Favre withdrew it, meaning he "dismissed" it himself, because he decided to SETTLE for an apology/explanation from McAfee. If McAfee had agreed to pay money to Favre WITHOUT going to court, Favre would still have withdrawn the court case if he agreed to the sum offered by McAfee. But to use the word "dismissed" really generally means that a JUDGE dismissed it, which didn't happen here. So, "dropped because settled" would be a good way to think of this.

Good question. As of yesterday when I last checked, Favre had not yet voluntarily dismissed his lawsuit against McAfee. He can actually do so without needing a court order under Fed. R. Civ. P. 41. I expect that Favre will file a "Notice of Voluntary Dismissal" pursuant to his settlement agreement in the coming days if he has not already done so.
