Honestly they cannot stop you if you resign right away worse if you were a permanent staff, and let's say example you have health issues and need to leave ASAP and don't wish to share that with them you don't have to.

I passed immediate resignation due to babalik ng school and wala pong mag aalaga na sa tita ko sa bahay because of disabilities, pero pinaparender ako still ng 30 days

what if the employee resigned before hand sample: november 2021 filed and effective february 2022, but it was not acknowledged by the immediate superior then the employee continued and filed irrevocable resignation on april 2022, is this acceptable by law?

Me they won't pay last cut off :( I'm so depressed. They don't care about employees. I will not sacrifice my health to this bad company. But they demand 30 days. I can't longer work it will worse my health.

The question is what If you need to resign asap and you can't render 30 days anymore? They were not able to answer this. What if you have no choice and you can't miss the opportunity.

As per the labor code, it is mandatory to render 30 days upon resignation. However, it is the discretion of the company when you want earlier date. It is the right of the employer. Depende na sa inyong agreement basta maayos kang nakipag-upas, or else you are liable for damages.

Wrong! Wrong! Wrong! The Labor Code says "at least 30 days", not 30 days. So if the contract you signed says you have to render 60 days, you have to render 60 days. There's a big difference between "30 days" and "AT LEAST 30 days". If you'll do a vlog about this, get your facts straight.

There’s two rules on filling resignation. With cause or without cause. With cause is a emmediately resignation which is on the labor code i forgot the article. And if you emmediately expext no separation pay

@@mckinleygregorio5237 Yes. There are provisions in the Labor Code that justifies immediate resignation, such as: 1. Serious insult by the employer or his representative on the honor and person of the employee; 2. Inhuman and unbearable treatment accorded the employee by the employer or his representative; 3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and 4. Other causes analogous to any of the foregoing. However, my issue is these people in the video claims that the 30-day notice is absolute when the law clearly states "AT LEAST 30 days". The law states "AT LEAST 30 days" because if your employment contract says you have to render 60 days, then you have to render 60 days. Which makes me question if these people in the video are really "lawyers".

Ask ko lang po, 2 days palang ako sa training at gusto ko na po mag resign. Nakasulat po sa contract ko na "AT LEAST 30 DAYS" . Pwede po ba ako agad mag resign di ko po kasi kaya mag trabaho eh.

@@maryjanecantos6717 That will be up to your employer kung papayagan kang mag immediate resignation. pero kung hindi sila pumayag, then you have to render the agreed notice period. Wala naman nakalagay sa contract mo na pag 2 days ka pa lang, pwede ng hindi mag render. Sa susunod kasi, huwag mag apply sa trabaho na hindi naman pala kaya.

I don't get a contract from that company. They say they won't pay me and I will be AWOL. I worked with that so much , and I have health concerns now. I can't work anymore for 30 days more. I don't want to sacrifice my health for them. They don't care about my health

Applicable din po ba yung 30 day period sa mga Job Order Employees sa NGAs? Since wala na man Employer-Employee Relationship as Section 7.4 of COA-DBM Joint Circular No. 1, Series of 2017 provide.

Question lang po, di nya ko kasi na tackle to especially in these era of pandemic: What if the employee resigns due to fear of unsafe working space? Like, unsanitary yung workplace and one might get COVID from it. Like, the employee is often getting sick since working but is fully vaccinated. Is this reason still part of the "no turn over" resignation? Thanks po and God bless.

Hope you can see this. I worked as a consultant, technically my contract expired over a year ago but I was still acting as if I was a consultant/employee doing regular employee duties. This past week they brought me in as a full time employee. With the changes as a full time employee I have to clock in, so they credited me for a week of work as a new employee but didn't acknowledge me as my last week as a consultant and hasn't paid me that fee. What can I do?

good day atty.. what if ayaw ng employeer magbigay ng clearance form sa employee? does the employee need to render his/her 30days turnover? and after turnover without giving a clearance form from the employer, does he/she should sign the Quit Claim and have it notarized?

