Hello sir, I noticed a mistake in the first answer itself, First point of first answer, it is not a MISTAKE OF FACT as mistake of fact clearly states that when both the parties are at cross purposes (bilateral mistake) , it is then considered a mistake of fact. The correct answer would be SECTION 56- IMPOSSIBILITY EXISTING AT THE TIME OF CONTRACT, or initial impossibility. Thankyou for the Lecture, it was overall helpful.❤

I think it can't be initial impossibility as it states that it should be obviously impossible from beginning but in this case it is rather a mistake of fact that they believed it to be possible.

It rather appears to be a case of Supervening or Subsequent Impossibility arising due to the destruction of subject matter essential to the performance of the contract. The horse is the dead subject matter so...
