Welcome. Distinguished leaders and esteemed colleagues, good afternoon! My name is Wang Yong, professor at China University of Political Science and Law. The topic of my speech is regarding Zhang Zhehan’s 813 Incident and the rule of law. On August 13, 2021, an incident happened - August 13 Incident. Here is the brief case description of this incident. On August 13, hundreds of marketing accounts on Weibo and Wechat simultaneously posted photos of Actor Zhang Zhehan traveling in Japan in 2018. Photos of him in a cherry blossom park. Netizens’ opinion convicted him of worshipping the Yasukuni Shrine. I don't know this person Zhang Zhehan before December last year. I have never watched his TV dramas. Even now I cannot name a TV drama that Zhang Zhehan has appeared in. However, as a law professor, along with our fellow law professionals, we are all paying special attentions to this incident. We have studied this incident independently. We consider this incident a serious violation of the rule of law in the era of Internet. It is a residual atmosphere of the Cultural Revolution in the era of internet, which should deserve the highest attention in the law field. I will discuss this incident from three perspectives: factual issues, legal issues and political issues. Factual issues. During the 8-13 incident of Zhang Zhehan, netizens accused and convicted him of worshipping the Yasukuni Shrine. This establishes a case of slander and libel. Defamation has three characteristics. 1st is the traditional techniques. His photos in cherry blossom park were tampered with Photoshop to change the background to Yasukuni Shrine. 2nd, the higher class method - altering of the Baidu entries. Zhang Zhehan and Lady Dewi was photographed together, while they attended a friend's wedding. We know Lady Dewi is an old friend of China, wife of President Sukarno. However, one day before August 13, someone altered her Baidu entry. They switched the name of her late husband from President Sukarno to President Suharto. Suharto is the one responsible for mass massacre of Chinese-Indonesians. What a coincidence in the timing. The 3rd characteristics: over 800 marketing bots including WeChat accounts released this false news at the same exact time. Plus huge amount of robots and water armies commented on the relevant news reporting posts. Some of our official media outlets were not aware of the facts, perhaps because the operators were young and inexperienced staff members. So they reposted these info. And the public opinion quickly spiraled out of control. 4th characteristics: China’s Association of Performing Arts (CAPA) used false information and rumors on the internet, to enforce an Internet boycott of Zhang Zhehan, without following formal procedures. On August 15th, CAPA directly released the list of immoral artists, to enforce a industry-wide boycott against Zhang Zhehan. Such are the 4 main characteristics of this incident. Now what are the legal implications of this? First, when a citizen's reputation and personality rights are violated based on fabricated truths, under Civil Code, this is slander and defamation. This constitutes as defamation according to the civil law rules, and the people's court should file the case。 