The reason why the judge has to ask the same question is he must get a yes or no response so that the defendant can’t claim his constitutional rights were violated.

I don't see why people don't understand that if you treat the judge with kindness and the highest level of respect you might actually get a better sentence, so you could go from 8 years in prison to only 2 but people apparently think 8 isn't enough.

I ironically think the same thing when I watch NBA games and a player is mad at a call. Instead of moving on because there is nothing you can do to reverse that call, they scream at the ref and end up getting in more trouble by getting dealt a technical foul or thrown out the game. lol

Contempt of Court is a serious charge in some states. There was a case where a convict refused to obey the judge, and the judge sentenced to the maximum under the law for each contempt charge. There were two charges in all and each charge carried a maximum penalty of two years in prison. So the judge handed down a sentence of 2 years on each charge to run consecutively which means the prisoner has to serve a full 2 years on the first charge before the second sentence can begin. Yes, the guy got 4 years for pissing off the wrong judge.

i worked in a juvenile “prison” and a kid only had like 9-10 months left before he was released… he TRIED to escape.. and because he was then over 18 he got 5 years in prison 😂 the escape clip reminded me of it…

We have a small town here where the cops and chief are so corrupt that the traffic court judge tells them to hush and she has the ticketed person speak instead.. this police dept was so corrupt that it was THAT bad that she expected the cops to lie. (The chief finally had his certification pulled so he can't be a cop in the state of FL ever again.. after years of this crap.. they finally got him on a simple charge of lying about an on line test he said he took that would get him an increase in pay.. he himself never took it).

The last dude had already be taken to court by the lady to make him quit bothering her. He didn’t stop so now he is back in court. Two times she took him to court to make him stop and he still looks at her and says you tell me to stop. Judge should have stuck to the year but was afraid it would get overturned as too harsh. The 93 days will stick only because the dude caused a ruckus.

Kabir, this is a controversial case with the man who was exonerated (found innocent). The defendant was finally found not guilty I believe based on new information; I believe also he may have gotten help from a special group in the United States called the Innocence Project.

There is a transcript made of every criminal proceeding in the event a matter is appealed to a higher court. The transcript is always part of the record on appeal. It sounds repetitive and inane in the live setting but it's important in an appeal to have a transcript that reads like coherent dialogue. Question; Answer. As for that judge who went out in the hallway to duke it out with the public defender, there must have been some history there that we don't know and still that judge should have been censured. Totally inappropriate and unprofessional. The public defender, from what I saw, was just preserving the defendant's right to a speedy trial. If that is waived, a trial that must take place within 90 days by statute, for example, can take months depending on the court's calendar. It was an aggressive position to take, since professional courtesy usually dictates that you waive that right, but he was in his legal right not to waive it.

Ope and now on the stalker dude.... He appreciate how serious the judge took this. People who stalk others like that, are ill. Too many of them end in serious violence and death. The stalker was breaking the order of protection (ex parte) RIGHT in front of the judge too! If its a full order of protection with no contact order, he isn't supposed to talk directly to her in the courtroom! I mean, unless the Judge says he can. When I went through my stalking debacle for 2 years, the police did take it serious but no matter how many times he violated, the court didn't ever give him more than a few days. Maybe a week or so but would let him out early due to overcrowding. And he most certainly didn't get punished for each violation. It's such a wild story and I'm glad that I had a safe place to live with our infant son. The police would patrol my street and a lot of times when they would go to park somewhere, they'd park by my house to watch for him instead of going to a gas station or parking lot, where they usually park to chill or whatever they do. Lol I'm grateful for them and happy that the worst & most dangerous parts of it finally stopped and the rest of it, (that was more annoying than anything) eventually slowed to no communication at all. Thank goodness and thank those amazing officers, as well as the victim advocate with the police, who worked with me before, during and after this situation. She helped me stay safe going forward by getting me into a program with the, (my) State that would basically make all of my public info, private. My address would not even be used on my utility bills, since those and all the rest of my mail went to a specific PO Box they set up for me. My mail got filtered through the PO Box by the State and forwarded to my actual address, by them. They also put safety alerts on accounts that they could and provided documentation to give to whomever I needed to. It was something I think all states should have, if they don't already. This was over 10 years ago when it started so, things have likely changed. Hopefully for the better! (Lordie. I clearly had a lot to say today. What a surprise. 🙄🤷♀️😂)

First clip that guy who was in jail for 25 years for no reason (not guilty) should get a full compensation. (compensation = earning money as you were supposed to while you're free X 25 years is a huge back pay, That the way it should be)

Mental illness is not an easy problem to handle. Usually if gets to court a judge must order a 10 day psych evaluation as per procedure in most states. The person is then sent into a hospital for that 10 days under guard or a prison facility. If found mentally incapable of understanding their actions or the actions of the court they are then considered mentally incompetent to stand trial and are involuntary committed to a mental hospital until they are able to understand their actions. A few kids were sent to hospitals like that and eventually stood trial at age 18. Usually they are found somewhat guilty but under strange circumstances so they are placed on house arrest with electronic monitoring and ordered to attend weekly therapy sessions. Over time they get better and the monitoring is slowly taken away and the therapy goes to monthly then 3 months then once a year. It’s just how we handle these cases.

It was always supposed to be innocent until proven guilty , but lately a lot of verdicts have been overturned for wrongful conviction. We have an organization called the innocence project and it is really working hard to fix these cases.

If I were a judge and some monster was smiling and smirking while the victim's loved ones read victim impact statement, I'd give them the most severe punishment allowed by law . The maximum years , life without parole. Period. Some people are just so stupid and obnoxious like the guy who threatened the judge's life. He probably lost his kids for a reason. I can't feel bad for these defendants. They put themselves in that position.

I guess I can understand the purpose of the victim's impact statement if you are dealing with a criminal that, in any way, hurt a few people but I see no logic in giving a victim's impact statement when you are dealing with a brutal murderer and/or a serial killer. If they are evil enough to take someone's life, I highly doubt that they care about you and what you have say to them.

25 to life is the penalty for being found guilty of murder in the 1st (premeditated or such a way that is so evil) or 2nd degree (not knowing the person but doing it anyway).