Gusto ko man po ilaban yung immediate resignation ko due to uncomfortable working environment dahil I really feel that all employees that day are bullying me indirectly, I prefer to be silent na lang kasi baka mabaliktad pa ako ng company at ako ang matalo. I have recorded the scenario/talks that day but the record is not so clear so that I may have evidence. I decided to immediately resign bago pa matuluyan ang mental health ko. I am going home crying thinking bakit sila ganon sa akin. And now, I have the difficulty to apply in a well-known company because I don't have COE.

If you asked for guidance at the time it was happening, we would have suggested taking it up with higher management to see if they would intervene or hold people accountable. @@LegalGuidePhilippines Actually the higher management also doesn't care. I think there were already 6-10 employees last year and this year is already 6-8. I don't know if it's the employees have problems or it's the company.

Hi Jomon, good for you po. I'm happy to hear that you were able to resign immediately. #SanaAll ganyan ang ending. However, I just want to warn everyone else that just because you were able to resign immediately doesn't mean it will be that way for all people. There are legal requirements and corresponding legal consequences if these are not followed. If you fell under the exemptions to turnovers, then no wonder po naka resign kayo immediately. If you didn't fall under the exceptions to the turnover and yet you left without the 30 day period, then consider yourself fortunate po because discretionary naman po for the employer whether to enforce the consequences. They just chose to let the matter go. Again, the reason we do videos like this is so we can teach both employers and employees the proper (and fair) way of resigning so that everyone is safe. Tama lang po na ihold nila ung sahod .mo .. kahit napasok ka pa... 15 po ung sahod ko tapos effective po ung resignation ko ng 19... Payroll ko 26 to 10... Sinubukan ko po kasi magpaalam ng 15 days lang.. naiitindihan ko po.. kung i hold nila ung last pay ko.. pero ung sahod kahit pumapasok ka pa parang mali po thanks po kung masasagot nyo

Sir ask ko lang po, 3 days after ko pumasok want ko na po mag resign, and nung 4th and 5th day ko po di na ako pumasok kasi po di ko na po talaga kaya, and now po nagpunta ako ng agency asking for resignation kasi may balak po ako lumipat ng work, ayaw po ako payagan dahil daw po sa kontrata, and sabi na sasampahan daw po ako ng kaso, pag pinilit ko daw po mag resign, sana po matulungan niyo ko, thank you po

Hello sir, I passed my resignation a week after I started with my job. Though they let me start even though I haven't comply with all the requirements. Atty. I immediately resign sa company ko dahil gusto nila akong ilipat sa kabilang branch namin ng hindi nila ako inabisuhan or kinausap man lang so i decided to quit dahil na offend ako sa ginawa nila. What will happen po if nakapagsign na ako ng contract for 3 years, nakaka-1month palang ako ng pasok pero di ko na kasi kaya mentally. Ang sabi if hindi tinapos yung 3 years magbabayad daw ako ng 150k. Please, enlighten me of what should I do.

Attorney😢 paano po nagbigay nako ng letter of immediate resignation nasa training ako ala pa production under probationary ako 6month Nagpaalam pako ng pormal dahil di ko kaya yong work at ala nako pera para pamasahe at pambaon sawork ko ala naman ako mapagkukunan kaya di nako pumasok pinagrerender ako ng 30day pero paano ako makakapasok kong ala naman ako financial para ipamasahe sa work ? If hindi po papasok sa grounds for immediate termination, at hindi nakipag coordinate sa employer ng maayos tulad ng advise sa video, maari pong ma terminate under AWOL. Hope that helps po.

Paano yung probi ka. Tapos nag resign after 1 month. May 30 days prior notice. Sa loob ng 30 days. Nag leave absent, nakapag-paalam. Nakapagturn-over ng maayos tapos biglang nag atras yung mag papalit muna sa akin habang 3days leave ako? Bigla akong hindi pinayagan mag leave, 1 day before. Pero nagpatuloy pa rin ako. Hello po, pano po ba ang gagawin ko, or pwedi ko po ba kasuhan ung Manager ko? Kasi pinipilit po nila ako na mag return to office, currently po kasi naka work from home ako. Then sinabihan niya ako na kumuha ng recommendation from my Doctor which I did, nakapag provide ako ng recommondation that I am only allowed to work from home. Then na submit ko na din po yun sa kanya, and then now. They want me to work in the office even though meron na nga po akong recommendation from the doctor na WFH lang ako. Ano po kaya best na gawin ko.

