You need to learn the law. The landowners authority means employees CAN physically remove someone from a PRIVATE shopping mall. It’s private property… NO legal right to film in there. It’s not a crime, or illegal to do so, but they can remove someone for filming.

On private property you DONT have ‘rights’ (legal rights, your human and basic rights remain) You don’t even have the ‘right’ to even “be” on someone else’s property, unless you reside there. Filming on private property whilst not a crime can be prevented. Any auditor that thinks they have “rights” because it ‘has public access’ is simply deluded. The landowner has the legal right to tell someone to stop filming. Then they can tell them to leave the property. If that doesn’t happen, they have the right to physically remove them as a trespasser.

It’s private land with implied rights of access and the owner makes the rules and can withdraw the implication of right of access at any time. It’s not a police matter though.

@@MrAndrewFarrow You're correct, it's not a police matter that he was filming. They couldn't care less. They DO care about threats of physical violence, which is what they were there for. Once they realized that the threats were non-existent, or that the alleged victims refused to press charges, they were ready to head out. Brendan's arguing with them about the filming issue kept them there longer than they wanted to be there, obviously. Maybe Brendan should stop with the lame "don't you have anything better to do than harass me?" crap and realize that they do have better things to do, but he's sitting there wasting their time, arguing about nonsense that he can take up with the mall security office.

It's the public that's there. The building is privately owned sure, but the people that are there ARE the public. Fair use has to be thing even in the UK I would think? Every part of Britain is owned by someone or some organisation, quite often by the Crown or local councils, even the pavement in a street is owned, so by your definition that places that are owned aren't public that would make it illegal to take any photos anywhere, and walking down the street would be trespass.

Not only is she so narcissistic that she thinks she rules the mall, she is also too stupid to realize her own actions ensured her and her unruly kid being immortalized on the web. Nice Job Mom. I wonder if she told the cops that spoke to her to turn off their BWCs. I hope the cops educated her and the mall staff on the right to peacefully film in public spaces and if there is something like a FOIA request process in Britain please request and post the footage of Karen's police interaction in hopes she can be shamed some more. Sadly though, you are probably right, the mall will remove the piano because heaven forbid there will be a few people that complain rather than having it there for the enjoyment of the rest of us.

actually it is, by entering a private establishment, you are implicitly agreeing to follow the policies set forth and if you don't, you are free to leave or be guilty of tresspassing and possibly disturbing the peace any private facility has the right to refuse service, up to and including, admission to the property as long as their policy does not violate the law

You have no rights to do as you please on private premises even if they are open to public. You are subject to their rules. Otherwise they can evict you as a trespasser. Not a police matter though.

The biggest problem I have it that the mall KNOWS Brendan, they KNOW he plays the piano and KNOWS he films it. You can't say one moment you can film, then the next day you can't film. And yet how many film him while playing?

Playing the piano in public and filming it wasn't the issue, Brendan went on and on about the law. If a private owned shopping mal doesn't want ptoplt filming, then respect that! Move on! They are allowed to play the piano and film him! It's the crazy lady that has a problem! I don't understand Brendan at all, to go on and on about it! It is what it is, it's their policy and sccept and move on! But you are allowed to play and getting filmed. So what's Brendan's problem? Just making a fuss because of the video?!

I cannot believe the poor quality of our police force. How have we gone from the best in the world to one of the most incompetent. A woman has made a false complaint, wasting police time, and they argue they have no jurisdiction inside a public building. A few months ago police arrested a 14 yr old autistic girl in her private home for an innocent comment about her grandmothers look alike, but here a pianist is legally playing in a public space is threatened and they cannot do anything? Why are we paying them, to walk around in twos and threes, but when asked to do something sensible, they side with the trouble makers.

In A private building that is open for business IE Shopping Mall, the landlord/owner indeed has rights to include a policy like it or Not- most don't make a fuss, here's the thing tho- if things go sideways then the management Will! Think about it, its not that hard . !

@@paulbrutAgreed, sort of. Whilst it's true that there is no expectation of privacy in a public space and this is a public space, this space is also privately owned. It's open to the public but still private property. As the building owner/occupier, they are perfectly entitled to refuse entry or eject anyone from that property at any time. So, in order to appear reasonable, they produce a policy or guide to expectation for anyone on their property. You then have a choice to either accept those conditions or leave. If you contravene their conditions, you may be asked to leave or the police may be asked to assist them to eject you. However, there is also a commercial consideration, if you start ejecting people for petty contravention, you'll very soon have an empty shopping centre! To my mind, what should have been said to that woman by both security and plod was STFU or please leave. Similar to Brendan, we'd like you to play on but don't film or please leave. Simple.
