to be fair, when PayPal restricts your account for scamming ppl (assuming ppl reported her), it's nearly impossible to do anything including reset your password. Cam, in the US criminal law prosecutes crimes and civil law prosecutes torts. Crimes can get you sent to jail, torts can result in damages which are fines you have to pay to those harmed. This is not a class action as there is no class of plaintiffs, just the state attorney general representing Texas.

In re her attorney claiming no master list of clients-If her goal from the beginning was to offer personalized coaching, meal plans and fitness routines, wouldn't a master list of people be the literal only way to keep everyone and everything straight? Wouldn't it be the only way to track progress and changing client needs? In her apology video, she stated that she was basically a one woman operation, that it was just her doing everything and too many people were signing up for her to keep up with. It sounds like she never had a master list of clients and never cultivated personal relationships in order to actually personalize anything, which leads me to believe this was a scam from the beginning. How are you going to basically be a personal trainer/nutritionist and not keep some kind of system that tracks your clients? Something that you can look at and refresh your memory about every individual?

Furthermore, without a master list how does she pay her taxes? How does she track the cost of her write-offs (cost of Internet for the year, software programs, etc.)? How does she know how much money she brings in annually? How does she look at data to determine whether she needs to raise her prices or not? Maybe she is putting in a lot more time than she expected into the personalization aspect and thus would need to charge accordingly. Perhaps internet costs or her cell phone bill went up so she would need to factor in the added costs to her. How would she know if someone that requested a refund was ever an actual paid client or not? Did she have a strict no refunds policy? If not, how does she know she is refunding the appropriate amount of money, why she is refunding it, making sure she no longer provides that client services and is able to track the loss on taxes? I am guessing she probably doesn't pay taxes, if so, they cannot be filed accurately if she doesn't keep records. If she does keep them, she is obviously lying about the lack of master list. If she isn't lying, then this whole thing is even worse than I thought. In my opinion, everything BD touches is a scam. I mean, if we are to believe her and her attorney, she didn't even attempt to protect her own interests in her own business! I have so many questions!

Clarification on the paypal issue: it sounds like maybe her account was locked due to fraud. Like her account was shut down by paypal. I don't think it was a "forgot password" issue. ETA: It really sounds like her lawyer is trying to blame her without obviously throwing her under the bus. She can pay someone to do this for her but it sounds like she doesn't want to pay and is not taking this seriously. If she doesn't comply, she could lose the case without it even going to trial.

So my job currently is analyzing and organizing documents from various lawyers for experts to testify. At least once a day we get files sent that 500 or so individual docs. Not pages. Docs. With most of them being 10 to 20 pages long. Some going up to 200 pages at once. Sadly I've come to find out that most (I'm sure not all) lawyers are the most disorganized with docs. Especially discovery. We call it document dumping. Then they will be like here's these docs and our trial is in 4 weeks. Have fun. -_- I mean thankfully it looks like I will always have a job...

YES…this information should 100% be easily accessible. When you are a business owner and you’re selling goods and/or a service, and you’re selling via the internet, there is NO way there’s not information in regards to who purchased what, what plan they purchased and WHEN they purchased!! NOOOOWWW, I say there’s “no way”, but if she had deleted her ENTIRE website after being sued or when everything went on national news, finding all the women who purchased from her COULD be an issue. I can only see this being an issue if she had wiped everything clean when she got caught. I’m speculating, but I don’t think I’m wrong!! This is probably the reason they’re trying to by so much time.

My hope is always that BD will show actual humility (not Instagram reel "humility") and just take responsibility, and do the right thing. But her face. Paypal does lock you out for fraud. I was locked out of mine and banned for life because a transaction was incorrectly auto flagged and they won't let me dispute it or view my old transactions from when my account actually worked. They do actually make it really difficult.

Look, that data has to be structured, if it's downloaded from PayPal or whatever. A short scrapping code should be able to go through all those pages and extract names and the other necessary information. I'd do it for her if she paid me lol. I don't believe that data is like a literature book where she'd have to read every single word to find where the names are, this is such an obvious effort to delay everything.

I think most class actions are civil. Like for suits against companies that led to people getting mesothelioma, or malfunctioning medical devices, exposure to toxic chemicals. Typically the goal is to settle to pay out everyone in the class action lawsuit from what I understand.

This isn’t a class action. This is a consumer protection case brought against her by the state attorney general. A class action is a civil case where a plaintiffs attorney represents a small group of people, or class. There’s no class here, just the AG suing Brittany for violating trade laws.

A few have already mentioned here that she's likely locked out of her PayPal account because of reports of fraud. I would be furious with PayPal if they gave her access once again to her victim's information to do god knows what with. At the end of the day, PayPal is locking her out to protect those customers. Her lawyer did go as far as to suggest that the DA's office subpoena PayPal for the records, I wonder if that's the route they will end up taking.
