@@Irish_1916 they were not suggesting that at all. Fowler in his testimony said he floyd could possibly have had higher levels of CO because of his positioning. They asked him if he thinks it contributed to the death and he said no. But at that moment there was no known record to the court of his levels. The new evidence said he had 1.5% carbon monoxide. Which would be at the normal range. What the judge blocked was questioning tobin using this evidence during tobin's rebuttle.

It seems unlikely and nonsensical, but the constitutional job of the defense is to find any way to sow doubt in the minds of the jury, doubt that it was Derek’s knee that caused death. Because in the end, to find Derek guilty, should be beyond a reasonable doubt. I can’t imagine the jury will buy the carbon monoxide argument though, but the defense is just doing their job. And this is a good thing and why America has one of the best legal systems because someday you or I might need a defense like this.

This atypical case [11] is notable in that it exemplifies the truth that fatal exposure to vehicle exhaust is not always associated with COHb 50 %; rarely, it can be considerably lower. The case also highlights one of the contentious issues surrounding the use of CO-oximetry postmortem, namely the potential for MetHb interference in COHb measurement. A 28-year-old man was found dead in his car many hours after going missing. Suicidal intent was assumed by the finding of a garden hose taped to the exhaust pipe that had delivered exhaust fumes into the cab of the closed vehicle. At autopsy 5.5 days later blood was sampled for COHb measurement by CO-oximetry to confirm carbon monoxide poisoning. The CO-oximeter used (IL 682) measures at six wavelengths. Results of this initial testing revealed that COHb was, surprisingly, not increased (0.6 %), but MetHb was severely increased (56.3 %). O2Hb and HHb were 12.2 % and 30.9 % respectively, and total hemoglobin was within normal healthy limits (13.8 g/dL). It is routine practice at the laboratory where this analysis was done to repeat COHb measurement in cases of potential carbon monoxide poisoning - using a different technique - if CO-oximetry reveals MetHb 30 %. This practice is based on the assumption that increased levels of MetHb can cause falsely low COHb CO-oximetry values. On confirmatory testing using a reference gas chromatography assay, it was established that the “true” COHb value was 18.6 %, much higher than the CO-oximetry result - confirming carbon monoxide intoxication - but not sufficiently high to conclude that carbon monoxide poisoning was the sole cause of death. After further laboratory testing, which included confirming the high MetHb by a spectrophotometric assay, the authors of this report concluded that death was due to hypoxia consequent on a combination of carbon monoxide intoxication and acquired severe methemoglobinemia. In support of this conclusion the authors postulate that the mechanism of severe methemoglobinemia in this case was inhalation of nitrogen oxides, known to be present in exhaust fumes.

Floyd had an oxygen saturation of 98%. That is normal. Mine runs 94-95% when they check it. The carboxyhemoglobin level is also normal for a smoker. Once it attaches to the hemoglobin it stays there, so there probably was no carbon monoxide poisoning.

That's not why they didn't order carbon monoxide levels. They didn't think it was relevant because there was no reason to believe Mr. Floyd had been exposed to carbon monoxide. We would order such tests if a patient was brought in after being found in a running car in an enclosed area, or in a house when there were no other obvious causes for their low level of consciousness. Mr. Floyd's whereabouts were known prior to being brought in via ambulance. Carbon monoxide poisoning, as a cause of his presenting condition, wasn't even on the radar. If we had nothing to point to that would explain why he died, we'd start looking at causes outside the box, but there were likely causes known at the time of arrival so those causes were investigated.

Yes, because he has ruled that allowing that evidence at this late stage would unfairly disadvantage the defence. The accused has the right to put forward a defense that fits the evidence the prosecution has disclosed. The prosecution were told to gather this evidence (Floyd's blood carbon monoxide level results) back in February and failed to do so. They were very sloppy here and only have themselves to blame.

The CO level in GF would be irrelevant. He was breathing the same air the officers were breathing , and none of them had CO poisoning. SO there's no way CO played a part in this whatsoever. Someone is grasping at straws. If there were enough exhaust fumes to harm GF , there would have been enough to harm the police officers , since they were all breathing the same air. This is nothing more than a poorly thrown together case in which the prosecutor initially saw it as a slam dunk then realized late in the game that things were not as they seemed.

The knee didn't cut off his air supply. The knee would have had to be on the trachea. It was on the carotid artery. @@iLLMATIKedits I've had a water trails from the a/c unit on my car half a hour and more after its turned off, anyhow it's at the front of any vehicle not the back. And the only way you could get that carbon monoxide is the have your face shoved up the exhaust pipe or run a hose of it but any car made in the past 25 years + has a catalytic converter to filter stuff like carbon monoxide so if anyone wants to commit suicide by sitting In a running car for half an hour with a hosepipe up the exhaust they'll die of suffocation not carbon monoxide poisoning unless they've got a old car even then it's more than likely still suffocation. The only form of death by carbon monoxide now a days is from a gas leak or open fire with a blocked chimney.

It's actually smart. There is no single defense. The job of Derek's lawyer is to give the jury multiple ways ( no matter how far fetched) that George could've died. remember the burden of guilt is on the state and they need to prove it without a reasonable doubt. All the defense needs to do is make 1 person in the jury start to question how he really died to hang the jury.