However, when Zhang Zhehan, as an ordinary citizen of People's Republic of China, filed a lawsuit for defamation or infringement of reputation, the People's Court refused the case. This goes against the Supreme People’s Court’s established case-filing registration system, which it repeatedly emphasized at the end of the year, that citizens' prosecutions cannot be refused. Complete contradictory - we don't know where the powers of this session of the People's Court come from? 2nd, which is somewhat pleasing to hear, that Zhang Zhehan reported his case again as "criminal defamation". The public security department has accepted it and is now waiting to file a case. The 3rd issue, a legal one, is about CAPA CAPA should have followed formal procedures when it listed Zhang Zhehan as an artist with bad behaviors. The association says it was through its ethics committee. But the member list of this ethics committee, its procedures, hearing procedures, are all missing. From 8-13 to 8-15, such a short period. Secondly, can an association punish some actors using words: "artists with bad behaviors"? In my opinion, the laws should forbid anybody from being insulted - It is a basic principle. Even criminals are spared of insults according to the law. They can be penalized, but not publicly shamed. How can an association have the power to take the 2 words "bad behaviors" from a 4-words idioms to label others? Terms in law must be technical, not to mention a word like "bad". The hidden meanings can be contradictory. Who are bad? People who "break laws" or "lose morality"？ Then Zhang Yimou who violated the National Family Planning policy to give birth to 3 children, and got fined for over 7 million Yuan - is he also an "artist of bad behaviors"? There are still more such cases. Who are bad? Who are not? CAPA is not a legislative body, but they still must abide by the basic principles of the law. This is the 2nd point. The 3rd point: CAPA is not an administrative agency. Yet their conjoined boycott are indeed administrative penalties. Enforcing the industry prohibition of administrative punishment, depriving citizen's labour rights stipulated in the constitution. But there is no guarantee of procedure The 4th issue involves the anti-monopoly law. Paragraph 5 of Article 13 of the Anti-Monopoly Law clearly states that: conjoined boycott is a behavior of monopoly. Under the organization of the association, the publication of such a list, and the call for a boycott, completely constitutes the violation of antitrust law under Paragraph 5 of Article 13. As an association, doesn't it have a political stance on the anti-monopoly law that the central government attaches great importance to? The 3rd issue is the political one. I'll bring up three points of views here. 1st, we should be at alert to the legacy of the Cultural Revolution in the Internet age This era of ours has a biggest characteristic, that is the artificial intelligence of the Internet. Capital. Capital controls the platform; capital has advantages; capital has the monopoly; Capital owns the algorithms. Under this situation, as the other speaker has mentioned, where is the news? Where is the truth? It's highly possible that everyone of us is currently inside a little dark room, while the real truth, real news are under the control of those technologies. The incident of Zhang Zhehan I mentioned earlier fully demonstrated this technical feature. This is the 1st point that we must be alerted to. Be alerted to the pitfalls of the Internet era. These technologies can completely ignore the laws. Can violate the basic rights of citizens. Can also use technologies to attack its competitors. 2nd point - we must beware of False Nationalism We Chinese all love our country. We all are hot blooded. This is our precious nationalism and patriotism. But nationalism and patriotism can be true or false. Some people utilize nationalism and patriotism to attack their competitors. They use nationalism to create public opinion terror, and persecute our own Chinese nationals Chinese persecute Chinese themselves - this is essentially an anti-nationalism, anti-patriotism. So we must be aware. 