Shawn was just trying to walk home from his favorite karaoke bar, but Officer Fratto thought Shawn looked suspicious, so he began to follow him (and scare him) as he was walking home. Shawn had committed no crime. No crime had been observed or reported. Fratto eventually jumped out of his police cruiser and detained Shawn, claiming he saw him illegally jaywalk. He demanded Shawn provide his “ID.” However, Shawn answered all questions asked by Fratto, who never asked Shawn his name or date of birth. Shawn knew that he was being harassed and did not want to provide his ID to Fratto, who continue to bully him and escalate the situation. Fratto chose violence and took Shawn to the ground, injuring him. Fratto’s supervisor showed up and helped coverup the misconduct. Luckily, Shawn had a friend from the bar who helped him get the bodycam footage and communicate to the prosecutor and judge in court, resulting in the bogus charge being dismissed. But unfortunately, the incident has had a lasting negative effect on Shawn. I don't understand why the officer asks for ID? If you're not driving they can only ask for name and info (not that this individual did anything wrong). I see lots of cops across the country wanting the ID.

Effective 5/12/2015 41-6a-1003. Pedestrians yielding right-of-way -- Limits on pedestrians. (1) A pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles on the roadway. (2) A pedestrian crossing a roadway at a point where there is a pedestrian tunnel or overhead pedestrian crossing shall yield the right-of-way to all vehicles on the roadway. (3) Between adjacent intersections at which traffic-control signals are in operation, a pedestrian may not cross at any place except in a marked crosswalk

Federal Court needs to step in and no longer allow these body cams to be muted. Any officer muting or covering the lens should be charged with tampering with evidence. These actions are nefarious.

Ive been noticing a lot of body cam videos of cops trying to arrest people for "jaywalking" popping up lately. Seems like not crossing a street "correctly" is justification for state sanctioned violence to lot of cops.

The guy who stomp kicks his dogs and punches them over and over. The cops did nothing while the dog abuser tells the cops that his son who is like 6 is going to be an officer. The kid also broke their window and took chunks out of my friends stucco house. And since he was turned in for dog abuse. He now flood lights my friends bedroom. A lady fighting cancer with a medically fragile kid. The 6 year old is constantly swearing. Hitting things. You hear him beating his little sister. So yes, cops like this are raised by parents like my friends neighbor.

There's a very large Special Olympics presence in my area, and if this happened here, there would be HELL to pay! I can't explain just how angry I am at this situation!

Yes, Please sue them!! By now that police department should be well aware that he is disabled and that they should lay off him. I’m not saying that disabled people should be given a free pass to break the law. BUT HE DID NOT BREAK THE LAW IN THIS CASE! I do think they (developmentally disabled ) deserve extra patience and should be given the benefit of the doubt. It should be easy for the police department to provide all of their officers with your brother’s name , photo, and area where he lives and places that he typically frequents. No excuses. This cop should also be fired. He’s an 1diot. He made a huge deal out of nothing, lied and exaggerated when recounting what happened, and couldn’t figure out that this man had a disability. And to top it off he doesn’t even know the law for his area. Then when he and his supervisor realized that they were wrong about the law, they didn’t have the decency or integrity to admit it. They still felt the egotistical need to feed their fragile egos by citing a different infraction than they had ever accused Sean of in the first place.

When an officer stops, mutes his/her own body cam while on a traffic stop or any contact with the public that officer MUST be charged, prosecuted for tampering with evidence. The body cam and footage belongs to the taxpayers and public.

Judges should be required to instruct juries to draw an adverse inference when cops disable, in any way, body or dashboard cams. Including "forgetting" to turn them on, etc.

The way he followed him slowly, saying stuff to him out the window, felt so predatory. Making it very obviously that you're following someone late at night, then saying, "Why are you running?" is blatant harassment. Once I got arrested when I called for a domestic violence my boyfriend was fried off meth and they took me in cuz they said their captain told them to and it ruined my career for a year I lost my job and my ex punched me in my head strangled me busted my lip and gave me a black eye. I wish I would have sued the police. He also searched me and was talking dirty to me until I told him stop and finally a female came to finish the search he kept asking if I’m wearing panties. Super disgusting. They accused me of being on drugs and I did a test and was clean for everything while my ex got released cuz I was crying and acting “crazy “. I just got beat up and arrested and sexually harassed and falsely accused of using drugs ! wtf. Whole time my ex was beating on me on and off for years and I finally snapped and called for help I was tired of being his punching bag. I regret calling the police and will never call them again I would rather take another beating from my ex than lose my job again. Seriously nothings worse than being broke and losing my home

I live close to Clearfield and work in the city. There are very few crosswalks and the only crosswalk I am aware of in a parking lot is at an elementary school in the area.

They tried to make my dad do a sobriety test, he was missing half a foot, and his blood sugar was dropping, he needed food, but he wasn't so dad that he couldn't drive but he was by the time they were done,

Ironic that this man, even with a mental disability, had a better grasp of the law than this officer or his supervisor. He knew he was under no obligation to ID and that any threat of arrest was illegal.

i was actually in one of the apartments nearby this scene, i remember, i was shaking under the covers terrified at the prospect of a potential jaywalker outside my house. once i saw red and blue lights blaring outside my curtains, the shaking all of a sudden stopped. i knew my instinct was right that there is a dangerous person nearby jaywalking, and seeing the siren lights really made me feel safer knowing theyve most definitely caught the deviant. thank you CPD!

@@nukepuke932 Yup. Exactly. So other severely disabled people like my mama who’ve been mistreated by authority can get effed by the police over and over again. Even if it’s a fraction of a penny, it’s the principle of the matter. These lawsuits need to be taken directly from a pool of shared police pension. Not only would that stop them from being such bullies, it would FORCE police officers to hold each other accountable. Nothing changes someone’s tune faster than money.
