utmost professionalism and yet she has bad mouthed Baldwin on a personal level, publicly. I neither like him or dislike him, although I have seen that he is like many actors, struggling with failure to launch syndrome, but for someone in her role to call him a C**k sucker in public is an appalling lack of decorum and says more about her than him.

The show Suits comes to mind where the paralegal will spend days combing through evidence to find something like this, so I'm wanting to know if it was a paralegal or a junior associate or who. @@amyb347 I have never watched suits, I stopped watching tv years ago, but every lawyer in a courtroom has a team behind him doing the work. Paras don't work days, they work months and in some cases they work years on a case. That core team are the Address of Service, they maintain the documents, the evidence, they manage all communications incoming and outgoing and are responsible for the communications that comes from the courts and the judge, and the other side. They know it all intimately. In fact, the people working on that team, all their names are at the other end too so the court knows who it went to, who is responsible. It's a massive job and on a big case, it cannot be just one person. The research part of the team ensures all they discover goes to them, and again...more than one person. These high level lawyers pull in very large hourly rate, and people think they are being paid too much, but out of that rate they pay their team. At some point, the records will be made public and be discussed. Cases are used in law school as teaching material as well, so, everything will be there.

The defense themselves knew it wasn’t favorable to them, it was just the fact that it was withheld that caused the case to be thrown out. That ammo box may have been where the live round came from, but there is no true way of finding that out. Those rounds were mixed and transported to so many different places since the 1883 set. It was no way favorable to the defence where the round came from. Their goal was to prove he wasn’t criminally negligent with the firearm.

That man is broken. I genuinely feel bad for him, and if you told me years ago that I'd ever feel bad for Alec Baldwin, I would've laughed in your face. Obviously Halyna is the biggest victim given she lost her life from a freak accident, but I cant imagine the trauma of being the one who pulled the trigger without even imagine something like that could happen. I genuinely hope he's in therapy, especially after being dragged into court wrongfully like this.

​@@TempoMontagesWhen you're a convicted felon you can't even be in possession of a functional firearm even one loaded with blanks. Mark Wahlberg, prime example. He tried even getting it the restriction lifted but he couldn't. My point is, even if an armorer on a Hollywood movie set hands you a "prop gun" it's still considered by law to be a firearm. Alec wasn't found not guilty, it was prosecutor misconduct that got the case dismissed. Obviously you've missed that point.

I agree and I don't think it should be the actors job to know which bullet is fake and real and specially when they have hired an armourer to do that job. Sure I would have liked to know better what exactly happened but I feel for him even if he was the one who happened to shoot Halayna, I'm sure he must have wondered lot what he could have done differently. Makes my angry what a mess this trial became, I can't imagine how hard it must have been for Halayna's family.

But you have misunderstood not only what a producer likely does, by why someone like Alec would be a producer on a film and that there may be other producers. Like the original comment said, he was there as an actor when the accident happened. I'm also curious where you made up this rule that the director(or even producer) would be responsible for everything that happens on set, that's strange.

@@ianmilleris In the U.S. there are basic gun safety practices, with the overall theme that once it is in your hands, everything that happens with that firearm is on you. As a result, one of those safe practices is that you personally verify that a gun is safe and clear when you take possession of it, regardless of what someone else says, or if it's someone else's job etc. This is a very basic, foundational safety practice. The fact that he didn't do this, even when he was about to other dangerous things with the gun as part of the scene, like aim it at someone, screams extreme negligence in my mind.

Prosecutors lie in every case. He could afford a team of lawyers who devote all of their time to his defense. The majority are imprisoned based on prosecutorial conduct.

It was VERY suspicious the way it happened. If people were paying attention, actors are known to be corrupt and have dark secrets. They live in that world. Look at Brandon Lee and Bruce Lee for example.....and many others who died under VERY suspicious circumstances under UNBELIEVABLE odds. How many "accidental" bullets out of ALL the MILLIONS of movies made all around the world, have actually KILLED PEOPLE? Only the ones in this country through the years, with shady people involved, like Alec. Pretty clear that he is a shady person, and his soul is probably not even his own at this point. I absolutely disagree with Baldwin's political points of view, and never cared to much for his acting career. But i strongly agree with the judge dismissing this case. It's a tragic thing that happened, but charging a person for what was clearly an accident, and trying to go about in the way this prosecutor did. Would have definitely been a miscarriage of justice! You made the right call Judge. May Haylena Hutchins rest in peace, and prayers for her family to find peace as well.

There would be no nurses and doctors, they'd ALL (100%) be in prison - although, there are quite a few that SHOULD be in prison, to be honest. People are imperfect, we can't imprison them each time they screw up. I am not claiming I know where to draw that line in every case between criminal and civil, but I don't think either of these cases should have gone to criminal trial.

Alec insisted on using a fully functional (prop) gun. The firearms safety rules are there for a reason, reasons bought & paid for in blood. Even in the military those rules apply to everyone when handling a firearm.

I’m glad the case was dismissed. He should not have been accused of a crime, since he didn’t know that there was live ammo in the gun. The person in charge if the gun and ammunition is guilty. This is akin as trying to accuse a driver whose new car’s brakes didn’t work and hit someone. Yes, the driver was moving towards the victim, but the maker of the vehicle is the guilty one, not the driver.