3rd point: we must insist on the rule of laws in this era. Law is the biggest political matter. The Party Central Committee has issued the resolution on the rule of law in 2014. The rule of law is a principle that the central government attaches great importance to. The rule of law is related to the basic rights of every citizen To put it into practice, that is, judicial review by judicial organs, judicial trials, and judicial filing of cases are the last barrier to protect the basic rights of citizens. We cannot use vague reasons, slogan reasons, or procrastination to reject a citizen's request for defense and protection of his rights, or a request for filing a case. If we can't even do this one thing, then our case registration system is nothing but a dead letter. If we can't even do this one thing, then how can we build a country ruled by law? So my topic today is the Zhang Zhehan Incident. The victim is the individual Zhang Zhehan himself. However, if the 3 issues are not resolved, the victim will not be limited to one person, Zhang Zhehan, but can be you, me, and others in the future. Everybody can become a victim. That's why in this era, it's more important for us to pay special attentions to the rule of law, to resolve social conflicts and ensure economic development and political stability. Therefore, I hope Zhang Zhehan Incident can arouse our great attention. Thank you.

🔥🔥🔥《从张哲瀚事件看法治》🔥🔥🔥 在2021年8月13号，发生了一起“813事件”。这个事件的简要案情是这样的：在微博上数百个营销公号，微信公号同时发布了演员张哲瀚在2018年的一次的日本旅游，在樱花林拍的一张照片，舆论将其定罪为“参拜靖国神社”。 在去年12月之前，我都不知道张哲瀚这个人，我也从来没有看过他演的电视剧，我现在都说不出张哲瀚演了哪一部电视剧。但是作为一个法学教授，和我们法学同仁，对这一事件高度重视，我们对此进行了独立的研究，我们认为这个事件是网络时代一起严重的破坏法律制度的事件，是网络时代的“文革遗风”事件，应当引起法律界的高度的重视。 主要有三个问题：第一是事实问题；第二是法律问题；第三是政治问题。 事实问题 在张哲瀚的“813事件”当中网络定罪其“参拜靖国神社”。这是一起诽谤事件。 第一，是传统的技术。将张哲瀚在樱花林的照片通过技术的PS，将背景更换为靖国神社； 第二，是修改百度词条。张哲瀚和黛薇夫人在参加一个朋友的婚礼当中，与黛薇夫人有一张合影。大家知道黛薇夫人是中国的老朋友，苏加诺总统的夫人，但是在8月13号的前一天，有人将黛薇夫人的百度词条进行了修改，将黛薇夫人是苏加诺的夫人改为苏哈托的夫人，而苏哈托是屠杀华人的罪魁祸首，时间是如此的巧合； 第三，是舆论最终失控。是有八百多个营销公号、微信公号在同时发布了这个不实消息，还有大量的水军、机器人在相关的报道下面进行评论。我们有些官媒，不明真相，也可能是小编在那操作，转发相关的这些消息，舆论最终失控。 第四，中国演出行业协会未经正当程序的联合抵制。利用网络上的这些信息，没有经过正当程序，采纳了网络意见，在8月15号发布“劣迹艺人名单”，进行全行业对张哲瀚进行联合抵制。这就是这件事的四大特点。 法律问题 第一，涉及到一个公民的名誉、人格权受到侵犯，捏造事实，这就是《民法典》所规定的诽谤和侮辱。它构成民法上的诽谤的名誉侵权，人民法院应当立案。但是张哲瀚作为中华人民共和国的一个普通公民，在向人民法院提交诽谤名誉侵权的起诉状，我们的人民法院拒绝受理。这个和最高人民法院关于立案登记制，并且年底一再强调的不得拒绝公民的起诉是完全相悖的！我们不知道这些人民法院的权力是从何而来！ 第二，比较让人欣慰的是张哲瀚提起了刑事诽谤主张，公安部门受理了，现在等待是否立案程序； 第三，关于中国演出业协会，中国演出业协会在将张哲瀚列为“劣迹艺人”，应当经过一个正当的程序。 1、协会说是通过一个道德委员会，但道德委员会的名单、程序、听证程序，一概都没有说。从8月13号到8月15号，时间相差极短。 2、一个协会在惩处一些演员的时候能不能用“劣迹艺人”这四个字？我认为，法律不侮辱他人这是一个基本原则，法律连犯罪分子都不能侮辱，只能是惩处，不能游街，不能示众。一个协会哪来的权力，能用一个成语上的“劣迹斑斑”的“劣迹”去定义他人，法律的词语应当具有禁止性，更何况“劣迹”这个词，内涵也很模糊。哪些人是“劣迹”？违法失德都是劣迹。那张艺谋当年违反计划生育生了三胎罚了七百多万，这是不是劣迹艺人呢？还有林林总总、诸如此类，哪些是“劣迹”的，哪些不是“劣迹的”呢？协会虽然不是立法机关，但是应当遵循法律的基本原则给与一个标准。 3、协会不是行政机关，但是他做出的这样的一种联合抵制，实际上是一种行政处罚，是行政处罚中的行业禁令，是对宪法上所规定的公民的劳动权的一种剥夺，但是在程序上没有任何保障。 4、涉及咱们的反垄断法第十三条的第5款，明确规定了联合抵制交易是一种垄断行为。在协会的组织下，所发布的这样一种名单，并且号召联合抵制完全构成了反垄断的第十三条第5款。作为一个协会，对于现在中央高度重视的反垄断法难道没有一点政治立场吗？ 政治的问题 第一，要警惕网络时代的“文革遗风”。我们这个时代在技术上有一个非常大的特点，就是网络、人工智能、资本，资本控制平台、资本具有优势、资本具有垄断地位，资本拥有算法。在这种情况下，正如刚才张建伟老师所说的，新闻到底在哪里？真相到底在哪里？很可能我们每个人都被关在一个小黑屋里，而真正的事实、真相、新闻是被一个技术在操控，刚才我所讲到的张哲瀚事件的813，就完全展现了这样一种技术特点。这是我们要警惕的第一点，警惕网络时代的“文革遗风”。这些技术它们会完全不顾法治，侵犯公民的基本权利，并且用技术来打击竞争对手； 第二，一定要警惕虚假的民族主义。我们中国、中国人民都是爱自己的国家，都有一腔热血，这就是我们的珍贵的民族主义和爱国主义，但是民族主义和爱国主义也有真假之分。有一些人现在利用民族主义为了打击竞争对手打击他人，利用民族主义来制造舆论恐怖，来迫害中国人自己，中国人迫害中国人自己这本质上就是一种反民族主义，反爱国主义，所以我们一定要警惕。 第三，一定要坚持法治原则，法治是最大的政治。党中央在2014年就发布了依法治国的决议，法治是中央高度重视的一个原则，法治关系着每一个公民的基本权利。落实到实处，就是司法机关的司法审查、司法审判、司法立案是保障公民权利的最后一道屏障，我们不能以模糊的理由、拖沓的做法来拒绝一个公民为自己权利的申辩和保护的诉讼请求、立案的请求。如果连这一点都做不到，那么我们的立案登记制岂不是一纸空文，如果连这一点也做不到，我们的法治国又如何建立起来？ 今天主题是张哲瀚事件，受害人是张哲瀚个人，但是刚才讲的三个问题不解决的话，在今后受害人就不仅仅是张哲瀚这一个人，可能是你、我、他，每一个人都可能成为受害人，所以在这个时代我们更重要的要高度重视法治，以法治来解决社会利益的冲突保障经济的发展和政治的稳定。
