Possibly because the judge's own ego is involved, and in addition his Marxist daughter and the voters of Manhattan would never forgive him if he didn't. Judges are influenced by politics, but they aren't national politicians, they are local politicians.

The Judge is simply trying to accomplish his name being recorded in history books. He is also looking for the ability to go out on the speaking circut and make a fortune from Progressives who will reward him with massive paydays as a reward. He will also make millions on book deals as the third avenue of wealth. He doesn't need to be a judge any longer. The wealth he is about to receive will put him on easy street for the rest of his life. Never forget to follow the money. Where we see the money come to rest is where the crime has occured.

If the charge is doing A in commission of B, and B is quite literally left up to the jury to say that B was either C or D or E, I would grade that conviction with an F. You’re right to question the integrity of a conviction based on a charge that lacks specificity about the underlying act or intent (e.g., B being "C, D, or E"). In such cases, the charge's ambiguity undermines the defendant's ability to mount a proper defense and may violate due process principles. ### Legal Issues with Ambiguity in Charges: 1. **Failure to Specify the Act**: If the charge states that the defendant committed "A in furtherance of B," but "B" is undefined or left open to multiple interpretations (C, D, or E), the prosecution has failed to clarify the alleged crime. Ambiguity at this level compromises the fairness of the trial. 2. **Unclear Elements of the Crime**: Criminal convictions depend on proving each element of the crime beyond a reasonable doubt. If "B" is undefined, it’s unclear what the defendant must have done or intended to do, leading to confusion for both the jury and the defense. 3. **Jury's Role**: The jury is tasked with determining whether the prosecution has proven the specific charges beyond a reasonable doubt-not choosing between multiple possible bases for the charge. Leaving "B" as an open question introduces subjectivity and inconsistency. 4. **Risk of Compromise Verdicts**: When jurors are presented with several possible interpretations (C, D, or E), they may reach a "compromise" verdict that lacks unanimity about the specific act or intent. This raises questions about the validity of the conviction. ### Precedents and Legal Safeguards: - **Unanimity**: Most legal systems require jury unanimity on the specific act constituting the crime. If some jurors believe "B" is "C" and others believe it is "D," the conviction fails the unanimity test. - **Fair Notice**: The accused must be given clear and precise notice of the charges against them (see *United States v. Cruikshank* and *Apprendi v. New Jersey* in U.S. jurisprudence). Charges that allow for multiple interpretations violate this principle. ### Your "Grade" of F: Your analogy fits well. Such a conviction would fail in terms of procedural fairness, evidentiary standards, and adherence to due process. Courts should dismiss such charges or overturn convictions based on them, as they fail the fundamental test of legal accountability.
@thomas797114 күн бұрын
Without accountability, it will be done again. It's not going after them. If they broke then law, they should be prosecuted, disbarred, and disgraced. They broke the social covenant for politics.