He wasn't charged with knowing there was live ammo. That would be a murder charge. He was charged with aiming a gun at a person, cocking it, and pulling the trigger. This, with knowledge that it was a real gun (prop guns are usually real guns) he knew live ammo was on set, he knew that gun was used for target practice, he knew what he was doing violated all gun safety and film industry rules on handling firearms. He was charged with aiming, cocking, and discharging a live firearm that he believed was loaded with blanks, but he also knew could be loaded with real ammo, which was against film industry safety because that has killed people on set. All of that was proven. That's the law. That is manslaughter.

@@DLC-sy7pp It’s called a misfire. There had already been two misfires on location in the couple of days previous to the accident. They were using old vintage firearms and the armourer clearly didn’t know how to handle them properly, or it’s possible that they rented faulty ones. Those guns that misfired had blanks in them but, for some odd reason, the one handed to Alec Baldwin had several live rounds. The whole thing is really suspicious. Full disclosure: I was once had to use a vintage firearm in a play. I was supposed to shoot at another actor standing at the opposite end of the stage (safe distance). One night, before going on stage for the murder scene, I set it down on the dressing room chair next to mine and it suddenly went off. The blank blew out and lodged into a costume. I was very relieved that there wasn’t another actor nearby, because it could’ve injured them terribly. That was a misfire. Unfortunately, the propmaster was nowhere to be found, and I had to go on stage with an empty gun, and it only made a “click” when I shot the bad guy. I didn’t have time to tell him either. He stared at me wondering when I was going to shoot him, but quickly figured out what had happened and dropped to the ground like he was dead. So embarrassing and anticlimactic. It was all I could do to keep from cracking up. 😅

Ultimately, however, that is also the responsibility of the armourer - to control everything related to weapons on set. As for her hiring, that would’ve been done by the production company overseeing the filming, Thomasville Pictures. She might not have seemed like an incompetent hire, given that her father is a renowned, highly experienced, armourer himself. So maybe they were just bamboozled into thinking that she would be great? However, the film crew and staff were extremely upset with how they were running the production, and Alec Baldwin was actually siding with the crew in these disputes. Baldwin, like the other funding producers, were not running day-to-day operations. That was the job of the production company and the line producer. I don’t know all the exact details but deadline Hollywood had numerous articles about how this all played out, much of it way over my head. I read a comment from someone in the New York Times, who sounded like they were experienced with the finance end of how these productions work, and they referred to an article in deadline Hollywood that detailed that the production company was possibly “short sheeting” the film. So maybe they were cutting costs and corners because they would be allowed to keep what they didn’t spend? In which case, maybe they did hire her just to save money. There were also rumors that some people working on the film were doing target practice nearby as recreation when not filming. If true, that seems to be the most likely route for the live ammo to end up on set. In other words, the armourer ran a sloppy ship.

Multiple witnesses heard the armorer declare that the gun was safe. Most of what the prosecution wanted to prove was what Baldwin should've known and what he should've done, not what he definitely knew. I mean, people have common knowledge about guns or gun safety, but that doesn't make them experts or know how to assemble or disassemble weapons or know which bullets go into which guns. It's a real tragedy that occurred, and it's also a real tragedy that to this day and time, prosecutors are still hiding evidence to throw people in jail.

Wasn't real evidence. It's like saying that withholding your shoe size is withholding evidence, when shoes have nothing to do with it. The ammo didn't fit the gun, so it didn't fit the case. They could only have been blanks or live ammo, for that gun or other guns. They already proved and knew that live ammo was on set.

@@logangodofcandy the point is the defense was still supposed to see the ammo so they could test them. The prosecutor though dint give the defense the ammo so the judge therefore had to throw the case out. So all have to blame the prosecutor for hiding ammo from the defense

That's not hyperbole. He was at odds with be person he shot, and is famous for being an angry psycho. He also had a gun he knew was real in a set that had live ammo, which he had access to. What he did is no less than manslaughter, which is usually about 5 years. The manslaughter was proven.

Because its a fundamental rule of using a firearm. Checking any weapon handed to you, regardless of the person who gave it to you, is universally taught, by every school, every police force, every military. There are no exceptions, ever.

The evidence could have pointed to sabatage on set. The defense had a right to use that line of reasoning in their case, but couldn't because the evidence was withheld.

An exculpation is an excuse in law. The rounds were brought to set without his knowledge, if indeed they were the exact same rounds. That's his exculpation; he did not know and had no reason to believe the gun he was handed was loaded with live rounds.

Doesn't matter. He knew it was a real gun and that live ammo was on set. He knew all the gun safety rule and the film industry gun safety rules. He KNOWINGLY and with intent violated EVERY rule that he knows has led to accidental deaths before. He is a gun control nut. What he did was textbook manslaughter. He knew the gun was real and live ammo was on set to use the gun for target practice. He knew that pointing guns at people is dangerous and NEVER allowed on set. They position cameras to make it look like you're aiming at a person in movies. Only a person that knows NOTHING about guns thinks he's innocent.

Didn't they even say that there was several people that were in charge of the stunt weapons? I remember reading an article that a couple of the stunt guns had been swapped out at the last second. And I just hate to see someone who was innocent have to go through this trauma, and then also someone died because of it. It's just really sad