I do understand that the "new" evidence was always there but not brought to evidence due to not seeming relevant. I also understand that revealing this now that its relevant due to an insinuation that Carbon Monoxide poison could have possibly contributed to the death and I see no problem with it as long as the defense is given ample time to examine and respond. Can not have one sided evidence on either side.

I have COPD and when they check my oxygen level. Mine is 97 and 98. They have always told me that is good. I worked in a Dealership as Assistant Service Manager and I had Monoxide Poisoning because I worked in an office off from the garage with 2 small windows where the mechanics could pass their paper work. When you get this poisoning you are very ill, vomiting, headaches, stomach aches. Adjustments were made when I returned to work the next day. It was winter and the car's were hooked up to hoses and put through a hole in the garage door. Some of the mechanics were lazy and did not put the hose through the door before starting the car. I breathed this for 8 hours that day. Now if this happened the officer would also have the poisoning. I do not believe with his oxygen level being 98 did not affect his death. Just my opinion.

Youre also not right where the exhaust is coming out either. Or with a knee on your neck. Probabpy wouldnt take much when youre getting choked out next to the vehicles exhaust. Just my opinion. You should try that tho and let us know the difference from being in a shop and basically breathing through a tube with exhaust straight up in your face

I train with chokes at least 3 times a week on people different sizes ans shapes. I apply them and i have them applied to me. That being said its stunning how there is a video of a man being choked out to the point of death and there is still a debate weather he was murdered or not. Everyone in my dojo allowed there hands to be tied behind there back lay on belly and knee to base of neck and EVERYONE had compromised breathing. Ya let me apply the knee pressure to crowder bet he doesn’t last long if the pressure is real. And when dealing with cops in the street the pressure will be real

Respiratory Therapist here. An ABG (Arterial Blood Gas) is the only 100% way that you can get the correct O2 sats. The doctor was talking about using an O2 sat test by monitor; i.e. finger, toe, ear. So he cannot argue that it could be wrong. This needs to be brought to the attention of the jury.

Not necessarily. Floyd forced himself and the officers down. ( I am going down.) That was were they just happen to end up. With the struggle Floyd was giving them by just trying to get him in the vehicle there was no way for them to keep trying. Not true. All regular oximeters measure how saturated your hemoglobin. Carbon monoxide (CO) combines with hemoglobin 200 times stronger than oxygen (O2). You need a special oximeter to differentiate whether the hemoglobin is combined with CO rather than O2. Since it is within normal range for a non-smoker (1.5%) it really is meaningless.

because the defense's witness was alluding to the notion that george floyd's face was close to the exhaust of the police car. so his lack of oxygen could have been cause by that, along with his anxiety and stress, and his supposed enlarged heart. rather than derek chauvin being on his neck. so theyre trying to put doubt in the jurors mind that chauvin contributed enough to the death and that it was other factors. the prosecution is trying to rebuttal and say that his carbon monoxide levels were normal so the defense's point is invalid

You forget that there was concern of that reading being a false positive by the nature of how carbon monoxide works. It was explained that cm attaches to co as it enters the body. So with the equipment they used for testing would not pick that up. That is why they want the actual test equipment to be used. The request for that was done back in February. The judge didn't make the claim that the state was willfully hiding evidence but he wasn't too happy about it.

This seems over complicated. Have a man of his weight kneel on his neck while handcuffed for the same amount of time. If he dies, he was guilty. If he lives, he's free to go.

@@barnhousedesignspa9251 the defense blocked the blood gas levels from being discussed during the ER doctors testimony. Then, the defense called Dr. Fowler up to testify and he mentioned blood gas levels. The defense cracked the door open. So the prosecution now has a right to call their expert back up and use this blood gas level tests. This definitely hurt the defense!

If Mr. Floyd’s blood oxygen was 98%, he clearly COULD breathe. Therefore he was asphyxiated by a knee on the neck. I haven’t been able to watch the case, so what are they claiming actual cause of death to be?

If Floyd's pulse oximetry was 98% but the brain was deprived of oxygen by a knee to the neck, then the brain will die and the rest of the body dies.

The defense witness brought up the carbon monoxide theory. I thought the prosecutor could refute it in rebuttal. The defense opened that door.

You don't get to bring new information into the case the way they did. They had ample opportunity to submit evidence and were told specifically not to bring it up in front of the jury.

Unfortunately, the defense lawyer did not realize that 98% oxygen saturation of Mr. Floyd refuted the assumption that he died of asphyxiation by the knee. The judge should have declared mistrial for the late disclosure of the crucial information.

Its part of a compunding issue - heart issues, fentanyl in his system, weight on the back/neck area, brething in carbon monoxide all contributed to his death .... honestly, the fentanyl was enough alone

@@shanes6382 sorry not sorry but the fentanyl wasn't enough on its own if you'd of been following the trial you'd know that the toxicologist, the we doctor and the paramedics along with the pulmonologist and other experts. Have repeatedly stated that if fentanyl was an issue he wouldn't have been struggling like he did and he most likely wouldn't of been conscious when the police approached him... If any of you knew how powerful a drug fentanyl was you wouldn't even during it up. Literally a grain of that stuff can make you od.

It's literally the prosecutions job to say he's guilty. The judge has consistently ruled in the defenses favor. From throwing out 3rd degree. Yelling at the emt, and so on.

Judge is extremely biased in favour of the defense throughout. Surprised he wasn't brazen enough to acquit. They all belong to the same brotherhood, I'm sure.
