Colonial and apartheid-era laws are currently under review through published Discussion Paper 162. The South African Law Reform Commission has recommended that some of the laws be repealed. Naledi Moleo speaks to the project leader Prof. Shannon Hoctor.

I wonder why EFF was ignored and called all sorts of names for advocating for this exact exercise. There is plenty of evidence to show that for many years now EFF have been saying apartheid laws shouldn't be applicable in a democratic state but media and the gullible called EFF anti-constitutional.

The reality is that for many years now EFF have been saying apartheid laws should be repealed. But as usual the media seem only able to project the voices of the colonisers

I remember very well that Malema accused the government of using apartheid laws to prosecute him. We need a new constitution that is Afrocentric, and we need to repeal all apartheid laws

It's not about constitution. ANC Presidents entrusted with uplifment of people failed dismally to implement freedom charter and what was contained in the constitution. Zuma was one of them. Today he is making noise all over, 9 wasted years

For 30 years the ANC did not review the Apartheid laws. Visit that "sunset clause", Prof and change it to "sunrise".

There is a lot that need to be repealed, actually we must begin to draft a new constitution now and not later. We must do it line by line word by word. I once said in SA we don't have judges but cheque collectors and it is not an insult

In my view the constitutional amendments that MK and President Zuma have talked about is what has woken up the ANC and its handlers to repeal these laws😂😂

I don't know...to call the observance laws of our Lord, 'Apartheid' or 'colonial' is more than a little disingenuous 😶.. Some things are timeless 😊

It is good to remind us that these laws were enforced on us by the Dutch. Where is the laws under which the Sovereign nation or Aboriginals abide. The Aboriginal people did not give their consent to these laws.

Since all laws, past and current, are governed by the Constitution and are null and void if they conflict with it, I don't think there's any reason to panic. I believe that the drafters of the current Constitution anticipated how difficult it would be to remove these laws, which is why we switched from a system of parliamentary sovereignty to one of constitutional sovereignty. In contrast to earlier times, our current 30-year-old regime permits judges to invalidate legislations that violate the Bill of Rights, either completely or only to extent that they contradict it. While it is a moral obligation to repeal these antiquated, cruel, and racist laws of the past, the fact that we haven't done so yet shouldnt be trainsmash (so we should throw the baby out with the bath water) because the current Constitution safeguards against laws that violate our rights, E.g. The freedom of religion, the right to assemble etc.

My question z y d word apartheid z regarded as a very evil systems by d world law but you'll nvr find a word apartheid in our own constitution,you will nvr find a word atrocities yet d fundamental problem of this country's inequality z rooted on these 2 things I've jst mentioned.Make it make sense pls.

@@Qotha those are very few. Most bussiness people i know, MAKE DEBT in order to pay their employees salaries. They make debt in order to keep the business going amd when they go home at night they are poirer than poor. Nope....the lavish spending of governt people is so noticable. Greed and pride has swallowed our poor country.

@@Qotha and also dont forget according to marvericks report on how the upgrade of jm house in sandton was done. Poor people investing in vbs. The money received for free by jm and shivambu was there very own peoples long saved money for their retirement. At least rupert has lists and lists of where they donate their money to uplift the poor not steal from them

Don't you also think we should accelerate things like land reform, or do you think people should wait 50 years after apartheid has ended before they can be given access to land in their own country? We all know that apartheid colonization and were declared a crime against the humanity of black South Africans.

The issue of these old acts is completely irrelevant, just like the mk and zupta. Rather concentrate on drafting new laws on drinking and urinating in public, and any other law that will civilise the unruly section of society.

😂 Funny how white people find a way to identify a problem when the decendants of their great grandparents victims become emotional when being given a picture of their bloodlines past . It you where given details of exactly how your great grandparents were oppressed in their time , you would also have some emotional inclination