How about if the company they extend only my vissa for 1 month and ill already sign the contract and i want to resign immediately because the schedule of my work are not right according in the write in contract. May tanong po Ako. Nag immediate resign kasi Ako sa previous work ko. Kasi lumipat kmi nang Bahay. At Hindi Kona kayang mag render nang 30 days kasi sa pasig nako nakatira. Ang trabaho ko ay sa paranaque. Sinasabi nang HR sakin. Hindi pa Ako cleared kasi nag immediate resign ako. Tanong ko po.. maari ko pa po ba makuha Ang last pay ko or Hindi ko na makukuha pa??? Paano po attorney kung nagfile ako ng resignation at hindi ko na tinapos yung 30 day advance sabihin mating naka 20 days pa lang yung resignation ko at yung natirang 10 days ay inabsent ko na lang sa dahilan naman na yung 6month contract ko ay natapos na at wala rin silang bagong kontrata o regulazation na pinapirmahan sakin. Puwede po ba ito?

Thank you for this info atty's/ How about those with employment bond? Based on signed contract, voluntary resignation will require me to pay the bond (employer spent amount in training). But I am currently having mental issues (panic attacks/anxiety), can I use my medical diagnosis as a reasonable cause for terminating my probe contract early, without paying such bond? I hope you can enlighten me on this. Thanks.

Check the contract if the bond excludes mental health situations. If not, try negotiating with your employer on this point. If not, then you'll have to comply with the obligations you agreed to, including the employment bond.

What if hindi po nakuha ang first salary nung 30th which almost a month kong hinintay to pay my bills, support my family and ma-sustain ang pagpasok ko sa work? Against na nga po sa Article 103 ng labor code ang ginawa nila. 5 days na po ako di nakapasok kasi wala na ako talaga mapagkukunan ng allowance. Worse, instead mag-special payout sila, isasabay na lang daw nila sa 15th yung sahod na hindi nabigay.. Sapat na rason po ba yun para mag-immediate resignation?

what if originally designated to location A after 10 years suddenly move u to location B and this doesn't work for you then decide to resign do i need to render 30 days?

may mga employee kami na papasok sa pagpupulis or pagsusundalo e gusto immediate effect na yung kanilang resignation kesyo mag-aasikaso daw kasi sila ng mga papeles nila. Ano kaya ang magandang sabihin sa kanila

Hi attorney's ask ko lang po kung consider ba ang emotional abuses and intimidation and defamation for inhumane treatment ?. Also during Pandemic they force me to signed some AWOL which i work in rental home. paanu po if yung manager ayaw pirmahan yung clearance at mag 30 days n po from date of separation ang sabi d po daw niya ibibigay kasi di po siya satisfied sa turn over ko at kulang kulang kaso kaya ako ng resign nkaka walang gana po n talag yung pakikitungo ng manager sa kin kaya naapektuhan n ang trabaho ko

Tungkol ko po sa 30 days notice. Tama po ba, Notice meaning, just to give them heads up right? Not sure bakit hindi pwede gamitin yung leave during render period or di counted yung VL

question po about sa BPO or ITO since call center agent lang kami and we don't turn over pero nasa contact namin we have to 60 days notice or else penalty is 2 months worth of your salary. So ang ending pag hindi mo natapos 2 months bayad ng penalty at hindi mo makukuha backwages bagkus me utang pa. Legal po ba yun? Salamat sa pagsagot po

Hello Atty., question po. I got a new job, but I just filed a letter of resignation the same day I got my new job. Start na agad sa new job ko, but I understand na need ko magrender ng 30 days pero willing naman po ako magrender while nasa new job na ako, adjust ng time siguro. Pwede ba ko mareklamo or kasuhan ng current employer with this? I did this because mahirap magresign if walang trabaho agad, sobrang liit na kasi ng sahod hindi na po kakayanin. Salamat po
