@@loveofthegame2015 not yet still waiting to be contacted by the court to send them my medical records. Out of 15000 personal filing to date let alone the almost million filings by lawyers I believe the court has only payed out a few people who have been fighting much longer than I have. The final deadline to file is August 2024 then years in waiting for a response. Now thanks to multiple lawsuits on the case, there is so much red tape; one would have to be near death door to get anything

If a claimant of the Camp Lejeune Lawsuit was receiving benefits for a related condition from the drinking water and settles his case, and there were offsets will he stop receiving future benefits ? or will that be a condition in the settlement agreement ?

I know of no veterans who successfully have solely claimed their service connection with regard to the poison waters they drank and bath at in Camp Lejuene. So I suspect the answer is it will likely not affect the service connection disabilities you are receiving now. Cheers

Thank you for the updates My husband was in the gulf war and stationed at camp legune after 1987 in 1990. A tumor grew in his mouth while there and grew, metastasized when he came home. It has now come back. Could he file ?

Yes but only if he is positive for MGUS. This would suggest strongly the the government did not clean the water at Camp Lejuene after 1987. So go to the VA and specifically request an MGUS evaluation. Not a lawyer; but Hope I helped. I am a Vietnam vet with 10 percent service connections for agent orange only. Under the law if I win my case against the Marine Corps while I spent my month in Camp Lejuene it cannot effect my current 10 per service connection regarding my stay in Vietnam. They are separated and distinct from the other.

Veterans need to find out the impact of attorney fees on their Camp Lejeune claim/lawsuit, particularly if there ends up also being an offset against the VA benefits they have received and will receive in the future. Also, ask why most of these law firms are seeking a higher percentage of fees than the Federal Tort Claims Act's 20% (if a settlement) and 25% (if a trial) caps on attorney fees.

This touches on my thought. If someone is awarded 100K the attorneys fees will be based in this rather amount leaving the amount at 75K for the Vet. but the offset will be calculated on the full 100K reducing the award even more?

@@59Gretsch Yes, that seems a very valid concern. The veteran ends up paying a huge legal fee in exchange for an overall net loss in moneys received.

This is why I educated myself and will represent my self and travel personally to the designated court in South Carolina. I now have my assigned docket number that gives me the legal right to make my personal claim If I win my case against the government I want it all. No lawyer can possibly argue better then your’s truly. Cheers

Suppose i was awarded 100% for ptsd. Further down the road i am diagnosed with bladder cancer. Of course the va picked up the tab except for what my health insurance paid. Is that considered an offset to be paid back out of my settlement?

Not likely as you have never filed service connections with regard to Camp Lejuene. Have you? One thing for sure your PDSD from Vietnam of 100 percent is well deserved and has nothing to do with any claim against camp Lejuene as PDSD it is not linked to the poison water of camp Lejuene. However ask your VA for a MGUS test and if it is positive you may have a justification for filling under the current PACT Act Hope this help. Not a lawyer.

My husband was in camp lejeune he was in the Marines he was a corporal in the Marines and there's paper work that state that he was in camp lejeune he had cancer in lungs lymph nodes and bones. How can I file a claim.

Yes on behalf of themselves only. Wives of dead veterans may file a secondary claim for widow benefits. Not a lawyer Just as the veteran must file the claim on their own behalf and not his family members affected
